<strong>in</strong> the Cape Prov<strong>in</strong>ce, and after 1986, Regional Services Councils and,<br />
<strong>in</strong> the Natal, Jo<strong>in</strong>t Services Councils. <strong>The</strong> M<strong>in</strong>ister was entrusted with<br />
the <strong>decision</strong>-mak<strong>in</strong>g not because there were no local authorities, but<br />
because the <strong>in</strong>terest at stake was agriculture. <strong>The</strong> reference <strong>in</strong> the<br />
Act to municipal areas, as then def<strong>in</strong>ed and demarcated, was merely<br />
a convenient way of def<strong>in</strong><strong>in</strong>g ‘agricultural land’.<br />
Despite contested historical contexts, approach<strong>in</strong>g the matter<br />
through the prism of def<strong>in</strong><strong>in</strong>g functional areas is correct; it places the<br />
dispute <strong>in</strong> the appropriate constitutional space where one can debate<br />
the policy imperatives of one def<strong>in</strong>ition over another. <strong>The</strong> draw<strong>in</strong>g of<br />
clear boundaries of the fuzzy concept of ‘municipal plann<strong>in</strong>g’ is a case<br />
<strong>in</strong> po<strong>in</strong>t and a specific approach is presented here.<br />
‘Municipal plann<strong>in</strong>g’ is def<strong>in</strong>ed by two concepts — the mean<strong>in</strong>g of<br />
‘plann<strong>in</strong>g’ and the reach of the qualifier ‘municipal’. 52 Given the<br />
broad def<strong>in</strong>ition of plann<strong>in</strong>g, there are bound to be overlaps with<br />
other functional areas. Agriculture also deals with land use plann<strong>in</strong>g<br />
and so does ‘environment’ and ‘nature conservation’, all Schedule 4A<br />
functional areas. <strong>The</strong> qualifier ‘municipal’ is then key to the proper<br />
demarcation of a municipality’s land use plann<strong>in</strong>g powers.<br />
In the recent <strong>decision</strong> of City of Johannesburg Metropolitan<br />
Municipality v Gauteng Development Tribunal and Others, 53 Nugent<br />
JA def<strong>in</strong>ed ‘municipal plann<strong>in</strong>g’ as follows:<br />
It is clear that the word ‘plann<strong>in</strong>g’, when it is used <strong>in</strong> the context of<br />
municipal affairs, is commonly understood to refer to the control and<br />
regulation of land use, and I have no doubt that it was used <strong>in</strong> the<br />
Constitution with that common usage <strong>in</strong> m<strong>in</strong>d. <strong>The</strong> prefix ‘municipal’<br />
does no more than to conf<strong>in</strong>e it to municipal affairs.<br />
Municipal affairs must necessarily relate to matters that fall with<strong>in</strong><br />
the competence of a municipality. Plann<strong>in</strong>g is an <strong>in</strong>strumentality <strong>in</strong><br />
the service of other substantive local government functional areas.<br />
<strong>The</strong>y relate ma<strong>in</strong>ly to the built environment — zon<strong>in</strong>g, build<strong>in</strong>g<br />
regulations and so forth. <strong>The</strong> question is, then, whether <strong>decision</strong>s on<br />
subdivisions of agricultural land are part of municipal affairs. It is<br />
difficult to conceive of the municipal <strong>in</strong>terest at stake when a<br />
<strong>decision</strong> is to be made whether a farmer may bequeath his far-flung<br />
farm to his children by fragment<strong>in</strong>g the farm <strong>in</strong> small hold<strong>in</strong>gs. <strong>The</strong><br />
result of such a subdivision, agri-economics have taught us, may be<br />
that the fragmented farm <strong>in</strong>evitably leads to unproductive land<br />
portions, which eventually impacts on food security. Food security is<br />
