Imposing a youth sentence<br />

Before imposing a youth sentence, the court must<br />

consider recommendations from a conference if one is<br />

held, any pre-sentence report that is prepared,<br />

representations made by the parties or their lawyer,<br />

representations made by the parents <strong>of</strong> the YP if any,<br />

and any other relevant information that is before the<br />

court. s.42(1)<br />

(see “Conferences,” p.108 and “Pre-sentence reports,”<br />

p.114)<br />

Possible youth sentences<br />

s.42(2)<br />

Section 42(2) requires a court that finds a YP guilty <strong>of</strong><br />

an <strong>of</strong>fence to impose one <strong>of</strong> the following sanctions, or<br />

any combination that are not inconsistent with each<br />

other [the exception is murder s.42(2)(q)or (r)]<br />

a<br />

a reprimand – similar to a warning by a judge<br />

b an absolute discharge<br />

c<br />

a conditional discharge – this may require<br />

supervision by the provincial director<br />

• the court may NOT combine the sentence <strong>of</strong><br />

conditional discharge with (k) "probation," (l)<br />

"ISSP", or (m) "attendance order" to attend an<br />

approved non-residential program s.42(11)<br />

d a fine to a maximum <strong>of</strong> $1,000<br />

• the court MUST consider present and future<br />

means <strong>of</strong> the YP to pay s.54(1)<br />

• the fine may be discharged through fine options<br />

if a program is established s.54(2)<br />

• the YP may apply to extend the time to pay<br />

s.54(10)<br />

an order to pay compensation for specified losses<br />

or specified damages to another person<br />

• the court MUST consider present and future<br />

means <strong>of</strong> the YP to pay s.54(1)<br />

• the court may consider representations made by<br />

the recipient s.54(4)<br />

• notice <strong>of</strong> the terms <strong>of</strong> the order MUST be given<br />

to the recipient s.54(5)<br />

• the YP may apply to extend the time to pay<br />

s.54(10)<br />

an order for the restitution <strong>of</strong> property to another<br />

person<br />

• the court may consider representations made by<br />

the recipient s.54(4)<br />

• notice <strong>of</strong> the terms <strong>of</strong> the order MUST be given<br />

to the recipient s.54(5)<br />

• the YP may apply to extend the time to pay<br />

s.54(10)<br />
