9.0 Future Monitor<strong>in</strong>g Requirements by RQIA<br />

The DHSSPS envisage that RQIA will have a significant role <strong>in</strong> monitor<strong>in</strong>g, quality,<br />

availability <strong>and</strong> access to <strong>in</strong>dependent advocacy under the new legislation as a<br />

safeguard for patients who are deemed to lack capacity to consent to tier 3<br />

<strong>in</strong>terventions e.g. ECT or forced feed<strong>in</strong>g. It is proposed that this may <strong>in</strong>volve a<br />

similar process to that currently <strong>in</strong> place for appo<strong>in</strong>tment, registration <strong>and</strong> referral to<br />

Part 2 <strong>and</strong> Part 4 doctors under the exist<strong>in</strong>g <strong>Mental</strong> <strong>Health</strong> Order. (1986)<br />

There is much current debate around the concept <strong>of</strong> “<strong>in</strong>dependence”. Most <strong>of</strong> the<br />

current advocacy providers are employed by organisations which also provide<br />

accommodation <strong>and</strong> care services to Trusts. The level <strong>of</strong> tra<strong>in</strong><strong>in</strong>g varies greatly<br />

amongst advocates <strong>and</strong> it is vital to ensure that commissioners do not spend all <strong>of</strong><br />

the available resources on the statutory advocates at the expense <strong>of</strong> peer led<br />

services.<br />

The provision <strong>of</strong> advocacy services to those under the age <strong>of</strong> 16 is outwith the<br />

proposed new legislation.<br />

10.0 Summary<br />

There is a clear recognition <strong>of</strong> the importance <strong>of</strong> the cont<strong>in</strong>ued provision <strong>of</strong> <strong>Advocacy</strong><br />

<strong>Services</strong> <strong>in</strong> Northern Irel<strong>and</strong>. The anticipated new capacity legislation has re<strong>in</strong>forced<br />

the growth <strong>of</strong> the advocacy movement <strong>and</strong> government <strong>in</strong>terest <strong>in</strong> this area. The<br />

Patient Client Council <strong>and</strong> the HSCB, as the commissioner, are both <strong>in</strong>terested <strong>in</strong><br />

sett<strong>in</strong>g st<strong>and</strong>ards for advocacy services <strong>and</strong> explor<strong>in</strong>g the options available for<br />

delivery <strong>of</strong> services.<br />

RQIA has been at the forefront <strong>of</strong> establish<strong>in</strong>g mutually beneficial relationships with<br />

advocates <strong>and</strong> carers representatives. It is envisaged that we will cont<strong>in</strong>ue to engage<br />

with advocates <strong>in</strong> design<strong>in</strong>g <strong>and</strong> implement<strong>in</strong>g our <strong>in</strong>spection programme <strong>and</strong> <strong>in</strong><br />

ensur<strong>in</strong>g that service user‟s benefit from the added protections that access to<br />

advocacy affords them.<br />

The RQIA <strong>Advocacy</strong> Forum will cont<strong>in</strong>ue to meet quarterly.<br />

There is a significant amount <strong>of</strong> work to be done <strong>in</strong> the com<strong>in</strong>g year <strong>in</strong> conjunction<br />

with DHSSPS, both with regard to on-go<strong>in</strong>g policy development relat<strong>in</strong>g to advocacy<br />

<strong>in</strong> implement<strong>in</strong>g the processes <strong>in</strong>volved <strong>in</strong> the adm<strong>in</strong>istrative procedures required to<br />

support the <strong>in</strong>dependent advocate role <strong>and</strong> <strong>in</strong> signpost<strong>in</strong>g patients to the most<br />

appropriate <strong>Advocacy</strong> Service to best meet their needs. It is envisaged that the new<br />

legislation will be <strong>in</strong> place by 2016.<br />

By cont<strong>in</strong>u<strong>in</strong>g to develop relationships with advocates, RQIA can beg<strong>in</strong> to explore<br />

options to <strong>in</strong>volve service users <strong>and</strong> carers <strong>in</strong> our ma<strong>in</strong>stream <strong>in</strong>spection<br />

programme. This helps to re<strong>in</strong>force RQIAs commitment to PPI <strong>and</strong> raise the calibre<br />

<strong>of</strong> our <strong>in</strong>spection activity, putt<strong>in</strong>g the public <strong>and</strong> the service user at the heart <strong>of</strong><br />

everyth<strong>in</strong>g we do.<br />
