or the public, the <strong>contract</strong>ing officer may issue an order stopping work in whole or<br />

in <strong>part</strong>. Any stop work order issued by a <strong>contract</strong>ing officer under this clause (or<br />

issued by the <strong>contract</strong>or to a sub<strong>contract</strong>or in accordance with paragraph (i) of this<br />

clause) shall be without prejudice to any other legal or <strong>contract</strong>ual rights of the<br />

Government. In the event that the <strong>contract</strong>ing officer issues a stop work order, an<br />

order authorizing the resumption of the work may be issued at the discretion of the<br />

<strong>contract</strong>ing officer. The <strong>contract</strong>or shall not be entitled to an extension of time or<br />

additional fee or damages by reason of, or in connection with, any work stoppage<br />

ordered in accordance with this clause.<br />

Regardless of the performer of the work, the <strong>contract</strong>or is responsible for<br />

compliance with the ES&H requirements applicable to this <strong>contract</strong>. The <strong>contract</strong>or<br />

is responsible for flowing down the ES&H requirements applicable to this <strong>contract</strong><br />

to sub<strong>contract</strong>s at any tier to the extent necessary to ensure the <strong>contract</strong>or's<br />

compliance with the requirements.<br />

The <strong>contract</strong>or shall include a clause substantially the same as this clause in<br />

sub<strong>contract</strong>s involving complex or hazardous work on site at a DOE-owned orleased<br />

facility. Such sub<strong>contract</strong>s shall provide for the right to stop work under the<br />

conditions described in paragraph (g) of this clause. Depending on the complexity<br />

and hazards associated with the work, the <strong>contract</strong>or may choose not to require the<br />

sub<strong>contract</strong>or to submit a Safety Management System for the <strong>contract</strong>or's review<br />

and approval.<br />

In the performance of this <strong>contract</strong>, the Contractor shall comply with the<br />

requirements of Executive Order 13423 and the U.S. De<strong>part</strong>ment of Energy (DOE)<br />

Affirmative Procurement Program Guidance. This guidance includes requirements<br />

concerning environmentally preferable products and services, recycled content<br />

products and biobased products. This guidance is available on the Internet.<br />

In complying with the requirements of paragraph (a) of this clause, the Contractor<br />

shall coordinate its activities with the DOE Recycling Coordinator. Reports<br />

required by paragraph (c) of this clause shall be submitted through the DOE<br />

Recycling Coordinator.<br />

The Contractor shall prepare and submit reports, at the end of the Federal fiscal<br />

year, on matters related to the acquisition of items designated in EPA's<br />

Comprehensive Procurement Guidelines that Federal agencies and their Contractors<br />

are to procure with recovered/recycled content.<br />
