15 Ballydugan Road, Downpatrick. Proposed car wash (retrospective).
The proposed development is contrary to Policy FLD 1 of the Department's
Planning Policy Statement 15: Planning and Flood Risk, in that it is located
within the flood plain and it does not merit being considered an exception to
the policy.
The proposal is contrary to Policy FLD 1 of the Department's Planning Policy
Statement 15: Planning and Flood Risk, FLD 1, in that the development lies
within a flood plain and as a result, may increase flood risk, will have an
adverse impact on the visual amenity and character of the local landscape and
may adversely impact the features of importance to nature conservation.
The proposal is contrary to the Department's Planning Policy Statement 2:
Planning and Nature Conservation, paragraph 90, in that development would, if
permitted, damage the nature conservation value of the adjacent river corridor
and associated Quoile River and Downpatrick Marshes Site of Local Nature
Conservation Importance (SLNCI).
The proposal is contrary to the Department's Planning Policy Statement 3:
Access, Movement and Parking the proposed access would, if permitted,
prejudice the safety and convenience of Road Users since the location of the
access would conflict with the vehicles entering the slip lane to the Asda
Complex.
The proposal is contrary to Policy CTY 1 of Draft Planning Policy Statement 21,
Sustainable Development in the Countryside in that there are no overriding
reasons why this development is essential and could not be located within a
settlement.
The proposal is contrary to Policy CTY 15 of Draft Planning Policy Statement
21, Sustainable Development in the Countryside in that the development
would, if permitted, mars the distinction between the defined settlement limit
of Downpatrick and the surrounding countryside or that otherwise results in
urban sprawl.
The proposal is contrary to Polcy IBD 1 & Policy IBD 6 of Draft Planning Policy
Statement 4, Industry, Business and Distribution in that it does not fit into any
of the exceptions for Development in the Countryside.
The proposal is contrary to Policy CON 2 of the Ards and Down Area Plan 2015
in that development would, if permitted, be liable to adversely affect the
environmental quality, integrity or character of LLPA 1.
