ZIMBABWE<br />

On April 18, 1980, Zimbabwe became an <strong>in</strong>dependent<br />

state. In a note dated February 24, 1981, to<br />

the Secretary General <strong>of</strong> the United Nations, the<br />

Prime M<strong>in</strong>ister made a statement read<strong>in</strong>g <strong>in</strong> part <strong>as</strong><br />

follows:<br />

My Government will cont<strong>in</strong>ue to apply with<strong>in</strong> its<br />

territory, on the b<strong>as</strong>is <strong>of</strong> the pr<strong>in</strong>ciples <strong>of</strong> reciprocity<br />

<strong>and</strong> mutual respect for sovereign <strong>in</strong>dependence, all bilateral<br />

treaties validly concluded or recognised by the<br />

United K<strong>in</strong>gdom Government <strong>in</strong> respect <strong>of</strong> Southern<br />

Rhodesia for a period <strong>of</strong> three years from the date <strong>of</strong><br />

<strong>in</strong>dependence, i.e. 18th April, 1980, unless such treaties<br />

are term<strong>in</strong>ated or modified earlier by mutual consent. It<br />

is the <strong>in</strong>tention <strong>of</strong> my Government dur<strong>in</strong>g such period<br />

to subject all bilateral treaties to full exam<strong>in</strong>ation for<br />

the purpose <strong>of</strong> determ<strong>in</strong><strong>in</strong>g whether such treaties require<br />

term<strong>in</strong>ation, revision or renegotiation <strong>in</strong> the light<br />

<strong>of</strong> Zimbabwe’s sovereign status. It is the earnest hope<br />

<strong>of</strong> my Government that dur<strong>in</strong>g the aforementioned period<br />

the normal processes <strong>of</strong> diplomatic negotiation will<br />

enable it to reach satisfactory accord with the States<br />

concerned upon the possibility <strong>of</strong> the cont<strong>in</strong>uance,<br />

modification or term<strong>in</strong>ation <strong>of</strong> such treaties.<br />

At the end <strong>of</strong> the three year period referred to<br />

above my Government will regard such treaties whose<br />

cont<strong>in</strong>uance or modification have not been agreed <strong>as</strong><br />

hav<strong>in</strong>g term<strong>in</strong>ated.<br />

As regards multilateral treaties validly concluded<br />

or recognised by the United K<strong>in</strong>gdom Government <strong>in</strong><br />

respect <strong>of</strong> Southern Rhodesia, my Government proposes<br />

to review at le<strong>as</strong>t some <strong>of</strong> those treaties dur<strong>in</strong>g a<br />

period <strong>of</strong> six years from the date <strong>of</strong> <strong>in</strong>dependence, i.e.<br />

18th April, 1980. It will <strong>in</strong>dicate to the depositaries <strong>in</strong><br />

each c<strong>as</strong>e <strong>of</strong> review whether the Republic <strong>of</strong> Zimbabwe<br />

will confirm, seek to modify or term<strong>in</strong>ate its obligations<br />

under the treaty concerned. Dur<strong>in</strong>g such period <strong>of</strong><br />

review any party to a multilateral treaty which w<strong>as</strong> validly<br />

applied or extended to Southern Rhodesia may, on<br />

the b<strong>as</strong>is <strong>of</strong> reciprocity <strong>and</strong> respect for national <strong>in</strong>dependence,<br />

rely on the terms <strong>of</strong> such treaty until it is<br />

modified or term<strong>in</strong>ated. At the expiration <strong>of</strong> the period<br />

<strong>of</strong> review treaties <strong>as</strong> modified, or which have not been<br />

term<strong>in</strong>ated, shall cont<strong>in</strong>ue fully <strong>in</strong> force <strong>as</strong> if they had<br />

been concluded by the Republic <strong>of</strong> Zimbabwe.<br />

By note <strong>of</strong> April 14, 1983, to the Secretary-<br />

General <strong>of</strong> the United Nations, the Government <strong>of</strong><br />

Zimbabwe extended the period <strong>of</strong> review <strong>of</strong> bilateral<br />

treaties to April 18, 1984. This period <strong>of</strong> review<br />

w<strong>as</strong> further extended by a note dated April 11,<br />

1984, <strong>in</strong> which the Prime M<strong>in</strong>ister notified the<br />

Secretary-General that “… my Government will<br />

cont<strong>in</strong>ue to apply with<strong>in</strong> its territory all such<br />

bilateral treaties until the 18th April 1985, unless<br />

term<strong>in</strong>ated earlier or modified by mutual consent.<br />

Thereafter my Government will regard those<br />

treaties whose cont<strong>in</strong>uance or modification h<strong>as</strong> not<br />

been agreed upon <strong>as</strong> hav<strong>in</strong>g term<strong>in</strong>ated.”<br />

In a further letter to the Secretary-General,<br />

received February 20, 1985, the Prime M<strong>in</strong>ister<br />

stated <strong>in</strong> part:<br />

Dur<strong>in</strong>g the p<strong>as</strong>t four years my Government h<strong>as</strong> reviewed<br />

all such bilateral treaties <strong>as</strong> were available to it<br />

or were brought to its attention <strong>and</strong> h<strong>as</strong> also concluded<br />

a number <strong>of</strong> bilateral treaties with other governments<br />

with the effect that these <strong>in</strong>struments have superseded<br />

some <strong>of</strong> the earlier ones. It h<strong>as</strong> become evident to my<br />

Government that many contract<strong>in</strong>g parties prefer to<br />

enter <strong>in</strong>to new arrangements with my Government<br />

rather than revive those treaties whose operations might<br />

have been suspended or term<strong>in</strong>ated between 1965 <strong>and</strong><br />

1979 or which are now considered to be obsolete <strong>in</strong> the<br />

conduct <strong>of</strong> present-day <strong>in</strong>ternational relations.<br />

Whilst it h<strong>as</strong> not been practicable for my Government<br />

to re-negotiate <strong>and</strong> f<strong>in</strong>alise all such agreements on<br />

which a will<strong>in</strong>gness to keep <strong>and</strong> ma<strong>in</strong>ta<strong>in</strong> them <strong>in</strong> force<br />

w<strong>as</strong> mutually <strong>in</strong>dicated by my Government <strong>and</strong> other<br />

contract<strong>in</strong>g parties, my Government h<strong>as</strong> reached the<br />

stage at which it considers that legal cont<strong>in</strong>uity between<br />

itself <strong>and</strong> <strong>Other</strong> Contract<strong>in</strong>g States h<strong>as</strong> been achieved<br />

with an underst<strong>and</strong><strong>in</strong>g either to revive, modify, re-
