Your own rights. Who has the rights? (Producer, director, scenario writer, …).<br />
C<strong>on</strong>sider who will be shar<strong>in</strong>g the copyrights <strong>and</strong> especially the exploitati<strong>on</strong> rights<br />
(<strong>in</strong> case you’re mak<strong>in</strong>g the producti<strong>on</strong> for somebody else, your <strong>in</strong>stituti<strong>on</strong> for<br />
example, they may <strong>in</strong>herit a part of these rights)<br />
The rights of the pers<strong>on</strong>s <strong>and</strong> locati<strong>on</strong>s appear<strong>in</strong>g <strong>in</strong> the movie (d<strong>on</strong> ‘t forget that<br />
even the students appear<strong>in</strong>g <strong>in</strong> a classroom record<strong>in</strong>g have rights <strong>on</strong> their<br />
appearance, beside the fact that their privacy has to be protected).<br />
Are all elements (c<strong>on</strong>tributors, texts, images, sounds, music, quotes…) that are<br />
be<strong>in</strong>g used <strong>in</strong> your video cleared for usage? Do not assume that images that are<br />
available for use for educati<strong>on</strong>al purposes (like show<strong>in</strong>g <strong>in</strong> the classroom) can be<br />
re-used unc<strong>on</strong>diti<strong>on</strong>ally <strong>in</strong> new producti<strong>on</strong>s.<br />
Creative Comm<strong>on</strong>s 9<br />
As a producer, you want to claim your <strong>in</strong>tellectual rights: you want users <strong>and</strong> re-users to<br />
acknowledge the fact that you are the creator <strong>and</strong> that <strong>in</strong> the mak<strong>in</strong>g of this product,<br />
you have <strong>in</strong>vested effort, creativity <strong>and</strong> knowledge. You can do this effectively <strong>and</strong> easily<br />
by adopt<strong>in</strong>g <strong>on</strong>e of the Creative Comm<strong>on</strong>s copyright or <strong>in</strong>tellectual property right<br />
schemes.<br />
Creative Comm<strong>on</strong>s (CC) provides free tools that allow authors, scientists, artists, <strong>and</strong><br />
educators to easily mark their creative work with the freedom or restricti<strong>on</strong> they want it<br />
to carry. Creators can use CC to select the appropriate copyright scheme for his/her<br />
creati<strong>on</strong>: this can range from “All Rights Reserved” to “Some Rights Reserved”. Creative<br />
Comm<strong>on</strong>s covers websites, academic publicati<strong>on</strong>s, music, film, courseware <strong>and</strong> so <strong>on</strong>,<br />
but is not designed to cover software.<br />
This obviously applies <strong>on</strong>ly to orig<strong>in</strong>al materials created entirely by you. If you have<br />
<strong>in</strong>tegrated resources (video, music, photos, text, film) produced by others, then aga<strong>in</strong>,<br />
the exist<strong>in</strong>g copyright legislati<strong>on</strong> applies to those materials <strong>and</strong> you should c<strong>on</strong>tact the<br />
copyright holders for authorisati<strong>on</strong>.<br />
It should be noted that Creative Comm<strong>on</strong>s is not really an IPR (<strong>in</strong>tellectual property<br />
rights) scheme, but merely a comprehensible representati<strong>on</strong> of the exist<strong>in</strong>g IPR, for the<br />
ease of use of the f<strong>in</strong>al user (<strong>and</strong> by its nature an encouragement to easier <strong>and</strong> wider<br />
distributi<strong>on</strong> of c<strong>on</strong>tent). The fact is that it is “nati<strong>on</strong>ally accepted” means that the<br />
nati<strong>on</strong>al legislative have identified the various Creative Comm<strong>on</strong>s schemes <strong>and</strong> matched<br />
them to the exist<strong>in</strong>g IPR legislati<strong>on</strong> <strong>in</strong> your country. In the end, the nati<strong>on</strong>al legislati<strong>on</strong><br />
still applies, <strong>and</strong> Creative Comm<strong>on</strong>s is simply a user-friendly translati<strong>on</strong> for publishers’<br />
<strong>and</strong> users’ sake.<br />
