Justification of and execution of any real property acquisitions shall be in<br />

The substance of this clause, including this paragraph (c), shall be included in any<br />
sub<strong>contract</strong> occasioned by this <strong>contract</strong> under which property described in<br />
paragraph (a) of this clause shall be acquired.<br />

Individual occupational radiation exposure records generated in the performance of work<br />
under this <strong>contract</strong> shall be subject to inspection by DOE and shall be preserved by the<br />
<strong>contract</strong>or until disposal is authorized by DOE or at the option of the <strong>contract</strong>or delivered<br />
to DOE upon completion or termination of the <strong>contract</strong>. If the <strong>contract</strong>or exercises the<br />
foregoing option, title to such records shall vest in DOE upon delivery.<br />

(a)<br />
(DEVIATION) Definition.<br />
Eligible employee means a current or former employee of a <strong>contract</strong>or or<br />
sub<strong>contract</strong>or (1) who has been employed at a De<strong>part</strong>ment of Energy Defense<br />
Nuclear Facility as defined in Section 3161 of the National Defense Authorization<br />
Act for FY 1993 (Pub. L. 102-484) and the Interim Planning Guidance for<br />
Contractor Work Force Restructuring (Feb 1996) or other applicable De<strong>part</strong>ment of<br />
Energy guidance for <strong>contract</strong>or work force restructuring, as may be amended or<br />
supplemented from time to time (hereinafter “Guidance”), (2) whose employment at<br />
such a Defense Nuclear Facility has been involuntarily terminated (other than for<br />
cause) or who has been notified that they are facing termination, (3) who has also<br />
met the job attachment test as set forth in applicable De<strong>part</strong>mental Guidance, and<br />
(4) who is qualified for a <strong>part</strong>icular position with the Contractor or, with retraining,<br />
can become qualified within the time and cost limits set forth in the De<strong>part</strong>mental<br />
Guidance.<br />
(b)<br />
Consistent with De<strong>part</strong>ment of Energy guidance for <strong>contract</strong>or work force<br />
restructuring, as may be amended or supplemented from time to time, the <strong>contract</strong>or<br />
agrees that it will provide a preference in hiring to an eligible employee to the<br />
extent practicable for work performed under this <strong>contract</strong>.<br />
