Draft <strong>Governor</strong> <strong>Phillip</strong> <strong>Park</strong> <strong>Plan</strong> <strong>of</strong> <strong>Management</strong> 2.0 <strong>Management</strong> Warringah Shire <strong>Council</strong> was appointed trustee <strong>of</strong> R56217 and R61140 on 25 January 1952. Care, control and management <strong>of</strong> R64483 devolved upon Warringah Shire <strong>Council</strong> according to Section 344 <strong>of</strong> the Local Government Act 1919. On 1 November 1991, the <strong>Governor</strong> <strong>Phillip</strong> <strong>Park</strong> (R56217, R61140, R64483) Reserve Trust was established, and Warringah <strong>Council</strong> was appointed manager <strong>of</strong> the Reserve Trust under the provisions <strong>of</strong> Sections 92 and 95 <strong>of</strong> the Crown Lands Act 1989. <strong>Management</strong> <strong>of</strong> the park was transferred to <strong>Pittwater</strong> <strong>Council</strong> following its secession from Warringah in 1992. The Crown reserve lands that comprise <strong>Governor</strong> <strong>Phillip</strong> <strong>Park</strong> are managed by the <strong>Governor</strong> <strong>Phillip</strong> (R56217, R61140, R64483) Reserve Trust, which is a separate corporate entity to <strong>Council</strong>. As <strong>Council</strong> only manages this trust, all income from and expenditure on these reserves must be separate from <strong>Council</strong>’s general revenues. The now-defunct Palm Beach Open Space Shoreline Committee (PBSOSC) managed the park in association with <strong>Pittwater</strong> <strong>Council</strong> at the time the previous <strong>Plan</strong> <strong>of</strong> <strong>Management</strong> was prepared in 1995. The park is now managed by <strong>Pittwater</strong> <strong>Council</strong> according to this <strong>Plan</strong> <strong>of</strong> <strong>Management</strong>, in liaison with the Department <strong>of</strong> Land and Water Conservation, the Palm Beach Association, stakeholders in the park, and representations to <strong>Council</strong> from the public. The Crown Lands Act 1989 requires that the Trust funds are accountable, and <strong>Council</strong> as Trust Manager is required to provide the Minister with triennial reports <strong>of</strong> the trust accounts. Whilst <strong>Governor</strong> <strong>Phillip</strong> <strong>Park</strong> is currently managed by one trust, DLWC have suggested that other Crown reserve trust that manages similar lands be amalgamated i.e. all beaches. This allows for the transfer <strong>of</strong> funds between reserves without the need for the Minister’s consent. <strong>Governor</strong> <strong>Phillip</strong> <strong>Park</strong> is primarily managed by <strong>Pittwater</strong> <strong>Council</strong>’s Reserves, Recreation and Building Services Business Unit, and using the expertise <strong>of</strong> a number <strong>of</strong> other <strong>Pittwater</strong> <strong>Council</strong>’s Business Units, to achieve the following:- Reserves, Recreation and Building Services Environmental Compliance Corporate Development Finance <strong>Plan</strong>ning and Assessment Overall park planning, preparation and ongoing management <strong>of</strong> <strong>Plan</strong>s <strong>of</strong> <strong>Management</strong> for parks, landscape design, horticultural maintenance, dune maintenance, beach and park cleansing, construction and maintenance <strong>of</strong> all buildings and structures, reserves bookings, filming bookings, installation <strong>of</strong> power and water supply, erection and maintenance <strong>of</strong> signs, and lifeguard patrol (summer only). Pay and Display, dog control, visitor behaviour, by-laws and ordinance control. Leases, franchises and land tenure. Financial accounting. Development control, assessment <strong>of</strong> development applications for major works, illegal operators. The previous <strong>Plan</strong> <strong>of</strong> <strong>Management</strong> provided direction for park management that has resulted in various improvements to the park since 1995. This <strong>Plan</strong> <strong>of</strong> <strong>Management</strong> provides further direction for improvements to the park to be funded from <strong>Council</strong>’s capital works program and ongoing grant applications. <strong>Pittwater</strong> <strong>Council</strong> October 2002 15
