The Development Officer may:<br />

a) Issue a development permit where the development <strong>of</strong> land, buildings or<br />

structures conforms to the adopted Development Plan, and to the<br />

requirements <strong>of</strong> this By-law and amendments thereto.<br />

b) Receive and process applications for amendments to this by-law, conditional<br />

use orders and variation orders.<br />

c) Enter any buildings or premises at all reasonable hours in the performance <strong>of</strong><br />

his duties with respect to this By-law;<br />

d) Issue development permits for the temporary use <strong>of</strong> buildings, structures or<br />

land pursuant to the provisions <strong>of</strong> this By-law; and<br />

e) Issue zoning memoranda or such other documents necessary for the<br />

administration and enforcement <strong>of</strong> this By-law.<br />

f) Allow or refuse such minor variations to the requirements <strong>of</strong> this By-law as<br />

authorized by and in accordance with the provisions <strong>of</strong> the Act.<br />

(3) Approval <strong>of</strong> Permits<br />

At the request <strong>of</strong> Council the Development Officer shall withhold approving or reject<br />

an application for a development permit:<br />

a) as provided for in the Act;<br />

b) which would result in a violation <strong>of</strong> this By-law or any other By-law or the<br />

<strong>Town</strong> <strong>of</strong> <strong>Virden</strong> or the Planning District; or<br />

c) for any person who has failed to pay any fees due and owing to the <strong>Town</strong> <strong>of</strong><br />

<strong>Virden</strong> or the Planning District under this or any other By-law.<br />

5. DEVELOPMENT PERMIT<br />

(1) No person shall construct, erect, enlarge locate, relocate, repair, use or occupy any<br />

land, building or structure contrary to any development permit.<br />

(2) Subject to subsection (3) here<strong>of</strong>, a development permit is required for the following:<br />
