FOREWORD<br />

First and foremost, I would like to warmly welcome the publication of “<strong>Justice</strong> for <strong>All</strong>: An Assessment<br />

of Access to <strong>Justice</strong> in Five Provinces of Indonesia” – the result of a study, conducted trough the<br />

cooperation of Bappenas, <strong>UNDP</strong>, and PSPK-UGM. This study will provide us with a description<br />

of the real circumstances of the five provinces, which experienced conflicts, either vertically or<br />

horizontally, such as in West Kalimantan, Central Kalimantan, Maluku, North Maluku and Central<br />

Sulawesi.<br />

Access to justice, as shown in the five provinces, has become a very important issue when justice<br />

seekers are in situation of conflict, especially those who are incapacitated and marginalized.<br />

Imbalance of power, rivalry of authority over natural resources, exploitation of racial sentiments<br />

and of religions have become stimulating factors for the occurrence of multidimensional and<br />

complex clashes. <strong>Justice</strong> has turned out to be a “luxury” and can hardly be touched by common<br />

people.<br />

In order to strengthen good governance, effective involvement of both the society and the<br />

government is required. Effective involvement, in turn, requires continuous support for applying<br />

the principles of public participation, accountability and transparency, particularly in the legal field.<br />

<strong>Justice</strong> seekers need to have sufficient and relevant information on laws and procedures in<br />

Indonesia. Through such information they would be able to acknowledge their own legal rights<br />

and obligations, how to implement them, how to seek redress for any future violations of those<br />

rights, as well as the consequences of any breach of obligations.<br />

Lastly, I expect the findings of this study can contribute a real benefit, not only for law enforcers<br />

and justice seekers, but also for society in general, specifically the poor and marginalized. <strong>For</strong><br />

those who are involved in this study, both directly and indirectly, I hereby would like to express<br />

my highest appreciation.<br />
