c) That the proposed development or use will be in harmony with the scale, bulk, coverage,
density, and character of the neighborhood in which it is located;
Staff response: Based on the information provided by the applicant, and due to the fact that
NC-540 is located immediately to the north and a 265 foot wide Progress Energy Transmission
line is located immediately to the west, the development as proposed is in harmony with the
scale, bulk, coverage, density, and character of the neighborhood in which it is located.
d) That the proposed development or use will generally conform with the Comprehensive plan
and other official plans adopted by the Town;
Staff response: Because the applicant will be constructing a greenway, the development as
proposed will generally conform to the Comprehensive plan and other official plans adopted by
the Town.
e) That the proposed development or use is appropriately located with respect to
transportation facilities, water and sewer supply, fire and police protection, and similar
facilities; and
Staff response: Based on the information provided by the applicant, the development or use as
proposed is appropriately located with respect to transportation facilities, water and sewer
supply, fire and police protection, and similar facilities.
f) That the proposed development or use will not cause undue traffic congestion or create a
traffic hazard.
Staff response: Based on the information provided by the applicant for other similar tower
sites, the use as proposed will not cause undue traffic congestion or create a traffic hazard.
Furthermore, twenty (20) additional findings for certain special uses, based on evidence and testimony
received at a public hearing, must be made in order for the Town Council to approve the SUP
specifically for a telecommunications tower (Part C, Article VII, Section 2.10 of the Zoning Ordinance).
The evidence submitted by the applicant in support of these additional findings is provided in
EXHIBIT B.
Finally, per the Zoning Ordinance, if Town Council approves the SUP, the use shall be exercised or
consummated within a time limit set by the Town Council or within one (1) year if no such time limit is
established. Otherwise, the permit shall be null and void. “Exercised and consummated” shall mean
that binding contracts have been set for the construction of the principal structures; or in the absence
of contracts that the principal structure is under construction to a substantial degree; or the
prerequisite conditions involving substantial investment are contracted for, in substantial
development, or completed.
Staff Recommendation:
In staff’s opinion, the applicant has provided sufficient documentation to satisfy the required findings
for the Special Use Permit.
Therefore, the Planning Department recommends approval of the Special Use Permit and Site Plan
(signed and seal date of August 18, 2010) for the AT&T CLEGG 199’ Monopole Telecommunications
