IRCS POLICY<br />
DEPARTMENT OF JUSTICE<br />
CORRECTIONAL SERVICES<br />
The Executive Director, Correctional Services is<br />
designated as the Provincial Director under the<br />
Youth Criminal Justice Act (<strong>YCJA</strong>), by Order in<br />
Council, for the purpose <strong>of</strong> determining that 1.3.1,<br />
an intensive rehabilitative custody and supervision<br />
program, is available in accordance with section<br />
42(7)(d) <strong>YCJA</strong>.<br />

NON-IRCS POLICY (NIRCS)<br />
DEPARTMENT OF JUSTICE<br />
CORRECTIONAL SERVICES<br />
There is also a policy for Non-IRCS cases and<br />
<strong>of</strong>fences that qualify for special treatment due to<br />
the nature <strong>of</strong> the <strong>of</strong>fence and the particular<br />
circumstances <strong>of</strong> the YP.<br />

Other sentencing provisions<br />
Maximum youth sentences<br />
• 2 years<br />
• 3 years for <strong>of</strong>fences punishable by life<br />
imprisonment for adults<br />
• 10 years for 1 st degree murder<br />
• 7 years for 2 nd degree murder<br />
Any single sentence under s.42(2) is generally limited<br />
to 2 years, with the EXCEPTIONS set out in s.42(14)<br />

is one for which the punishment for adults is life<br />
