changed the formula used <strong>to</strong> calculate the premium paid by the hedge fund purchasing the<br />

Finally, in response <strong>to</strong> RenTec’s concerns, Deutsche Bank <strong>and</strong> RenTec negotiated new<br />

liquidation terms under which, if an option were terminated by the bank without cause <strong>and</strong> if<br />

RenTec determined the liquidation could harm its other holdings, then RenTec had the right <strong>to</strong><br />

decide whether it wanted <strong>to</strong> control the liquidation of the account. 275<br />

The following chart provides a simplified diagram demonstrating how the restructured<br />

MAPS basket options were intended <strong>to</strong> work.<br />

In designing the restructured MAPS option, Deutsche Bank negotiated with RenTec<br />

about a number of the terms. Deutsche Bank also initiated negotiations with George Weiss about<br />

switching <strong>to</strong> the revised MAPS structure. Ultimately, however, Deutsche Bank did not enter in<strong>to</strong><br />

any new MAPS transactions with George Weiss. 276 According <strong>to</strong> the George Weiss Associates<br />

COO, Federick Doucette, George Weiss viewed the new structure as a sign that Deutsche Bank<br />
