1 Introduction<br />
1.1 The A46 is an important regional trunk road connecting the East and West<br />
Midlands. The A46 Newark to Widmerpool Improvement Scheme (“the Scheme”) is<br />
the provision <strong>of</strong> a new 28km long two-lane dual carriageway from the A606 two<br />
level junction at Widmerpool to an improved roundabout at Farndon, just south <strong>of</strong><br />
Newark. These improvements will reduce congestion, improve safety, and provide a<br />
bypass for East Stoke and Farndon.<br />
1.2 A Public Inquiry into the draft Orders for the Scheme (published January 2007) was<br />
held in the summer <strong>of</strong> 2007.<br />
1.3 The Secretaries <strong>of</strong> State for Transport and Communities and Local Government<br />
(“the Secretaries <strong>of</strong> State”) announced their decision on 19 December 2008<br />
(SD011) to make the Orders needed for the Scheme following acceptance <strong>of</strong> the<br />
Inquiry Inspector’s recommendations (SD010).<br />
1.4 The Orders for the Scheme were made on 31 January 2009. Advanced construction<br />
works commenced in February 2009. This consisted <strong>of</strong> vegetation clearance prior<br />
to the bird nesting season, fencing work, archaeology surveys and other<br />
environmental mitigation. And main construction activities commenced on 14 July<br />
2009.<br />
1.5 As a result <strong>of</strong> the Secretaries <strong>of</strong> States’ decision and the Inspector’s<br />
recommendations the Highways Agency (“the Agency”) considered a number <strong>of</strong><br />
outstanding design issues with respect to the Scheme, and it also identified some<br />
minor amendments to the Orders which required to be made. These changes<br />
resulted in the need for the publication <strong>of</strong> draft Supplementary Orders on 24 April<br />
2009 (“the 2009 draft Supplementary Orders”).<br />
1.6 A number <strong>of</strong> objections and representations in respect <strong>of</strong> the 2009 draft<br />
Supplementary Orders were received. These were considered at a Public Inquiry<br />
held between January and April 2010.<br />
1.7 The Secretaries <strong>of</strong> State for Transport and for Communities and Local Government<br />
announced their decision to make the Supplementary Orders on 27 July 2010 and<br />
the Orders were made on 15 October 2010 (“the 2010 Supplementary Orders”).<br />
1.8 In consequence <strong>of</strong> a number <strong>of</strong> small inconsistencies identified in the 2009 made<br />
Orders together with unresolved issues relating to proposals for a revised access<br />
for landowners at Farndon, Nottinghamshire, further minor amendments have been<br />
identified.<br />
1.9 These amendments reflect the outcome <strong>of</strong> a meeting before an Independent<br />
Mediator, attended by Ge<strong>of</strong>f Bethel, Highways Agency, Tony Nwanodi, Treasury<br />
Solicitor, Lisa Busch, Highways Agency Counsel, Ian Wildgoose, URS Scott Wilson<br />
and Mr A Morris (PA Freight Ltd) and their lawyers on the 7 th February <strong>2011</strong>.<br />

1.10 No solution put forward was acceptable to both parties. But the mediation enabled<br />
the Agency to better understand PA Freight’s requirements. The proposals have<br />
been necessitated because <strong>of</strong> the District Council’s failure to comply with the<br />
statutory procedures and consult the Agency in respect <strong>of</strong> PA Freight’s<br />
retrospective application for planning approval for their lorry park.<br />
1.11 This feature did not exist when the initial draft Orders were published in 2007.<br />
Consequently, the Agency’s initial design did not take the lorry park into account.<br />
Planning approval was granted in July 2007, during the time the Public Inquiry was<br />
sitting, yet no reference to this was made to either the Highways Agency or the<br />
Inspector by any <strong>of</strong> the parties.<br />
1.12 The amendments in question are contained in further draft Supplementary Orders<br />
published on 12 May <strong>2011</strong> under the Highways Act 1980, the Acquisition <strong>of</strong> Land<br />
Act 1981 and the Planning and Compulsory Purchase Act 2004 (“the <strong>2011</strong> draft<br />
Supplementary Orders”).<br />
The draft Supplementary Orders and additional Detrunking Order are:<br />

Supplementary (Side Roads) Order Number 1 20__<br />

1.13 This <strong>Statement</strong> <strong>of</strong> <strong>Case</strong> is required by Rule 6(1) (a) <strong>of</strong> the Highways (Inquiries<br />
Procedure) Rules 1994 and the Compulsory Purchase by Ministers (Inquiries<br />
Procedures) Rules 2007. It sets out the case that the Agency, on behalf <strong>of</strong> the<br />
Secretaries <strong>of</strong> State will put forward at the Public Inquiry in support <strong>of</strong> the <strong>2011</strong> draft<br />
Supplementary Orders and additional Detrunking Order being made. It sets out the<br />
Agency’s principal submissions covering:<br />

Order;<br />
III. The support, objections and representations received in response to the<br />

2 Background to the Scheme<br />
2.1 The A46 between Newark and Widmerpool is the only section <strong>of</strong> this important<br />
regional trunk road connecting the East and West Midlands which has not been<br />
improved. The high level <strong>of</strong> traffic using this route causes frequent congestion and<br />
delay. The road also has a poor safety record. The existing A46 is generally<br />
straight, following the line <strong>of</strong> the old Roman road, the Fosse Way. Overtaking is<br />
difficult, however, because <strong>of</strong> the undulating alignment and the many junctions and<br />
accesses to fields, farms and houses. Bridleways and footpaths also join and cross<br />
this section <strong>of</strong> the A46. Walkers, cyclists and horse riders find it difficult to cross<br />
because <strong>of</strong> the heavy traffic.<br />
2.2 The Scheme aims to address these problems through the provision <strong>of</strong> a new 28km<br />
long two-lane dual carriageway from the A606 two level junction at Widmerpool to<br />
an improved roundabout at Farndon, just south <strong>of</strong> Newark. These improvements will<br />
reduce congestion, improve safety, and provide a bypass for East Stoke and<br />
Farndon.<br />
2.3 Draft Orders for the Scheme, together with an Environmental <strong>Statement</strong>, were<br />
published on 26 January 2007. Draft Orders exhibitions were held in Cotgrave and<br />
Newark in early February 2007.<br />
2.4 An addendum to the January 2007 Environmental <strong>Statement</strong> was published in<br />
March 2007 to incorporate changes in anticipated traffic flows as a result <strong>of</strong> an<br />
update to the Department for Transport future traffic prediction methodology.<br />
2.5 A Public Inquiry for the Scheme was held in the summer <strong>of</strong> 2007 at which<br />
objections to the Agency’s evidence and independently promoted alternatives were<br />
heard in front <strong>of</strong> an independent Inspector. The Public Inquiry sat for 18 days and<br />
there were four accompanied site visits.<br />
2.6 As a result <strong>of</strong> the Department <strong>of</strong> Transport’s £1 billion fiscal stimulus package<br />
announced in November 2008, delivery <strong>of</strong> the A46 Scheme was accelerated.<br />
2.7 The Inspector’s Report (SD010) and Secretaries <strong>of</strong> States’ decision letter (SD011)<br />
were published in December 2008. It was recommended that the orders be adopted<br />
with the exception <strong>of</strong> a number <strong>of</strong> points <strong>of</strong> design.<br />
2.8 The need for the Scheme, Government policy and local planning issues were<br />
matters that were considered at the 2007 Public Inquiry. The purpose <strong>of</strong> this<br />
<strong>Statement</strong> <strong>of</strong> <strong>Case</strong> is to consider the <strong>2011</strong> draft Supplementary Orders and<br />
additional Detrunking Order only. It is not intended to revisit matters raised at the<br />
2007 Public Inquiry in respect <strong>of</strong> which the Secretaries <strong>of</strong> State have made their<br />
decision.<br />

3 The Need for the <strong>2011</strong> draft Supplementary and additional Detrunking Orders<br />
3.1 Representations made in spring 2009 by PA Freight Services Ltd (“PA Freight”), the<br />
owners <strong>of</strong> a haulage company at Farndon, Nottinghamshire, stated that the original<br />
design for changes to their access would not be adequate. The changes were<br />
required because <strong>of</strong> the creation <strong>of</strong> a new, enlarged roundabout at the junction <strong>of</strong><br />
the A46 trunk Road and Farndon Road, authorised under The A46 Trunk Road<br />
(Newark to Widmerpool Improvement and Slip Roads) (Side Roads) Order 2009.<br />
3.2 PA Freight had made representations at the 2007 Public Inquiry in respect <strong>of</strong> the<br />
original draft Orders, but raised no specific concerns about the effect <strong>of</strong> those<br />
Orders on their business. The concerns related instead to unspecified access<br />
issues and the potential impact on their land <strong>of</strong> possible proposals for a Newark<br />
Southern Relief Road, which does not in fact form part <strong>of</strong> the Secretary <strong>of</strong> State for<br />
Transport’s programme <strong>of</strong> highway improvements. Subsequently, a proposal for a<br />
connection to a Newark Southern Relief Road has been promoted by a private<br />
developer, Catesby Estates (Residential) Ltd, which obtained planning consent in<br />
April <strong>2011</strong> from the local planning authority, Newark and Sherwood District Council,<br />
for a new roundabout, approximately 1km south <strong>of</strong> Farndon roundabout on the<br />
duelled A46 to link with a relief road.<br />
3.3 No objections or representations were made in respect <strong>of</strong> the 2007 Orders by<br />
Charles Lawrence or Maurice Walmsley, whose accesses were affected by the<br />
2007 Orders, and both <strong>of</strong> whom have objected to the <strong>2011</strong> draft Supplementary<br />
Orders. An objection by Marjorie Clarkson, whose access was also affected by<br />
those Orders, was also considered at the 2007 Public Inquiry.<br />
3.4 Discussions held between PA Freight, URS Scott Wilson and the Agency relating to<br />
the company’s concerns about the design for their revised access were held on the<br />
following dates:<br />
January and September 2005, in connection with the planning application for an<br />
International Logistics Centre<br />
1 April and 7 May 2009, to discuss concerns about the Agency access design<br />
28 January, 5 March and 3 <strong>August</strong> 2010, to discuss design changes with PA Freight<br />
and their designers<br />
10 and 23 <strong>August</strong> 2010, to discuss PA Freight’s revised options for their access<br />
design<br />
2 September 2010, visit to PA Freight’s site to observe, discuss and understand<br />
method <strong>of</strong> operations<br />

4 Description <strong>of</strong> the <strong>2011</strong> draft Supplementary and further Detrunking Orders<br />
4.1 The <strong>2011</strong> draft Supplementary Orders and the further Detrunking Order were<br />
prepared and published on 12 May <strong>2011</strong> under the Highways Act 1980, the<br />
Acquisition <strong>of</strong> Land Act 1981 and the Planning and Compulsory Purchase Act 2004.<br />
4.2 The A46 Trunk Road (Newark to Widmerpool Improvement and Slip Roads)<br />
Supplementary (Side Roads) Order Number 1 20__<br />
I. This Order is made under sections 12, 14, 125 and 326 <strong>of</strong> the 1980 Act. It<br />
enables the Secretary <strong>of</strong> State to stop up and provide new private means <strong>of</strong><br />
access to premises affected by this Scheme and to vary The A46 Trunk Road<br />
(Newark to Widmerpool Improvement and Slip Roads) (Side Roads) Order<br />
2009.rule 10 <strong>of</strong> that Act. This corrects a minor error in the 2009 Order.<br />
II. The Order makes changes to the 2009 Order by stopping up two lengths <strong>of</strong><br />
private means <strong>of</strong> access which formally connected Farndon Road to Sproakes<br />
Lane. It also modifies that Order by removing the stopping up <strong>of</strong> the existing<br />
private means <strong>of</strong> access from Farndon Road to Mr Walmsley, PA Freight and Mr<br />
Lawrence, and retains that private means <strong>of</strong> access for pedestrian and cycle<br />
traffic only.<br />
III. The Order also varies the 2009 Order by removing a stopping up <strong>of</strong> an egress to<br />
a petrol filling station in the vicinity <strong>of</strong> Saxondale Roundabout, as shown in<br />
Schedule 10 <strong>of</strong> that Order. This would correct a minor error.<br />
4.3 The A46 Trunk Road (Newark to Widmerpool Improvement and Slip Roads)<br />
Supplementary Compulsory Purchase Order Number 1 20__<br />
I. This Order is made under Sections 239, 240, and 246 <strong>of</strong> the 1980 Act, and<br />
under section 2 <strong>of</strong> the Acquisition <strong>of</strong> Land Act 1981. The Order authorises<br />
compulsory acquisition <strong>of</strong> land and rights for the following purposes:<br />
II. The construction and improvement <strong>of</strong> the new trunk road in the Parish <strong>of</strong><br />
Farndon, in the District <strong>of</strong> Newark and Sherwood;<br />
III. The construction and improvement <strong>of</strong> highways and provision <strong>of</strong> new means <strong>of</strong><br />
access in pursuance <strong>of</strong> the Side Roads Order;<br />
IV. The diversion <strong>of</strong> watercourses and the execution <strong>of</strong> other works on<br />
watercourses in connection with the construction <strong>of</strong> the new trunk road and the<br />
improvement works.<br />
V. The Order enables the Secretary <strong>of</strong> State for Transport compulsorily to acquire<br />
land interests <strong>of</strong> PA Freight, Mr Walmsley and Mr Lawrence in order to enlarge<br />
PA Freight’s lorry park; provide a replacement access to the lorry park; and<br />
provide Mr Lawrence with an improved, separate access. The Order will also<br />
enable the Secretary <strong>of</strong> State to improve drainage for Mr Walmsley, Mr<br />
Lawrence and PA Freight. It is the Agency’s intention to agree licences over<br />
the land to construct the necessary works. If this is not possible title will be<br />
taken.<br />

4.4 The A46 Trunk Road (Newark to Widmerpool Improvement and Slip Roads)<br />
Margidunum Roundabout (Detrunking) Order 20__<br />
I. This Order is made under Sections 10 and 12 <strong>of</strong> the Highways Act 1980 and<br />
will detrunk a short length <strong>of</strong> the existing A46 Trunk Road at Margidunum<br />
Roundabout. It will correct a minor omission in The A46 Trunk Road (Newark<br />
to Widmerpool Improvement and Slip Roads) (Detrunking) Order 2009.<br />
II.<br />
No objections or representations have been made with respect to the<br />
Detrunking Order.<br />

5 Traffic Forecasting<br />
5.1 The traffic model prepared for the 2007 Public Inquiry was revised to include the<br />
Kinoulton amendments and the extra connection to the A606 Widmerpool junction<br />
that was a part <strong>of</strong> the 2010 Supplementary Orders. All <strong>of</strong> the other components <strong>of</strong><br />
the traffic model have remained the same. The subsequent modifications at the<br />
Farndon roundabout were too small to be represented in the traffic model.<br />
5.2 The Kinoulton amendments changed the journey times for local trips at the southern<br />
end <strong>of</strong> the Scheme. However, these changes were very small in comparison to the<br />
overall travel time benefits delivered by the whole Scheme. The updated travel time<br />
savings for the Scheme were presented at the 2010 Public Inquiry. The travel time<br />
savings will not change substantially as a result <strong>of</strong> the <strong>2011</strong> draft Supplementary<br />
Orders.<br />

6 Environmental Assessment <strong>of</strong> Supplementary Orders Proposals<br />
6.1 The <strong>2011</strong> draft Supplementary Orders as detailed in Paragraphs 4.2 and 4.3 correct<br />
a number <strong>of</strong> omissions from the previous Orders and provide for revised Private<br />
Means <strong>of</strong> Access arrangements at Farndon.<br />
6.2 In as much as these draft Supplementary Orders simply correct minor errors and<br />
omissions no change in scheme design is associated with them.<br />
6.3 Therefore no further consideration has been given to these draft Supplementary<br />
Orders as the assessment made in the original Environmental <strong>Statement</strong>, published<br />
in January 2007 and subsequent Addenda No. 2, published in October 2009<br />
remains valid.<br />

7 Supporters, Objections and Representations<br />
7.1 Summary The objection period to the draft Supplementary Orders published in May<br />
<strong>2011</strong> ended on 24 June <strong>2011</strong>. In all, nine affected landowners, local authorities,<br />
statutory bodies and other interested parties responded to the publication <strong>of</strong> the<br />
draft Supplementary Orders by the end <strong>of</strong> the objection period. Two letters <strong>of</strong><br />
objection, received after the closure <strong>of</strong> the statutory consultation period, dealt with<br />
matters which are not relevant to the draft Orders. A letter <strong>of</strong> support was received<br />
from Nottinghamshire County Council, in which the Council sought assurances<br />
about the capacity <strong>of</strong> Farndon Roundabout. As noted above, no objections have<br />
been received in connection with the draft Detrunking Order. Three statutory<br />
objections were received from PA Freight Services Ltd (“PA Freight”), <strong>of</strong><br />
International Logistics Centre, Fosse Way, Farndon, Newark, Nottinghamshire<br />
NG24 4SP, Maurice Walmsley <strong>of</strong> Kardeel House, 7 Bulpit Lane, Balderton, Newark<br />
NG24 3PT and Charles Lawrence, <strong>of</strong> Cranleigh Park 153a Farndon Road Newark,<br />
Nottinghamshire NG24 4SP. Each <strong>of</strong> these objections will be addressed in the<br />
Agency’s evidence before the Inquiry, in accordance with its case as summarised in<br />
the paragraphs that follow.<br />
7.2 PA Freight Services Ltd.<br />
I. PA Freight has objected on the ground that the design <strong>of</strong> the access to their<br />
premises proposed in the Orders is inadequate. Specifically, they consider that<br />
the proposed access, in that it would not provide adequate access, as<br />
compared with that which the company currently enjoys; would not provide<br />
sufficient working space for their operations; and would jeopardise the<br />
company’s operations at the site. According to PA Freight, the arrangements<br />
for the shared access with other users (namely, Mr M Walmsley’s and other<br />
users visiting PA Freight’s site) would be unsafe within the area <strong>of</strong> the lorry<br />
park.<br />
II. The design would not resolve existing drainage problems, and the gradients<br />
within the lorry park would cause operational difficulties for the large vehicles<br />
operated by the company. The company also object that the design would not<br />
provide adequate access to their retained land. This is situated to the East <strong>of</strong><br />
the existing A46 Trunk Road and west <strong>of</strong> the River Devon<br />
III.<br />
PA Freight acquired their site in late 1996/early 1997 at which time the depot<br />
had taken on the broad character as exists today. This was as a result <strong>of</strong> a<br />
number <strong>of</strong> planning consents between 1985 and 1997 that increased both the<br />
storage capacity and <strong>of</strong>fice accommodation on site. The adjoining land, owned<br />
by Mr Walmsley has been used for vehicle parking and or storage by PA<br />
Freight since 1996/1997. There are no planning consents for such use, or for<br />
any development <strong>of</strong> the land. The lorry park was constructed during 2007,<br />
again without the necessary planning consent. Retrospective planning consent<br />
was obtained <strong>August</strong> 2007.<br />

IV. The Agency has consulted with PA Freight with a view to obtaining an<br />
understanding <strong>of</strong> their operational requirements, and is <strong>of</strong> the opinion, as it will<br />
explain in evidence, that it has successfully addressed their concerns with<br />
respect to the proposed scheme. The Agency’s evidence will show that the<br />
scheme will provide a reasonable replacement access and will not disrupt PA<br />
Freight’s operations. The internal layout <strong>of</strong> PA freight’s secure yard will not be<br />
affected. The Agency has maintained the same number <strong>of</strong> lorry parking<br />
spaces, but with more generous proportions. This would allow occasional use<br />
by long vehicles.<br />
V. The design <strong>of</strong> the proposed new access is no less safe than the existing<br />
arrangements, and in fact <strong>of</strong>fers flexibility, with fewer points <strong>of</strong> conflict. The<br />
Agency has consulted the Environment Agency about drainage for the whole<br />
scheme. In order to remove any potential for future drainage problems in the<br />
locality the Agency is taking access over the land to cleanse existing drainage<br />
ditches and outfalls. The gradients proposed for PA Freight’s access and lorry<br />
parking area are either better, or no worse, than those which currently exist.<br />
VI. As regards the retained land, the Agency’s evidence will show that adequate<br />
provision has been made. Any outstanding issues can and will be dealt with<br />
as accommodation works, by providing suitable access, gated if required. It is<br />
the Agency’s intention to take title over the land included in the Order if<br />
licences cannot be agreed.<br />
7.3 Maurice Walmsley<br />
I. Mr Walmsley objected to the design on safety grounds, on the basis that the<br />
shared use <strong>of</strong> the proposed access, which traverses land in his ownership,<br />
with PA Freight and Mr Lawrence will result in vehicle conflicts and reduced<br />
safety. A section <strong>of</strong> Mr Walmsley’s land is leased to PA Freight and is being<br />
used for vehicle movements and storage <strong>of</strong> materials. Mr Walmsley’s concerns<br />
centre on potential conflicts between PA Freight’s vehicle movements and the<br />
proposed revised access arrangements to his and, which would cross PA<br />
Freight’s lorry park. Mr Walmsley has also raised concerns about gradients<br />
within the revised access. In addition, Mr Walmsley has indicated that he may<br />
need to use the land he currently leases to PA Freight for the storage <strong>of</strong> new<br />
and used vehicles which are at present delivered to his town centre premises.<br />
Investigations with the local planning authority have shown that there are no<br />
planning consents which enable Mr Walmsley to use his land for vehicle or<br />
storage. Nor is there any consent for development <strong>of</strong> this land.<br />
II. The Agency’s evidence before the Inquiry will show that the design <strong>of</strong> the<br />
proposed new access is no less safe than the current arrangements, and that<br />
safety will not be reduced should Mr Walmsley need to use his land to unload<br />
vehicles. The Agency’s design would have fewer conflicts than the existing<br />
access arrangements to PA Freight’s and Mr Walmsley’s land. As stated<br />
above, it is the Agency’s intention only to take title over the land if licences<br />
cannot be agreed.<br />

7.4 Charles Lawrence<br />
I. Mr Lawrence’s property is in residential use by him and adjoins PA Freight’s<br />
land. He currently shares the access in common with both Mr Walmsley and<br />
PA Freight. The Agency’s proposed access will provide him with a separate<br />
access and remove all conflicts with the other landowners. However, Mr<br />
Lawrence has objected on the grounds that the Compulsory Purchase Order<br />
enables the Secretary <strong>of</strong> State to compulsorily acquire his land.<br />
II. The Agency intends to acquire Mr Lawrence’s land temporarily by agreeing a<br />
licence to cleanse drainage runs and outfalls on his land.<br />
III. The Compulsory Purchase Order would, if made, provide powers to take title<br />
to the land, to enable the Agency to undertake necessary works. Title would<br />
only be taken if the licence cannot be agreed with both Mr Lawrence and PA<br />
Freight.<br />
7.5 Six representations were received:<br />
I. Patrick Mercer, MP raised concerns about the safety and workability <strong>of</strong> the<br />
Agency’s proposals due to conflicting movements between heavy goods<br />
vehicles, cyclists and pedestrians.<br />
II. Newark and Sherwood District Council raised concerns about the visual<br />
impact <strong>of</strong> the proposals and the impact on the local economy should PA<br />
Freight be forced to close down or relocate. The Agency will show that its<br />
proposals will not have an adverse effect on PA Freight’s ability to continue to<br />
operate, and to do so safely, from their current site.<br />
III. Natural England has responded indicating that they have no objections to the<br />
proposals.<br />
IV. Mrs Marjorie Clarkson, <strong>of</strong> Farndon Fields Farm, wrote expressing concerns<br />
about the quality and nature <strong>of</strong> the work affecting her access, which is<br />
currently being undertaken and will be addressed by the contractors. This is<br />
not a valid representation to the draft Orders<br />
V. Mrs Donna Paver, <strong>of</strong> 153 Farndon Road, Farndon, raised concerns about<br />
access to her property. Mrs Paver also raised concerns about the physical<br />
impact <strong>of</strong> the proposals as regards visual impact and an increased number <strong>of</strong><br />
parking bays within PA Freight’s lorry park. The Agency is satisfied that her<br />
access will not be adversely affected by the proposals and her concerns can<br />
be addressed by detailed design. As regards the changes within the lorry<br />
park, there is no increase in the number <strong>of</strong> parking bays and lengthening them<br />
would have little or no impact. The lorry park does not move closer to Mrs<br />
Paver’s property.<br />

VI.<br />
Michael and Ann Rowen, David Rowen and Elizabeth Rowen, <strong>of</strong> Cropwell<br />
Court , Cropwell Butler, Leicestershire wrote saying that the scope <strong>of</strong> the<br />
Public Inquiry into the draft Orders should be widened to address their<br />
concerns and appraise the merits <strong>of</strong> the proposed installation <strong>of</strong> MS3 signs<br />
adjacent to their property. The installation <strong>of</strong> MS3 signs on the A46 Trunk<br />
Road is not a matter for consideration under the draft Orders and therefore is<br />
not a valid representation. The Secretary <strong>of</strong> State has a duty to provide signing<br />
to give directions and ensure safety <strong>of</strong> the travelling public.<br />

8 Continuing Dialogue<br />
8.1 The Highways Agency has been corresponding and meeting with affected parties,<br />
and will continue to so in order to try to resolve any outstanding issues.<br />
8.2 If it does not prove possible to resolve all the concerns identified above before the<br />
Public Inquiry, then, in due course, as part <strong>of</strong> the Inquiry process, appropriate<br />
evidence in response will be served.<br />

11 Conclusion<br />
11.1 The Secretary <strong>of</strong> State for Transport and the Secretary <strong>of</strong> State for Communities<br />
and Local Government announced the decision, published on 19 December 2008,<br />
to make the orders needed for the Scheme following acceptance <strong>of</strong> the Inquiry<br />
Inspector’s recommendations. The Inspector proposed that a number <strong>of</strong><br />
modifications and designs be considered. This resulted in the need for the<br />
Supplementary Orders and these were published on 24 April 2009 with a six week<br />
comment period. The Secretary <strong>of</strong> State for Transport and the Secretary <strong>of</strong> State<br />
for Communities and Local Government announced their decision, published on 15<br />
July 2010, to make those Supplementary Orders following acceptance <strong>of</strong> the Inquiry<br />
Inspector’s recommendations.<br />
11.2 The Inspectors’ Report and Secretaries <strong>of</strong> States’ decision letters are available at<br />

11.3 The Inspectors, in preparing their Report and conclusions, had regard to all<br />
representations and evidence and all Inquiry documents to reach fair and balanced<br />
judgements in their Reports to the Secretaries <strong>of</strong> State. They made formal<br />
accompanied site inspections on various separate occasions and several<br />
unaccompanied inspections.<br />
11.4 The Secretaries <strong>of</strong> State, in turn, in reaching their decisions on the published<br />
Orders and Supplementary Orders, considered both Inspectors’ reports in full,<br />
together with their conclusions and recommendations. They also had available to<br />
them all Inquiry documents listed in the Inspectors’ Reports to enable them to make<br />
fair and balanced decisions.<br />
11.5 The Agency’s further Supplementary and additional Detrunking Orders are<br />
necessary to implement minor modifications to the Scheme. There has been no<br />
new evidence to change the Agency’s position and it remains <strong>of</strong> the view that these<br />
draft Supplementary Orders and Detrunking Order should therefore be made.<br />
