Two day <str<strong>on</strong>g>Training</str<strong>on</strong>g> <strong>on</strong> Intellectual Property Rights <strong>for</strong> Research<br />

Instituti<strong>on</strong>- <strong>CIPET</strong>, Bhubaneswar<br />

Background<br />

2013<br />

As part of <strong>UNIDO</strong>’s program <strong>on</strong> building awareness and knowledge am<strong>on</strong>g the educati<strong>on</strong>al and industrial<br />

instituti<strong>on</strong>s that are working in the field of research and development <strong>on</strong> Intellectual Property Rights, a<br />

two day training program <strong>on</strong> ‘Intellectual Property’ was organised at Central Institute of Plastic<br />

Engineering and Technology (<strong>CIPET</strong>), at Bhubaneswar, Orissa <strong>on</strong> 7 th and 8 th June 2013. Experts from<br />

Brain League visited <strong>CIPET</strong> to deliver lectures <strong>on</strong> specified topics <strong>on</strong> various aspects <strong>on</strong> intellectual<br />

property to a group of around thirty participants comprising of members of the faculty and students of<br />

doctoral program at the institute.<br />

Objectives<br />

Multifold objectives of the training program included providing basic awareness <strong>on</strong> Intellectual Property<br />

to the participants; developing certain basic skills in Intellectual Property am<strong>on</strong>g participants; helping<br />

the participants to understand the basic nuances of Intellectual Property Law and to identify various<br />

types of Intellectual Property dealt with by them during the course of their research; equip the<br />

participants with basic skills to safeguard their valuable IP. As a partner organisati<strong>on</strong> in the Plastic<br />

Project <strong>CIPET</strong>’s c<strong>on</strong>tributi<strong>on</strong> towards venue and other logistical arrangements <strong>for</strong> the programme are<br />

also appreciated.<br />

Agenda <strong>for</strong> <str<strong>on</strong>g>Training</str<strong>on</strong>g><br />

The participants at <strong>CIPET</strong> mostly comprised of researchers at the institute and hence required an<br />

advanced training in Intellectual Property to help them protect the inventi<strong>on</strong>s and scholarly c<strong>on</strong>tent<br />

they may create during their research. The training program was divided into various sessi<strong>on</strong>s <strong>on</strong><br />

<strong>UNIDO</strong> <strong>ICAMT</strong>

specific topics of IP relevant to the institute. After discussing with the stakeholders of the institute,<br />

following topics were identified to be relevant to the participants:<br />

1. Fundamentals of Intellectual Property- A primer <strong>on</strong> various types of intellectual property in<br />

today’s research envir<strong>on</strong>ment;<br />

2. Patent Search and Patent Filing and Prosecuti<strong>on</strong> Strategies- A detailed procedure <strong>for</strong> c<strong>on</strong>ducting<br />

patent search and the process of patent registrati<strong>on</strong><br />

3. Protecting Creative Expressi<strong>on</strong> through Copyrights- Basics of Copyright Law<br />

4. Trade Secrets- Protecting valuable in<strong>for</strong>mati<strong>on</strong> through trade secrets<br />

5. Patent claim c<strong>on</strong>structi<strong>on</strong>s and patent specificati<strong>on</strong> drafting techniques <strong>for</strong> research<br />

6. Research Collaborati<strong>on</strong>s, C<strong>on</strong>tracting and Licensing IP from research instituti<strong>on</strong>s<br />

7. Role Play <strong>on</strong> IP licensing negotiati<strong>on</strong>s<br />

The resource pers<strong>on</strong>s <strong>for</strong> the program included Dr. Kalyan kankanala, Mr. Nishant Kewalramani and Mr.<br />

Sandeep Hegde M.<br />

Course of the Program<br />

The program started with the <strong>for</strong>mal inaugurati<strong>on</strong> by Dr. Yadav.<br />

Dr. Kalyan C. Kankanala in his first sessi<strong>on</strong> <strong>on</strong> Fundamentals of Intellectual Property, gave a lucid<br />

overview of the meaning, nature and scope of intellectual property. He clarified the objective behind the<br />

legislati<strong>on</strong>s governing intellectual property and explained the rati<strong>on</strong>ale behind the grant of property<br />

rights <strong>on</strong> creati<strong>on</strong>s of human intellect. He then proceeded to explain each type of intellectual property in<br />

detail. Providing illustrati<strong>on</strong>s and real life case scenarios at regular intervals, he was able to equip the<br />

participants with the basic knowledge <strong>on</strong> Intellectual Property and a basic ability to identify and<br />

differentiate various types of Intellectual Property. Kalyan’s sessi<strong>on</strong> provided a str<strong>on</strong>g fundamental<br />

foundati<strong>on</strong> over which the participants could build advanced knowledge and skill set <strong>on</strong> IP.<br />

Mr. Nishant Kewalramani, in his sessi<strong>on</strong> <strong>on</strong> Patent Filing and prosecuti<strong>on</strong> strategy, provided strategic<br />

inputs <strong>on</strong> patent filing and described various strategic c<strong>on</strong>siderati<strong>on</strong>s that <strong>on</strong>e must c<strong>on</strong>sider in deciding<br />

to apply <strong>for</strong> registrati<strong>on</strong> of a patent. Nishant provided both academic and business c<strong>on</strong>siderati<strong>on</strong>s and<br />

explained how <strong>on</strong>e must analyse these pointers having regard to the importance of the inventi<strong>on</strong> and its<br />

worthiness to the instituti<strong>on</strong>. Nishant provided numerous real life examples to explain how it is<br />

important to strategise patent filing. He then explained to the participants how <strong>on</strong>e has to approach the<br />

objecti<strong>on</strong>s by the examiners during the prosecuti<strong>on</strong> of the patent applicati<strong>on</strong>. He provided various<br />

different situati<strong>on</strong>s where minor errors committed during the drafting and prosecuti<strong>on</strong> of a patent<br />

applicati<strong>on</strong> can result in rejecti<strong>on</strong> of the applicati<strong>on</strong>. He also explained the importance of prosecuti<strong>on</strong><br />

history in determining the scope of a patent.<br />

Nishant took up the Patent Searching Techniques in his next sessi<strong>on</strong> and provided a detailed procedure<br />

<strong>for</strong> making a patent search using free databases available around the world. He also c<strong>on</strong>ducted a live<br />

search to help participants to understand the nuances of patent search. He provided various techniques<br />

of bettering the search results and also analysing the same.<br />

Next two sessi<strong>on</strong>s were addressed by Mr. Sandeep Hegde M. Sandeep started with the basics <strong>on</strong><br />

copyright law and went <strong>on</strong> to explain the nuances of various aspects of copyright such as rights granted<br />

under copyright regime, protecti<strong>on</strong> of copyrights through registrati<strong>on</strong>s and due diligence, taking<br />

measures towards mitigating risks from third party copyrights and en<strong>for</strong>cement of copyrights. He also<br />

explained various tests devised by the courts in determining infringement of copyrights and provided<br />

ample examples to dem<strong>on</strong>strate the same. He them spoke about trade secrets. He explained the<br />

necessary attributes of trade secrets with the help of examples and explained how misappropriati<strong>on</strong> of<br />

trade secrets is ascertained. He helped the participants to analyse various hypothetical scenarios <strong>on</strong><br />

trade secret misappropriati<strong>on</strong>. He also provided various important factors to be c<strong>on</strong>sidered <strong>for</strong><br />

determining the best <strong>for</strong>m of protecti<strong>on</strong> between patents and trade secrets when an inventor comes up<br />

with an inventi<strong>on</strong>.<br />

Dr. Kalyan addressed the first sessi<strong>on</strong> <strong>on</strong> the sec<strong>on</strong>d day of the program with his presentati<strong>on</strong> <strong>on</strong> patent<br />

specificati<strong>on</strong> drafting and patent claim c<strong>on</strong>structi<strong>on</strong>s. Dr. Kalyan used a number of examples from<br />

patent applicati<strong>on</strong>s <strong>on</strong> plastic technology and plastic polymer science. The participants could easily<br />

relate to the examples and resp<strong>on</strong>ded to the same with enthusiasm. Dr. Kalyan also analysed some of<br />

the patent claims from the applicati<strong>on</strong>s of <strong>CIPET</strong> filed in the past. Dr. Kalyan’s sessi<strong>on</strong> helped the<br />

participants to understand how a claim in a patent applicati<strong>on</strong> is c<strong>on</strong>strued and how they could improve<br />

the strength of their patents by intelligently drafting their claims.<br />

Sandeep in his next sessi<strong>on</strong> explained IP licensing and IP commercialisati<strong>on</strong> by research instituti<strong>on</strong>s like<br />

<strong>CIPET</strong>. He provided a birds overview of how research instituti<strong>on</strong>s from the developed nati<strong>on</strong>s look at<br />

licensing. He then explained various comm<strong>on</strong> clauses in a license agreement and how <strong>on</strong>e could use<br />

negotiati<strong>on</strong> as a tool to ensure better returns from the transacti<strong>on</strong>. This sessi<strong>on</strong> was aimed at equipping<br />

the participants with skills of license negotiati<strong>on</strong>.<br />

The final sessi<strong>on</strong> was a role play <strong>on</strong> licensing. The participants were divided into different groups of two<br />

teams each and were given a hypothetical licensing problem. The participants were asked to assume<br />

roles of negotiators representing a party in the problem and negotiate a mutually agreeable license deal<br />

with the opp<strong>on</strong>ent team. After the c<strong>on</strong>clusi<strong>on</strong> of the negotiati<strong>on</strong>, the results of each team were<br />

analysed by the resource pers<strong>on</strong>s and the participants were provided further hints <strong>on</strong> how they can<br />

negotiate a better deal. The resource pers<strong>on</strong>s also explained how real life licensing negotiati<strong>on</strong>s are<br />

c<strong>on</strong>ducted and various factors that a negotiator has to c<strong>on</strong>sider.<br />

Feedback of participants<br />

The program received positive feedback from the participants. Most participants participated in the<br />

discussi<strong>on</strong>s during the course of the program and posed a lot of questi<strong>on</strong>s and sought clarificati<strong>on</strong>. The<br />

participants found the sessi<strong>on</strong>s extremely useful and enriching. The feedback <strong>for</strong>ms filled up by the<br />
