Majority (68%) <strong>of</strong> the respondents are permanent workers with open-ended<br />

contract; followed by contract workers (25%) <strong>and</strong> casual workers (6%). For<br />

most <strong>of</strong> the workers it was not clear who their employers were: the security<br />

company or the client companies <strong>and</strong> <strong>in</strong>dividuals.<br />

5.2.2. Hours <strong>of</strong> Work <strong>and</strong> Overtime<br />

Section 33 <strong>of</strong> the Labour Act (2003) states that the hours <strong>of</strong> work <strong>of</strong> a<br />

worker shall be a maximum <strong>of</strong> eight hours a day or forty hours a week.<br />

Section 34 provides exceptions to Section 33 <strong>in</strong> the follow<strong>in</strong>g areas:<br />

a. where shorter hours <strong>of</strong> work are fixed, the hours <strong>of</strong> work on the<br />

other days <strong>of</strong> the week may be proportionately longer than eight (8) hours<br />

but shall not exceed n<strong>in</strong>e (9) hours a day <strong>of</strong> a total <strong>of</strong> 40 hours a week;<br />

b. where longer hours <strong>of</strong> work are fixed, the average number <strong>of</strong> hours<br />

<strong>of</strong> work reckoned over a period <strong>of</strong> four (4) weeks or less shall not exceed<br />

eight (8) hours per day or forty hours per week or;<br />

c. where longer hours <strong>of</strong> work are fixed, the average number <strong>of</strong> hours<br />

over the period <strong>of</strong> one year shall not exceed eight (8) hours per day or 40<br />

hours per week, <strong>in</strong> the case <strong>of</strong> seasonal work.<br />
