NONDISCRIMINATION POLICY STATEMENT
The School Administrative Unit #48 School Boards including, Campton, Ellsworth, Holderness, Pemi-Baker, Plymouth, Rumney,
Thornton, Waterville Valley, and Wentworth have adopted a policy of nondiscrimination on the basis of sex, race, creed, color, country
of national origin, handicapping condition, disability or age.
Pemi-Baker Cooperative School District, in accordance with the requirements of Title IX of the Education Amendments of 1972;
Section 504 of the Rehabilitation Act of 1973, Title VI of the Civil Rights Act of 1964, The Age Discrimination Act of 1975, Individuals
with Disabilities Education Act, and amendments thereto in Public Laws, hereby declare formally that it is the policy of the Pemi-Baker
Cooperative School Board in their actions, and those of their employees, that there shall be no discrimination on the basis of sex,
race, creed, color, country of national origin, disability or age for employment in, participation in, or operation and administration of
any educational program or activity in the district’s schools.
Inquiries, complaints and other communications relative to the compliance of this policy and other public laws and federal regulations
concerned with nondiscrimination, shall be addressed to:

Any complaints or alleged infractions of the policy, law, or applicable regulations, will be processed through the grievance procedure
as outlined in this Parent/Student Handbook.
The Board acknowledges that their policy of nondiscrimination applies to employment practices in hiring and personnel management
as well as to admissions and participation in, and operation and administration of programs and activities within the Pemi-Baker
Cooperative School District, and is applicable to all persons employed or served by the district.
DEFINITIONS OF NONDISCRIMINATION LAWS
Title VI of the Civil Rights Act of 1964 prohibits discrimination on the basis of race, color or national origin in any program or activity
receiving Federal financial assistance (34 CFR Parts 100 and 101).
Title IX of the Education Amendments of 1972 prohibits discrimination on the basis of sex under federally-assisted education
programs or activities (34 CFR Part 106).
Section 504 of the Rehabilitation Act of 1973 prohibits discrimination on the basis of handicap in any program or activity receiving
Federal financial assistance (34 CFR Part 104).
The Age Discrimination Act of 1975 prohibits discrimination on the basis of age in programs or activities receiving Federal financial
assistance (42 USC 1601, et.seq.).
IDEA Individuals with Disabilities Act and Title II of the Americans with Disabilities Act of 1990 (ADA), 42 USC Section 12134, prohibits
discrimination on the basis of disability in all services, programs and activities of state and local governments.
NONDISCRIMINATION UNDER FEDERAL GRANTS & PROGRAM
No otherwise qualified individual with a disability in the United States as defined in Section 7(20)[29 U.S.C. § 706(20)], shall, solely
by reason of her or his disability, be excluded from the participation in, be denied the benefits of, or be subjected to discrimination
under any program or activity receiving Federal financial assistance or under any program or activity conducted by any Executive
agency or by the United States Postal Service.
Definitions
Individual with a Disability:
any individual who
(i) has a physical or mental impairment which substantially limits one or more such person’s major life activities,
(ii) has a record of such impairment, or
(iii) is regarded as having such an impairment.

Physical or Mental Impairment
(A) any physiological disorder or condition, cosmetic disfigurement, or anatomical loss affecting one or more of the following
body systems: neurological; musculoskeletal; special sense organs; respiratory; including speech organs; cardiovascular;
reproductive; digestive; genitourinary; hemic and lymphatic; skin; and endocrine; or
(B) any mental or psychological disorder, such as mental retardation, organic brain syndrome, emotional or mental illness, and
specific learning disabilities.
