the Development Facilitation Act. 61 In arriv<strong>in</strong>g at a <strong>decision</strong> <strong>in</strong> the<br />

certification proceed<strong>in</strong>gs the Court will have to address the matter<br />

from a constitutional division of powers paradigm. Moreover, it would<br />

have to confront Yacoob J’s approach as the SCA relied explicitly on<br />

the dicta <strong>in</strong> the m<strong>in</strong>ority judgment.<br />

<strong>The</strong> Development Facilitation Act of 1995, enacted at the same<br />

time as the transitional phase of local government commenced,<br />

provided for, among other th<strong>in</strong>gs, the establishment of prov<strong>in</strong>cial<br />

development tribunals to fast track urban-based developments. When<br />

local government’s powers, as listed <strong>in</strong> the 1996 Constitution, were<br />

implemented at the end of 2000, <strong>in</strong>clud<strong>in</strong>g powers relat<strong>in</strong>g to<br />

‘municipal plann<strong>in</strong>g’, a the lack of clarity on the cut off po<strong>in</strong>ts<br />

between competencies <strong>in</strong>evitably materialised. <strong>The</strong> City of<br />

Johannesburg, still apply<strong>in</strong>g old order ord<strong>in</strong>ances, 62 sought to<br />

determ<strong>in</strong>e the establishment of new townships and the application of<br />

build<strong>in</strong>g regulations. <strong>The</strong> prov<strong>in</strong>cial development tribunal sought to<br />

do the same. A developer that failed to get permission from the City<br />

could conveniently turn to the prov<strong>in</strong>cial tribunal, often with success.<br />

<strong>The</strong> question that confronted the SCA was who can make the f<strong>in</strong>al<br />

call — the City or the prov<strong>in</strong>ce. <strong>The</strong> Court correctly approached the<br />

matter from a division of powers angle. It def<strong>in</strong>ed ‘municipal<br />

plann<strong>in</strong>g’, draw<strong>in</strong>g on the dicta of Yacoob J <strong>in</strong> <strong>Wary</strong> v Stalwo, 63 and<br />

found that <strong>decision</strong>s relat<strong>in</strong>g to the built-environment (the<br />

establishment of township and the condition under which they are<br />

established), as listed <strong>in</strong> the Ord<strong>in</strong>ance, were properly located <strong>in</strong> the<br />

functional area of ‘municipal plann<strong>in</strong>g’. 64 <strong>The</strong> provisions of the<br />

Development Facilitation Act accord<strong>in</strong>g those powers to a prov<strong>in</strong>cial<br />

organ of state, were thus <strong>in</strong> conflict with the Constitution and <strong>in</strong>valid.<br />

While the control over agricultural land will not be <strong>in</strong> issue, the<br />

Constitutional Court is bound to provide reasoned def<strong>in</strong>ition of<br />

‘municipal plann<strong>in</strong>g’.<br />

zon<strong>in</strong>g of land to be used for specific purposes, <strong>in</strong>clud<strong>in</strong>g agricultural purposes;<br />

(f) the area of erven; (g) the regulation of the erection of build<strong>in</strong>gs’.
