21<br />

(1) This By-law is based upon the division <strong>of</strong> the <strong>Town</strong> into zones where the use <strong>of</strong> land,<br />

buildings and structures is substantially compatible. There are, however, certain<br />

uses, designated Conditional Uses, which cannot properly be permitted in any zone<br />

without consideration, in each case, <strong>of</strong> the impact <strong>of</strong> those uses upon neighbouring<br />

land.<br />

(2) An application for a conditional use may be initiated by an owner <strong>of</strong> land who<br />

proposes to establish a use which is classified as a conditional use under the<br />

provisions <strong>of</strong> this By-law.<br />

(3) An application for a conditional use shall be made in a prescribed form to the<br />

Development Officer, and shall be accompanied by such information that may be<br />

required by the Development Officer. An application is not considered to be in a<br />

complete form unless it is accompanied by the application fee.<br />

(4) Conditional use applications shall be processed in accordance with the provisions <strong>of</strong><br />

The Planning Act.<br />

(5) Council may approve or reject any application for a conditional use. Any approval<br />

may be subject to such terms and conditions as Council deems appropriate in<br />

accordance with The Planning Act.<br />

(6) Any change in the circumstances <strong>of</strong> a conditional use shall be subject to the<br />

provisions <strong>of</strong> this section and the appropriate provisions <strong>of</strong> The Planning Act.<br />

(7) Existing Conditional Uses are treated as follows:<br />

a) Where a use is classified as a Conditional Use under this By-law or<br />

amendments thereto, and exists as a legal use at the date <strong>of</strong> the adoption <strong>of</strong><br />

this By-law or its amendments, it shall be considered as a legally existing<br />

Conditional Use.<br />

b) Any change to a Conditional Use shall be subject to the provisions <strong>of</strong> this<br />

Section and the appropriate provisions <strong>of</strong> the Act.<br />

(8) A conditional use order shall expire and cease to have any effect if it is not acted<br />

upon within 12 months <strong>of</strong> the date <strong>of</strong> approval by Council, unless it is renewed, prior<br />

to the expiry date, at the discretion <strong>of</strong> Council for an additional period not exceeding<br />

12 months.<br />
