come the M<strong>in</strong>ister may thwart that power by simply categoris<strong>in</strong>g land<br />
fall<strong>in</strong>g <strong>in</strong> a municipal area <strong>in</strong> terms of section 3 of the Act as<br />
‘agricultural’? On the Court’s own analysis that power would be<br />
unconstitutional.<br />
Proceed<strong>in</strong>g from a literalist <strong>in</strong>terpretation, airbrush<strong>in</strong>g the<br />
conclusion with an unnuanced view of the constitutional status of<br />
local government, the <strong>decision</strong> was ripe for consideration by the<br />
Constitutional Court.<br />
4 <strong>The</strong> Constitutional Court majority<br />
In decid<strong>in</strong>g whether to allow the appeal from the Supreme Court of<br />
Appeal, the majority <strong>decision</strong> of the Constitutional Court, delivered<br />
by Kroon AJ, 18 already answered, albeit obliquely, the question at<br />
hand. <strong>The</strong> Constitutional Court’s jurisdiction is limited to<br />
‘constitutional matters, and issues connected with <strong>decision</strong>s on<br />
constitutional matters.’ 19 Although the appeal <strong>in</strong>volved the<br />
<strong>in</strong>terpretation of a statute, if such <strong>in</strong>terpretation <strong>in</strong>volved ‘the<br />
<strong>in</strong>terpretation, application and uphold<strong>in</strong>g of the Constitution itself,<br />
<strong>in</strong>clud<strong>in</strong>g issues concern<strong>in</strong>g the status, powers or functions of an organ<br />
of State and disputes between organs of State’, 20 the Court has<br />
jurisdiction. <strong>The</strong> Court held that <strong>in</strong> as much as the SCA read<strong>in</strong>g of the<br />
proviso could result <strong>in</strong> the removal of a national m<strong>in</strong>ister’s power, it<br />
raises a constitutional matter. In addition, the Court agreed that the<br />
<strong>in</strong>terpretation of the statute could be <strong>in</strong>fluenced by the demands of<br />
three rights <strong>in</strong> the Bill of Rights, namely, the right to a protected<br />
environment, 21 land 22 and sufficient food. 23 Once the constitutional<br />
dimension of the dispute was established, consider<strong>in</strong>g the matter<br />
must further also be <strong>in</strong> the <strong>in</strong>terest of justice. 24 <strong>The</strong> significant<br />
consequences of the judgment left little doubt that the Court should<br />
hear the matter, as Kroon AJ expla<strong>in</strong>ed:<br />
[T]he Supreme Court of Appeal’s <strong>in</strong>terpretation could potentially have<br />
far-reach<strong>in</strong>g effects on agricultural policy <strong>in</strong> the country, for beyond the<br />
narrow facts of this case. Land, agriculture, food production and<br />
environmental considerations are obviously important policy issues at a<br />
national level. <strong>The</strong> question is not whether the municipalities should not<br />
