Two day <strong>Training</strong> on Intellectual Property Rights for Research
Institution- CIPET, Bhubaneswar
Background
2013
As part of UNIDO’s program on building awareness and knowledge among the educational and industrial
institutions that are working in the field of research and development on Intellectual Property Rights, a
two day training program on ‘Intellectual Property’ was organised at Central Institute of Plastic
Engineering and Technology (CIPET), at Bhubaneswar, Orissa on 7 th and 8 th June 2013. Experts from
Brain League visited CIPET to deliver lectures on specified topics on various aspects on intellectual
property to a group of around thirty participants comprising of members of the faculty and students of
doctoral program at the institute.
Objectives
Multifold objectives of the training program included providing basic awareness on Intellectual Property
to the participants; developing certain basic skills in Intellectual Property among participants; helping
the participants to understand the basic nuances of Intellectual Property Law and to identify various
types of Intellectual Property dealt with by them during the course of their research; equip the
participants with basic skills to safeguard their valuable IP. As a partner organisation in the Plastic
Project CIPET’s contribution towards venue and other logistical arrangements for the programme are
also appreciated.
Agenda for <strong>Training</strong>
The participants at CIPET mostly comprised of researchers at the institute and hence required an
advanced training in Intellectual Property to help them protect the inventions and scholarly content
they may create during their research. The training program was divided into various sessions on

specific topics of IP relevant to the institute. After discussing with the stakeholders of the institute,
following topics were identified to be relevant to the participants:
1. Fundamentals of Intellectual Property- A primer on various types of intellectual property in
today’s research environment;
2. Patent Search and Patent Filing and Prosecution Strategies- A detailed procedure for conducting
patent search and the process of patent registration
3. Protecting Creative Expression through Copyrights- Basics of Copyright Law
4. Trade Secrets- Protecting valuable information through trade secrets
5. Patent claim constructions and patent specification drafting techniques for research
6. Research Collaborations, Contracting and Licensing IP from research institutions
7. Role Play on IP licensing negotiations
The resource persons for the program included Dr. Kalyan kankanala, Mr. Nishant Kewalramani and Mr.
Sandeep Hegde M.
Course of the Program
The program started with the formal inauguration by Dr. Yadav.
Dr. Kalyan C. Kankanala in his first session on Fundamentals of Intellectual Property, gave a lucid
overview of the meaning, nature and scope of intellectual property. He clarified the objective behind the
legislations governing intellectual property and explained the rationale behind the grant of property
rights on creations of human intellect. He then proceeded to explain each type of intellectual property in
detail. Providing illustrations and real life case scenarios at regular intervals, he was able to equip the
participants with the basic knowledge on Intellectual Property and a basic ability to identify and
differentiate various types of Intellectual Property. Kalyan’s session provided a strong fundamental
foundation over which the participants could build advanced knowledge and skill set on IP.
Mr. Nishant Kewalramani, in his session on Patent Filing and prosecution strategy, provided strategic
inputs on patent filing and described various strategic considerations that one must consider in deciding
to apply for registration of a patent. Nishant provided both academic and business considerations and
explained how one must analyse these pointers having regard to the importance of the invention and its
worthiness to the institution. Nishant provided numerous real life examples to explain how it is
important to strategise patent filing. He then explained to the participants how one has to approach the
objections by the examiners during the prosecution of the patent application. He provided various
different situations where minor errors committed during the drafting and prosecution of a patent

application can result in rejection of the application. He also explained the importance of prosecution
history in determining the scope of a patent.
Nishant took up the Patent Searching Techniques in his next session and provided a detailed procedure
for making a patent search using free databases available around the world. He also conducted a live
search to help participants to understand the nuances of patent search. He provided various techniques
of bettering the search results and also analysing the same.
Next two sessions were addressed by Mr. Sandeep Hegde M. Sandeep started with the basics on
copyright law and went on to explain the nuances of various aspects of copyright such as rights granted
under copyright regime, protection of copyrights through registrations and due diligence, taking
measures towards mitigating risks from third party copyrights and enforcement of copyrights. He also
explained various tests devised by the courts in determining infringement of copyrights and provided
ample examples to demonstrate the same. He them spoke about trade secrets. He explained the
necessary attributes of trade secrets with the help of examples and explained how misappropriation of
trade secrets is ascertained. He helped the participants to analyse various hypothetical scenarios on
trade secret misappropriation. He also provided various important factors to be considered for
determining the best form of protection between patents and trade secrets when an inventor comes up
with an invention.
Dr. Kalyan addressed the first session on the second day of the program with his presentation on patent
specification drafting and patent claim constructions. Dr. Kalyan used a number of examples from
patent applications on plastic technology and plastic polymer science. The participants could easily
relate to the examples and responded to the same with enthusiasm. Dr. Kalyan also analysed some of
the patent claims from the applications of CIPET filed in the past. Dr. Kalyan’s session helped the
participants to understand how a claim in a patent application is construed and how they could improve
the strength of their patents by intelligently drafting their claims.
Sandeep in his next session explained IP licensing and IP commercialisation by research institutions like
CIPET. He provided a birds overview of how research institutions from the developed nations look at
licensing. He then explained various common clauses in a license agreement and how one could use
negotiation as a tool to ensure better returns from the transaction. This session was aimed at equipping
the participants with skills of license negotiation.
The final session was a role play on licensing. The participants were divided into different groups of two
teams each and were given a hypothetical licensing problem. The participants were asked to assume

roles of negotiators representing a party in the problem and negotiate a mutually agreeable license deal
with the opponent team. After the conclusion of the negotiation, the results of each team were
analysed by the resource persons and the participants were provided further hints on how they can
negotiate a better deal. The resource persons also explained how real life licensing negotiations are
conducted and various factors that a negotiator has to consider.
Feedback of participants
The program received positive feedback from the participants. Most participants participated in the
discussions during the course of the program and posed a lot of questions and sought clarification. The
participants found the sessions extremely useful and enriching. The feedback forms filled up by the
