Q. Any other questions, other than about the extent of
the prior knowledge?
A. For example, in the Penshurst cases, Brother Chute
said that he had informed Brother Charles Howard with
respect to something. It's not clear what the "something"
was, and it is certainly not clear whether he made any
admissions other than what he had said in some other cases
about hugging. So there is no determination there of
whether what was being disclosed at the time was a matter
of sexual assault.
Q. That example you have just given me is an example of
a question about the extent of prior knowledge, isn't it?
A. Yes.
Q. There is a document entitled "Marist Brothers Claims
Data", which was served on all the relevant parties last
week. Do you have a copy of that with you?
A. Yes.
