1 Introduction 

1.1 The A46 is an important regional trunk road connecting the East and West 

Midlands. The A46 Newark to Widmerpool Improvement Scheme (“the Scheme”) is 

the provision of a new 28km long two-lane dual carriageway from the A606 two 

level junction at Widmerpool to an improved roundabout at Farndon, just south of 

Newark. These improvements will reduce congestion, improve safety, and provide a 

bypass for East Stoke and Farndon. 

1.2 A Public Inquiry into the draft Orders for the Scheme (published January 2007) was 

held in the summer of 2007. 

1.3 The Secretaries of State for Transport and Communities and Local Government 

(“the Secretaries of State”) announced their decision on 19 December 2008 

(SD011) to make the Orders needed for the Scheme following acceptance of the 

Inquiry Inspector’s recommendations (SD010). 

1.4 The Orders for the Scheme were made on 31 January 2009. Advanced construction 

works commenced in February 2009. This consisted of vegetation clearance prior 

to the bird nesting season, fencing work, archaeology surveys and other 

environmental mitigation. And main construction activities commenced on 14 July 

2009. 

1.5 As a result of the Secretaries of States’ decision and the Inspector’s 

recommendations the Highways Agency (“the Agency”) considered a number of 

outstanding design issues with respect to the Scheme, and it also identified some 

minor amendments to the Orders which required to be made. These changes 

resulted in the need for the publication of draft Supplementary Orders on 24 April 

2009 (“the 2009 draft Supplementary Orders”). 

1.6 A number of objections and representations in respect of the 2009 draft 

Supplementary Orders were received. These were considered at a Public Inquiry 

held between January and April 2010. 

1.7 The Secretaries of State for Transport and for Communities and Local Government 

announced their decision to make the Supplementary Orders on 27 July 2010 and 

the Orders were made on 15 October 2010 (“the 2010 Supplementary Orders”). 

1.8 In consequence of a number of small inconsistencies identified in the 2009 made 

Orders together with unresolved issues relating to proposals for a revised access 

for landowners at Farndon, Nottinghamshire, further minor amendments have been 

identified. 

1.9 These amendments reflect the outcome of a meeting before an Independent 

Mediator, attended by Geoff Bethel, Highways Agency, Tony Nwanodi, Treasury 

Solicitor, Lisa Busch, Highways Agency Counsel, Ian Wildgoose, URS Scott Wilson 

and Mr A Morris (PA Freight Ltd) and their lawyers on the 7 th February 2011.

1.10 No solution put forward was acceptable to both parties. But the mediation enabled 

the Agency to better understand PA Freight’s requirements. The proposals have 

been necessitated because of the District Council’s failure to comply with the 

statutory procedures and consult the Agency in respect of PA Freight’s 

retrospective application for planning approval for their lorry park. 

1.11 This feature did not exist when the initial draft Orders were published in 2007. 

Consequently, the Agency’s initial design did not take the lorry park into account. 

Planning approval was granted in July 2007, during the time the Public Inquiry was 

sitting, yet no reference to this was made to either the Highways Agency or the 

Inspector by any of the parties. 

1.12 The amendments in question are contained in further draft Supplementary Orders 

published on 12 May 2011 under the Highways Act 1980, the Acquisition of Land 

Act 1981 and the Planning and Compulsory Purchase Act 2004 (“the 2011 draft 

Supplementary Orders”). 

The draft Supplementary Orders and additional Detrunking Order are:

1.13 This Statement of Case is required by Rule 6(1) (a) of the Highways (Inquiries 

Procedure) Rules 1994 and the Compulsory Purchase by Ministers (Inquiries 

Procedures) Rules 2007. It sets out the case that the Agency, on behalf of the 

Secretaries of State will put forward at the Public Inquiry in support of the 2011 draft 

Supplementary Orders and additional Detrunking Order being made. It sets out the 

Agency’s principal submissions covering: 

I. The background to the Scheme; 

II. The need for the 2011 draft Supplementary Orders and additional Detrunking 

Order; 

III. The support, objections and representations received in response to the 

publication of the Supplementary Orders and an outline of the evidence which 

the Agency will present to the Inquiry in response; 

IV. Deposit Documents; 

V. Notice of Certificate of determination in respect of the environmental impact of 

the draft Orders

2 Background to the Scheme 

2.1 The A46 between Newark and Widmerpool is the only section of this important 

regional trunk road connecting the East and West Midlands which has not been 

improved. The high level of traffic using this route causes frequent congestion and 

delay. The road also has a poor safety record. The existing A46 is generally 

straight, following the line of the old Roman road, the Fosse Way. Overtaking is 

difficult, however, because of the undulating alignment and the many junctions and 

accesses to fields, farms and houses. Bridleways and footpaths also join and cross 

this section of the A46. Walkers, cyclists and horse riders find it difficult to cross 

because of the heavy traffic. 

2.2 The Scheme aims to address these problems through the provision of a new 28km 

long two-lane dual carriageway from the A606 two level junction at Widmerpool to 

an improved roundabout at Farndon, just south of Newark. These improvements will 

reduce congestion, improve safety, and provide a bypass for East Stoke and 

Farndon. 

2.3 Draft Orders for the Scheme, together with an Environmental Statement, were 

published on 26 January 2007. Draft Orders exhibitions were held in Cotgrave and 

Newark in early February 2007. 

2.4 An addendum to the January 2007 Environmental Statement was published in 

March 2007 to incorporate changes in anticipated traffic flows as a result of an 

update to the Department for Transport future traffic prediction methodology. 

2.5 A Public Inquiry for the Scheme was held in the summer of 2007 at which 

objections to the Agency’s evidence and independently promoted alternatives were 

heard in front of an independent Inspector. The Public Inquiry sat for 18 days and 

there were four accompanied site visits. 

2.6 As a result of the Department of Transport’s £1 billion fiscal stimulus package 

announced in November 2008, delivery of the A46 Scheme was accelerated. 

2.7 The Inspector’s Report (SD010) and Secretaries of States’ decision letter (SD011) 

were published in December 2008. It was recommended that the orders be adopted 

with the exception of a number of points of design. 

2.8 The need for the Scheme, Government policy and local planning issues were 

matters that were considered at the 2007 Public Inquiry. The purpose of this 

Statement of Case is to consider the 2011 draft Supplementary Orders and 

additional Detrunking Order only. It is not intended to revisit matters raised at the 

2007 Public Inquiry in respect of which the Secretaries of State have made their 

decision.

3 The Need for the 2011 draft Supplementary and additional Detrunking Orders 

3.1 Representations made in spring 2009 by PA Freight Services Ltd (“PA Freight”), the 

owners of a haulage company at Farndon, Nottinghamshire, stated that the original 

design for changes to their access would not be adequate. The changes were 

required because of the creation of a new, enlarged roundabout at the junction of 

the A46 trunk Road and Farndon Road, authorised under The A46 Trunk Road 

(Newark to Widmerpool Improvement and Slip Roads) (Side Roads) Order 2009. 

3.2 PA Freight had made representations at the 2007 Public Inquiry in respect of the 

original draft Orders, but raised no specific concerns about the effect of those 

Orders on their business. The concerns related instead to unspecified access 

issues and the potential impact on their land of possible proposals for a Newark 

Southern Relief Road, which does not in fact form part of the Secretary of State for 

Transport’s programme of highway improvements. Subsequently, a proposal for a 

connection to a Newark Southern Relief Road has been promoted by a private 

developer, Catesby Estates (Residential) Ltd, which obtained planning consent in 

April 2011 from the local planning authority, Newark and Sherwood District Council, 

for a new roundabout, approximately 1km south of Farndon roundabout on the 

duelled A46 to link with a relief road. 

3.3 No objections or representations were made in respect of the 2007 Orders by 

Charles Lawrence or Maurice Walmsley, whose accesses were affected by the 

2007 Orders, and both of whom have objected to the 2011 draft Supplementary 

Orders. An objection by Marjorie Clarkson, whose access was also affected by 

those Orders, was also considered at the 2007 Public Inquiry. 

3.4 Discussions held between PA Freight, URS Scott Wilson and the Agency relating to 

the company’s concerns about the design for their revised access were held on the 

following dates: 

January and September 2005, in connection with the planning application for an 

International Logistics Centre 

1 April and 7 May 2009, to discuss concerns about the Agency access design 

28 January, 5 March and 3 August 2010, to discuss design changes with PA Freight 

and their designers 

10 and 23 August 2010, to discuss PA Freight’s revised options for their access 

design 

2 September 2010, visit to PA Freight’s site to observe, discuss and understand 

method of operations

14 January 2011, meeting with Patrick Mercer, MP, to discuss the Agency’s 

approach to the access design 

7 February 2011, mediation, to try and resolve outstanding issues 

These discussions failed to reach to agreement on any modification to the design of 

the access.

4 Description of the 2011 draft Supplementary and further Detrunking Orders 

4.1 The 2011 draft Supplementary Orders and the further Detrunking Order were 

prepared and published on 12 May 2011 under the Highways Act 1980, the 

Acquisition of Land Act 1981 and the Planning and Compulsory Purchase Act 2004. 

4.2 The A46 Trunk Road (Newark to Widmerpool Improvement and Slip Roads) 

Supplementary (Side Roads) Order Number 1 20__ 

I. This Order is made under sections 12, 14, 125 and 326 of the 1980 Act. It 

enables the Secretary of State to stop up and provide new private means of 

access to premises affected by this Scheme and to vary The A46 Trunk Road 

(Newark to Widmerpool Improvement and Slip Roads) (Side Roads) Order 

2009.rule 10 of that Act. This corrects a minor error in the 2009 Order. 

II. The Order makes changes to the 2009 Order by stopping up two lengths of 

private means of access which formally connected Farndon Road to Sproakes 

Lane. It also modifies that Order by removing the stopping up of the existing 

private means of access from Farndon Road to Mr Walmsley, PA Freight and Mr 

Lawrence, and retains that private means of access for pedestrian and cycle 

traffic only. 

III. The Order also varies the 2009 Order by removing a stopping up of an egress to 

a petrol filling station in the vicinity of Saxondale Roundabout, as shown in 

Schedule 10 of that Order. This would correct a minor error. 


Supplementary Compulsory Purchase Order Number 1 20__ 

I. This Order is made under Sections 239, 240, and 246 of the 1980 Act, and 

under section 2 of the Acquisition of Land Act 1981. The Order authorises 

compulsory acquisition of land and rights for the following purposes: 

II. The construction and improvement of the new trunk road in the Parish of 

Farndon, in the District of Newark and Sherwood; 

III. The construction and improvement of highways and provision of new means of 

access in pursuance of the Side Roads Order; 

IV. The diversion of watercourses and the execution of other works on 

watercourses in connection with the construction of the new trunk road and the 

improvement works. 

V. The Order enables the Secretary of State for Transport compulsorily to acquire 

land interests of PA Freight, Mr Walmsley and Mr Lawrence in order to enlarge 

PA Freight’s lorry park; provide a replacement access to the lorry park; and 

provide Mr Lawrence with an improved, separate access. The Order will also 

enable the Secretary of State to improve drainage for Mr Walmsley, Mr 

Lawrence and PA Freight. It is the Agency’s intention to agree licences over 

the land to construct the necessary works. If this is not possible title will be 

taken.

Margidunum Roundabout (Detrunking) Order 20__ 

I. This Order is made under Sections 10 and 12 of the Highways Act 1980 and 

will detrunk a short length of the existing A46 Trunk Road at Margidunum 

Roundabout. It will correct a minor omission in The A46 Trunk Road (Newark 

to Widmerpool Improvement and Slip Roads) (Detrunking) Order 2009. 

II. 

No objections or representations have been made with respect to the 

Detrunking Order.

5 Traffic Forecasting 

5.1 The traffic model prepared for the 2007 Public Inquiry was revised to include the 

Kinoulton amendments and the extra connection to the A606 Widmerpool junction 

that was a part of the 2010 Supplementary Orders. All of the other components of 

the traffic model have remained the same. The subsequent modifications at the 

Farndon roundabout were too small to be represented in the traffic model. 

5.2 The Kinoulton amendments changed the journey times for local trips at the southern 

end of the Scheme. However, these changes were very small in comparison to the 

overall travel time benefits delivered by the whole Scheme. The updated travel time 

savings for the Scheme were presented at the 2010 Public Inquiry. The travel time 

savings will not change substantially as a result of the 2011 draft Supplementary 

Orders.

6 Environmental Assessment of Supplementary Orders Proposals 

6.1 The 2011 draft Supplementary Orders as detailed in Paragraphs 4.2 and 4.3 correct 

a number of omissions from the previous Orders and provide for revised Private 

Means of Access arrangements at Farndon. 

6.2 In as much as these draft Supplementary Orders simply correct minor errors and 

omissions no change in scheme design is associated with them. 

6.3 Therefore no further consideration has been given to these draft Supplementary 

Orders as the assessment made in the original Environmental Statement, published 

in January 2007 and subsequent Addenda No. 2, published in October 2009 

remains valid.

7 Supporters, Objections and Representations 

7.1 Summary The objection period to the draft Supplementary Orders published in May 

2011 ended on 24 June 2011. In all, nine affected landowners, local authorities, 

statutory bodies and other interested parties responded to the publication of the 

draft Supplementary Orders by the end of the objection period. Two letters of 

objection, received after the closure of the statutory consultation period, dealt with 

matters which are not relevant to the draft Orders. A letter of support was received 

from Nottinghamshire County Council, in which the Council sought assurances 

about the capacity of Farndon Roundabout. As noted above, no objections have 

been received in connection with the draft Detrunking Order. Three statutory 

objections were received from PA Freight Services Ltd (“PA Freight”), of 

International Logistics Centre, Fosse Way, Farndon, Newark, Nottinghamshire 

NG24 4SP, Maurice Walmsley of Kardeel House, 7 Bulpit Lane, Balderton, Newark 

NG24 3PT and Charles Lawrence, of Cranleigh Park 153a Farndon Road Newark, 

Nottinghamshire NG24 4SP. Each of these objections will be addressed in the 

Agency’s evidence before the Inquiry, in accordance with its case as summarised in 

the paragraphs that follow. 

7.2 PA Freight Services Ltd. 

I. PA Freight has objected on the ground that the design of the access to their 

premises proposed in the Orders is inadequate. Specifically, they consider that 

the proposed access, in that it would not provide adequate access, as 

compared with that which the company currently enjoys; would not provide 

sufficient working space for their operations; and would jeopardise the 

company’s operations at the site. According to PA Freight, the arrangements 

for the shared access with other users (namely, Mr M Walmsley’s and other 

users visiting PA Freight’s site) would be unsafe within the area of the lorry 

park. 

II. The design would not resolve existing drainage problems, and the gradients 

within the lorry park would cause operational difficulties for the large vehicles 

operated by the company. The company also object that the design would not 

provide adequate access to their retained land. This is situated to the East of 

the existing A46 Trunk Road and west of the River Devon 

III. 

PA Freight acquired their site in late 1996/early 1997 at which time the depot 

had taken on the broad character as exists today. This was as a result of a 

number of planning consents between 1985 and 1997 that increased both the 

storage capacity and office accommodation on site. The adjoining land, owned 

by Mr Walmsley has been used for vehicle parking and or storage by PA 

Freight since 1996/1997. There are no planning consents for such use, or for 

any development of the land. The lorry park was constructed during 2007, 

again without the necessary planning consent. Retrospective planning consent 

was obtained August 2007.

IV. The Agency has consulted with PA Freight with a view to obtaining an 

understanding of their operational requirements, and is of the opinion, as it will 

explain in evidence, that it has successfully addressed their concerns with 

respect to the proposed scheme. The Agency’s evidence will show that the 

scheme will provide a reasonable replacement access and will not disrupt PA 

Freight’s operations. The internal layout of PA freight’s secure yard will not be 

affected. The Agency has maintained the same number of lorry parking 

spaces, but with more generous proportions. This would allow occasional use 

by long vehicles. 

V. The design of the proposed new access is no less safe than the existing 

arrangements, and in fact offers flexibility, with fewer points of conflict. The 

Agency has consulted the Environment Agency about drainage for the whole 

scheme. In order to remove any potential for future drainage problems in the 

locality the Agency is taking access over the land to cleanse existing drainage 

ditches and outfalls. The gradients proposed for PA Freight’s access and lorry 

parking area are either better, or no worse, than those which currently exist. 

VI. As regards the retained land, the Agency’s evidence will show that adequate 

provision has been made. Any outstanding issues can and will be dealt with 

as accommodation works, by providing suitable access, gated if required. It is 

the Agency’s intention to take title over the land included in the Order if 

licences cannot be agreed. 

7.3 Maurice Walmsley 

I. Mr Walmsley objected to the design on safety grounds, on the basis that the 

shared use of the proposed access, which traverses land in his ownership, 

with PA Freight and Mr Lawrence will result in vehicle conflicts and reduced 

safety. A section of Mr Walmsley’s land is leased to PA Freight and is being 

used for vehicle movements and storage of materials. Mr Walmsley’s concerns 

centre on potential conflicts between PA Freight’s vehicle movements and the 

proposed revised access arrangements to his and, which would cross PA 

Freight’s lorry park. Mr Walmsley has also raised concerns about gradients 

within the revised access. In addition, Mr Walmsley has indicated that he may 

need to use the land he currently leases to PA Freight for the storage of new 

and used vehicles which are at present delivered to his town centre premises. 

Investigations with the local planning authority have shown that there are no 

planning consents which enable Mr Walmsley to use his land for vehicle or 

storage. Nor is there any consent for development of this land. 

II. The Agency’s evidence before the Inquiry will show that the design of the 

proposed new access is no less safe than the current arrangements, and that 

safety will not be reduced should Mr Walmsley need to use his land to unload 

vehicles. The Agency’s design would have fewer conflicts than the existing 

access arrangements to PA Freight’s and Mr Walmsley’s land. As stated 

above, it is the Agency’s intention only to take title over the land if licences 

cannot be agreed.

7.4 Charles Lawrence 

I. Mr Lawrence’s property is in residential use by him and adjoins PA Freight’s 

land. He currently shares the access in common with both Mr Walmsley and 

PA Freight. The Agency’s proposed access will provide him with a separate 

access and remove all conflicts with the other landowners. However, Mr 

Lawrence has objected on the grounds that the Compulsory Purchase Order 

enables the Secretary of State to compulsorily acquire his land. 

II. The Agency intends to acquire Mr Lawrence’s land temporarily by agreeing a 

licence to cleanse drainage runs and outfalls on his land. 

III. The Compulsory Purchase Order would, if made, provide powers to take title 

to the land, to enable the Agency to undertake necessary works. Title would 

only be taken if the licence cannot be agreed with both Mr Lawrence and PA 

Freight. 

7.5 Six representations were received: 

I. Patrick Mercer, MP raised concerns about the safety and workability of the 

Agency’s proposals due to conflicting movements between heavy goods 

vehicles, cyclists and pedestrians. 

II. Newark and Sherwood District Council raised concerns about the visual 

impact of the proposals and the impact on the local economy should PA 

Freight be forced to close down or relocate. The Agency will show that its 

proposals will not have an adverse effect on PA Freight’s ability to continue to 

operate, and to do so safely, from their current site. 

III. Natural England has responded indicating that they have no objections to the 

proposals. 

IV. Mrs Marjorie Clarkson, of Farndon Fields Farm, wrote expressing concerns 

about the quality and nature of the work affecting her access, which is 

currently being undertaken and will be addressed by the contractors. This is 

not a valid representation to the draft Orders 

V. Mrs Donna Paver, of 153 Farndon Road, Farndon, raised concerns about 

access to her property. Mrs Paver also raised concerns about the physical 

impact of the proposals as regards visual impact and an increased number of 

parking bays within PA Freight’s lorry park. The Agency is satisfied that her 

access will not be adversely affected by the proposals and her concerns can 

be addressed by detailed design. As regards the changes within the lorry 

park, there is no increase in the number of parking bays and lengthening them 

would have little or no impact. The lorry park does not move closer to Mrs 

Paver’s property.

VI. 

Michael and Ann Rowen, David Rowen and Elizabeth Rowen, of Cropwell 

Court , Cropwell Butler, Leicestershire wrote saying that the scope of the 

Public Inquiry into the draft Orders should be widened to address their 

concerns and appraise the merits of the proposed installation of MS3 signs 

adjacent to their property. The installation of MS3 signs on the A46 Trunk 

Road is not a matter for consideration under the draft Orders and therefore is 

not a valid representation. The Secretary of State has a duty to provide signing 

to give directions and ensure safety of the travelling public.

8 Continuing Dialogue 

8.1 The Highways Agency has been corresponding and meeting with affected parties, 

and will continue to so in order to try to resolve any outstanding issues. 

8.2 If it does not prove possible to resolve all the concerns identified above before the 

Public Inquiry, then, in due course, as part of the Inquiry process, appropriate 

evidence in response will be served.

9.1 Geoff Bethel, the Agency’s Senior Project Manager will give evidence on the reason 

for the draft Orders 

9.2 Ian Wildgoose of URS Scott Wilson will give evidence on the Agency’s design for 

the revised access for PA Freight Services limited, Maurice Walmsley and Charles 

Lawrence. 

9.3 David Elliott of URS Scott Wilson will give evidence about the impact of the 

proposed changes on traffic using the roads in the locality. 

9.4 Alastair MacDonald of Wilson James will give evidence relating to the logistics 

associated with the Agency’s design. 

9.5 Sarah Edgar of URS Scott Wilson will give evidence on the environmental Impact of 

the Agency’s proposals.

11 Conclusion 

11.1 The Secretary of State for Transport and the Secretary of State for Communities 

and Local Government announced the decision, published on 19 December 2008, 

to make the orders needed for the Scheme following acceptance of the Inquiry 

Inspector’s recommendations. The Inspector proposed that a number of 

modifications and designs be considered. This resulted in the need for the 

Supplementary Orders and these were published on 24 April 2009 with a six week 

comment period. The Secretary of State for Transport and the Secretary of State 

for Communities and Local Government announced their decision, published on 15 

July 2010, to make those Supplementary Orders following acceptance of the Inquiry 

Inspector’s recommendations.

11.3 The Inspectors, in preparing their Report and conclusions, had regard to all 

representations and evidence and all Inquiry documents to reach fair and balanced 

judgements in their Reports to the Secretaries of State. They made formal 

accompanied site inspections on various separate occasions and several 

unaccompanied inspections. 

11.4 The Secretaries of State, in turn, in reaching their decisions on the published 

Orders and Supplementary Orders, considered both Inspectors’ reports in full, 

together with their conclusions and recommendations. They also had available to 

them all Inquiry documents listed in the Inspectors’ Reports to enable them to make 

fair and balanced decisions. 

11.5 The Agency’s further Supplementary and additional Detrunking Orders are 

necessary to implement minor modifications to the Scheme. There has been no 

new evidence to change the Agency’s position and it remains of the view that these 

draft Supplementary Orders and Detrunking Order should therefore be made.

Bridleway: 

A public right of way for horse riders, cyclists and 

pedestrians. 

Design Year: 

15 years after the expected date of opening a 

scheme to traffic. 

Footpath: 

A public right of way for pedestrians. 

Highways Agency: 

An executive agency of the Department for Transport. 

Overbridge: 

A bridge passing over the proposed dual carriageway 

or another route. 

Site of Importance for Nature A non-statutory designated site of nature 

Conservation: 

conservation interest of regional or local importance. 

Trunk Road: 

A main road open to all traffic that is part of the 

national network managed and maintained by the 

Highways Agency. 

Two-Level Junction: 

A junction whereby traffic leaving or joining the main 

road passes over or under it on the side road (also 

known as a grade separated junction). 

Underbridge: A bridge passing under the proposed dual 

carriageway or another route. 

Underpass: 

A route beneath the proposed dual carriageway or 

another route for horse riders, cyclists and/or
