PREAMBLE With regard to fishing rights, Article 137 of Regional Law 31/2008 divides the aquatic environments of the Provinces into categories A, B and C, as well as public waters reserved for private use. Category A refers to large water bodies like lakes, with abundant, diverse fish populations which constitute an economic resource for professional fishing. The waters of Lake Idro (Lago d’Idro) fall within this category and are considered to offer the opportunity for quality fishing. The Province of Brescia, which is the local authority in the field of fisheries management, has sought to use planning tools in order to consolidate the ecological parameters of the aquatic environments and in order to restore the habitats, so that the ecosystem’s functional state can be ensured. The authority co-ordinates direct interventions in order to rebalance fish population and the population of birds that prey on fish, and also seeks to implement regulations for protecting
vulnerable species and supporting their populations without however imposing rules which would impose penalties on low-impact fishing activities. B. THE ENVIRONMENT AND FISHERIES ACTIVITIES Lake Idro is an important site for leisure and professional fishing. The town of Idro holds the exclusive fishing rights for certain sectors of the lake, while the inhabitants of the towns of Anfo and Idro can exercise their “civic” fishing rights over the whole water body, including the zone under the jurisdiction of the town of Bagolino. The holders of these “civic” fishing rights can use professional equipment. In other words, they are free to use professional resources, including nets, without having the status of professional fishermen. This right, granted to the inhabitants of these towns several centuries ago in order to provide them with the means to subsist, has become an anachronism as well as a source of obvious disparities and management issues. This “civic” right is exercised over the whole lake, and the equipment used is of professional quality. The high number of potential users of this type of equipment was becoming too great a source of pressure, enabling an excessive number of catches, particularly in the case of the most sought-after species. The risk was worsened by the gradual exhaustion of certain species referred to as (Source: P. CUCCHI / P. CASTELLI) being “noble”, that required optimal environmental conditions, and which, at the same time, were suffering from the deterioration of Lake Idro’s water quality. C. THE METHOD USED FOR RESOLVING THIS ISSUE a. Regulations For the whole of the Lombardy Region, the regulations are based on Regional Law 31/2008, which consolidates a series of texts relating to agriculture, forestry, fishing and rural development, as well as being based on Regional Decree 9/2003 (that has subsequently been amended), which regulates and co-ordinates fishing rights at regional level. However, these regulatory measures do not factor in the real “anomaly” relating to Lake Idro, namely the large number of people who benefit from this “civic” fishing right. The provincial fishing plan proposed introducing several restrictions, which are presented in section c. b. The consultative body for fishing The Province of Brescia, which is the local administrative authority responsible for the lake, bases its decisions on the regional regulations and on the provincial fishing plan, after receiving the opinion of the Provincial Consultative Committee for fishing. This Committee, which exists in each of the Region’s Provinces, was established pursuant to Article 135 of Regional Law 31/08, No. 10, which indicates that “the Provinces must take charge of the establishment of Provincial Consultative Committees for fishing. These technical and consultative structures must bring together the representatives of associations of amateur fishermen, associations of professional fishermen, fish farmers, environmental associations, and fisheries experts who must provide scientific opinions”. Not only does this Committee represent the social diversity of actors in the fishing sector, given the skills areas of its members, but it is also capable of proposing technical solutions to the various issues which relate to the sector. 33
