Recommendations were made <strong>in</strong> relation to the availability <strong>of</strong> <strong>Advocacy</strong> <strong>Services</strong> <strong>in</strong><br />

all <strong>of</strong> the <strong>in</strong>spected wards. <strong>Advocacy</strong> services are available with<strong>in</strong> the acute wards <strong>in</strong><br />

Gransha Hospital <strong>and</strong> the dementia wards with<strong>in</strong> Waterside. However the availability<br />

<strong>of</strong> advocacy services is limited with<strong>in</strong> Tyrone <strong>and</strong> Fermanagh Hospital.<br />

Progression towards achievement <strong>of</strong> Quality Improvement Plans will be exam<strong>in</strong>ed<br />

dur<strong>in</strong>g current <strong>in</strong>spections by MHLD Officers <strong>in</strong> 2012.<br />

8.0 DHSSPS <strong>Advocacy</strong> Work<strong>in</strong>g Group Guidance<br />

In 2010 <strong>in</strong> l<strong>in</strong>e with other UK health departments, the Department <strong>of</strong> health<br />

established a work<strong>in</strong>g group to help develop a policy on advocacy services <strong>in</strong> a<br />

health <strong>and</strong> social care sett<strong>in</strong>g. The RQIA mental health <strong>of</strong>ficer with responsibility for<br />

advocacy was <strong>in</strong>vited to jo<strong>in</strong> this group. A draft document was agreed <strong>in</strong> June 2011<br />

<strong>and</strong> went out for consultation. (DHSSPSNI draft advocacy policy document 2011).<br />

This document precedes the new proposed <strong>in</strong>capacity legislation, but will be used to<br />

support the role <strong>of</strong> the <strong>in</strong>dependent advocate. Information gleaned dur<strong>in</strong>g the course<br />

<strong>of</strong> the work has <strong>in</strong>formed this paper.<br />

To <strong>in</strong>form this work, the Department also carried out a scop<strong>in</strong>g study <strong>of</strong> advocacy<br />

services commissioned or provided by the five HSC Trusts, as well as research <strong>in</strong>to<br />

advocacy provision <strong>in</strong> the rest <strong>of</strong> the UK, the Republic <strong>of</strong> Irel<strong>and</strong> <strong>and</strong> <strong>in</strong>ternationally<br />

(New Zeal<strong>and</strong> <strong>and</strong> South Australia ma<strong>in</strong>ly). This, along with the outcomes <strong>of</strong> three<br />

workshops held <strong>in</strong> September <strong>and</strong> October 2010, has helped to <strong>in</strong>form the draft<strong>in</strong>g <strong>of</strong><br />

the policy. The purpose <strong>of</strong> the workshops was to engage, at an early stage, with<br />

<strong>in</strong>terested groups (<strong>in</strong>clud<strong>in</strong>g statutory <strong>and</strong> voluntary sector organisations <strong>and</strong> service<br />

users <strong>and</strong> carers) to <strong>in</strong>form policy development. A key driver for this work is the<br />

proposed <strong>in</strong>troduction <strong>of</strong> a new statutory right to an <strong>in</strong>dependent advocate <strong>in</strong> the<br />

<strong>Mental</strong> Capacity (<strong>Health</strong>, Welfare <strong>and</strong> F<strong>in</strong>ance) Bill which the Department is currently<br />

prepar<strong>in</strong>g. This proposed new statutory right reflects the grow<strong>in</strong>g recognition <strong>of</strong> the<br />

value <strong>of</strong> advocacy services <strong>in</strong> protect<strong>in</strong>g the human rights <strong>of</strong> the most vulnerable <strong>in</strong><br />

our society as acknowledged <strong>in</strong> the Bamford Review report on Human Rights <strong>and</strong><br />

Equality <strong>of</strong> Opportunity.<br />

The DHSSPS “Develop<strong>in</strong>g <strong>Advocacy</strong> <strong>Services</strong>". A policy guide for commissioners”<br />

May 2012 also aims to pave the way for the proposed new statutory right by seek<strong>in</strong>g<br />

to improve underst<strong>and</strong><strong>in</strong>g <strong>of</strong> what advocacy is <strong>and</strong> how advocacy services <strong>in</strong> a<br />

health <strong>and</strong> social care sett<strong>in</strong>g are commissioned. It sets out key pr<strong>in</strong>ciples <strong>and</strong><br />

st<strong>and</strong>ards for the future commission<strong>in</strong>g <strong>and</strong> delivery <strong>of</strong> advocacy services <strong>and</strong><br />

addresses the issue <strong>of</strong> <strong>in</strong>dependence. Further guidance will be prepared on the<br />

proposed new statutory right, once the detail has been developed.<br />
