Who or What is the Declarant?
THE DECLARANT (otherwise called the
developer) owns a property that is
being developed for use as a condominium.
The declarant is the one to work with
architects, lawyers and property managers
to put together a proposed set of condominium
documents in order to sell a development.
The declarant is the owner of
the property up until the date of registration
of a condominium declaration and
description when the condominium receives
its “name.” Following registration,
the declarant must appoint the first board
of directors for the corporation.
The declarant will run the corporation
with a board of directors until the majority
of units have been transferred, at which
point he is required to call and hold a
turnover meeting at which the owners of
the corporation elect a board of directors.
The declarant will continue to have a
relationship with the condominium long
after turnover to ensure that it meets its
obligations to warranty the building.❏
