THE BAHAMAS<br />

On July 10, 1973, The Baham<strong>as</strong> became an<br />

<strong>in</strong>dependent state. In a note dated July 10, 1973, to<br />

the Secretary-General <strong>of</strong> the United Nations, the<br />

Prime M<strong>in</strong>ister made a statement read<strong>in</strong>g <strong>in</strong> part <strong>as</strong><br />

follows:<br />

I have the honour, further to <strong>in</strong>form you that the<br />

Government <strong>of</strong> the Commonwealth <strong>of</strong> The Baham<strong>as</strong>,<br />

conscious <strong>of</strong> the desirability <strong>of</strong> ma<strong>in</strong>ta<strong>in</strong><strong>in</strong>g exist<strong>in</strong>g<br />

legal relationships, <strong>and</strong> conscious <strong>of</strong> its obligations<br />

under <strong>in</strong>ternational law to honour its treaty commitments,<br />

acknowledges that many treaty rights <strong>and</strong> obligations<br />

<strong>of</strong> the Government <strong>of</strong> the United K<strong>in</strong>gdom <strong>in</strong><br />

respect <strong>of</strong> The Baham<strong>as</strong> were succeeded to by the<br />

Commonwealth <strong>of</strong> The Baham<strong>as</strong> upon Independence<br />

by virtue <strong>of</strong> customary <strong>in</strong>ternational law.<br />

S<strong>in</strong>ce, however, it is likely that <strong>in</strong> virtue <strong>of</strong> customary<br />

<strong>in</strong>ternational law certa<strong>in</strong> treaties may have lapsed at<br />

the date <strong>of</strong> Independence <strong>of</strong> the Commonwealth <strong>of</strong> The<br />

Baham<strong>as</strong>, it seems essential that each treaty should be<br />

subjected to legal exam<strong>in</strong>ation. It is proposed, after this<br />

exam<strong>in</strong>ation h<strong>as</strong> been completed, to <strong>in</strong>dicate which, if<br />

any, <strong>of</strong> the treaties which may have lapsed by<br />

customary <strong>in</strong>ternational law the Government <strong>of</strong> the<br />

Commonwealth <strong>of</strong> The Baham<strong>as</strong> wishes to treat <strong>as</strong><br />

hav<strong>in</strong>g lapsed.<br />

It is desired that it be presumed that each treaty h<strong>as</strong><br />

been legally succeeded to by the Commonwealth <strong>of</strong><br />

The Baham<strong>as</strong> <strong>and</strong> that action be b<strong>as</strong>ed on this presump-
