EVOLVING INSTITUTIONAL FRAMEWORKS AND WOMEN’S RIGHTS: POTENTIALS AND LIMITATIONS<br />

community <strong>in</strong> <strong>Afghanistan</strong> was faced with the new challenge <strong>of</strong> engag<strong>in</strong>g with non-UN-m<strong>and</strong>ated mult<strong>in</strong>ational<br />

forces that, alongside military <strong>and</strong> <strong>in</strong>telligence operations, undertook “hearts <strong>and</strong> m<strong>in</strong>ds” campaigns<br />

through the provision <strong>of</strong> humanitarian assistance <strong>in</strong> the form <strong>of</strong> medical services, food distribution <strong>and</strong> small<br />

<strong>in</strong>frastructure projects. Costy (2004) recorded some <strong>of</strong> the anxieties felt by the NGO community about the <strong>in</strong>terface<br />

<strong>of</strong> military <strong>and</strong> humanitarian objectives <strong>and</strong> the problems <strong>of</strong> “militarized” aid.<br />

At the end <strong>of</strong> 2002, US forces began to implement an exp<strong>and</strong>ed plan for nationwide military support for the<br />

reconstruction effort through the Prov<strong>in</strong>cial <strong>Reconstruction</strong> Teams (PRTs). <strong>The</strong>ir objectives were to provide<br />

more secure conditions, to facilitate the recovery work <strong>of</strong> <strong>in</strong>ternational agencies, to engage <strong>in</strong> the restoration<br />

<strong>of</strong> national <strong>in</strong>frastructure <strong>and</strong> to support the extension <strong>of</strong> the central government’s authority <strong>in</strong> the prov<strong>in</strong>ces.<br />

Orig<strong>in</strong>ally only made up <strong>of</strong> units <strong>of</strong> US-led Coalition, they have been exp<strong>and</strong>ed to address some <strong>of</strong> the grow<strong>in</strong>g<br />

security concerns. 40 Act<strong>in</strong>g on behalf <strong>of</strong> NGOs, the Agency Coord<strong>in</strong>at<strong>in</strong>g Body for <strong>Afghanistan</strong> Relief<br />

(ACBAR) recorded their concerns, which centred around the potential duplication <strong>of</strong> humanitarian <strong>and</strong> reconstruction<br />

efforts between PRTs <strong>and</strong> the assistance community, confusion <strong>in</strong> local communities about the<br />

dist<strong>in</strong>ction between military <strong>and</strong> civilian actors, <strong>and</strong> the lack <strong>of</strong> capacity to provide adequate security to enable<br />

others to undertake their work.<br />

<strong>The</strong> government announced its plan for security sector reform (SSR) at the Tokyo meet<strong>in</strong>g on Consolidation<br />

<strong>of</strong> Peace <strong>in</strong> February 2003. <strong>The</strong> SSR plan <strong>in</strong>cludes reform <strong>of</strong> the M<strong>in</strong>istries <strong>of</strong> Interior <strong>and</strong> Defence, <strong>and</strong> <strong>of</strong> the<br />

police <strong>and</strong> the juridical system, as well as the disarm<strong>in</strong>g, demobiliz<strong>in</strong>g <strong>and</strong> re<strong>in</strong>tegrat<strong>in</strong>g <strong>of</strong> ex-combatants <strong>and</strong><br />

the build<strong>in</strong>g <strong>of</strong> the Afghan National Army (ANA). This process is complicated by the multisectoral donor<br />

support scheme be<strong>in</strong>g <strong>in</strong>sufficiently co-ord<strong>in</strong>ated to facilitate <strong>in</strong>ternational assistance properly. 41 <strong>The</strong> concentration<br />

<strong>of</strong> resources on the capital has also meant that the prov<strong>in</strong>ces were left open to the depredations <strong>of</strong> antigovernment<br />

spoiler groups, the narcotics trade, the entrenchment <strong>of</strong> regional power brokers <strong>and</strong> a ris<strong>in</strong>g<br />

<strong>in</strong>cidence <strong>of</strong> b<strong>and</strong>itry <strong>and</strong> crime (Sedra <strong>and</strong> Middlebrook 2004). <strong>The</strong> NATO-led International Security Assistance<br />

Force (ISAF) mission, which provided security <strong>in</strong> Kabul <strong>and</strong> its immediate environs, was authorized to<br />

exp<strong>and</strong> its m<strong>and</strong>ate <strong>in</strong> October 2003. However, this expansion has been slow, with member states yet to provide<br />

the requisite troops. <strong>The</strong> <strong>Afghanistan</strong> Stabilization Programme (ASP) is a major new <strong>in</strong>itiative to build capacity<br />

at the prov<strong>in</strong>cial level that may assist <strong>in</strong> provid<strong>in</strong>g a security <strong>in</strong>frastructure, but is still <strong>in</strong> its early stages.<br />

<strong>The</strong>re is only a distant prospect <strong>of</strong> the Afghan national police force <strong>and</strong> national army develop<strong>in</strong>g the capabilities<br />

to take over the provision <strong>of</strong> security <strong>in</strong> the short term. <strong>The</strong> fledgl<strong>in</strong>g police force does not provide much<br />

recourse for the protection <strong>of</strong> citizens, least <strong>of</strong> all women. <strong>The</strong> police, sometimes recruited from among local<br />

comm<strong>and</strong>ers, are allegedly <strong>in</strong>volved <strong>in</strong> arbitrary arrest, rape, sexual assault, kidnapp<strong>in</strong>g <strong>and</strong> extort<strong>in</strong>g ransoms for<br />

the release <strong>of</strong> prisoners. Attempts to attract new women recruits <strong>in</strong>to the police force have so far met with limited<br />

success, despite new <strong>in</strong>centives for tra<strong>in</strong><strong>in</strong>g, special transport <strong>and</strong> concessions over attire (IRIN 2004). 42<br />

<strong>The</strong> <strong>Afghanistan</strong> New Beg<strong>in</strong>n<strong>in</strong>gs Programme (ANBP) is a three-year scheme for voluntary demobilization,<br />

disarmament <strong>and</strong> re<strong>in</strong>tegration (DDR) overseen by the M<strong>in</strong>istry <strong>of</strong> Defence <strong>and</strong> implemented by UNDP with<br />

major f<strong>in</strong>ancial support from Japan. Although 20,000 combatants have been demobilized, non-statutory armed<br />

forces cont<strong>in</strong>ue to operate with impunity. A survey conducted by the Human Rights Research <strong>and</strong> Advocacy<br />
