本 科 的 法 律 輔 助 團 隊 由 六 名 法 律 翻 譯 主 任 、25 名 律 政 書
記 及 54 名 支 援 人 員 所 組 成 。
法 律 翻 譯 主 任
法 庭 雙 語 文 件 小 組 , 由 高 級 法 律 翻 譯 主 任 邱 惠 玲 女 士 帶
領 屬 下 的 五 位 法 律 翻 譯 主 任 , 協 助 本 科 律 師 擬 備 涉 及 刑
事 法 律 程 序 的 雙 語 法 庭 文 件 。 他 們 負 責 處 理 法 庭 文 件
中 的 複 雜 語 文 問 題 , 並 常 常 需 要 在 短 時 間 內 完 成 翻 釋 工
作 。2 011 年 , 法 律 翻 譯 主 任 為 本 科 翻 釋 了 共 4, 8 25 頁 的 中
譯 本 和 1,136 頁 的 英 譯 本 , 處 理 的 法 庭 文 件 繁 多 , 包 括 公 訴

Administration Unit
The Administration Unit provides administrative and logistical
support to the Division. The Unit, headed by Ms Phyllis Leung,
Chief Executive Officer (Prosecutions Division), assisted the
DPP in managing financial and human resources, handling a
staff of over 460 people and a divisional budget of over $130
million. Part of its management role was to ensure that public
monies were wisely spent and resources efficiently deployed.
The Division’s greatest expense was in respect of the
engagement of private lawyers to prosecute on its behalf.
In 2011, it spent $71.5 million to pay for the services of
private lawyers and independent experts such as forensic
accountants. The Unit also processed 66 requests for funds to
engage outside professionals on non-standard terms, often at
short notice.
2011 was a busy year for the Unit. On top of its heavy
schedule, the Unit implemented a series of mandatory
records management requirements. These included adopting
a standard classification scheme for all administrative records.
Using existing resources, the Unit revised the plan for office
accommodation and support services to meet the additional
requirements posed by the creation of the seven DL1 posts.
The Unit organized numerous visits inside and outside
the Division. In 2011, it processed 14 visits to the Division
and arranged for prosecutors to participate in 18 overseas
conferences or case-related duty trips. The Unit also oversaw
the work of the complaints registry. It maintained a register
which recorded over 600 verbal and written enquiries from
the public in relation to criminal prosecution matters. Among
other administrative tasks, the Unit helped acquire office
accommodation and equipment and provided secretarial
services for major meetings.
Paralegal and Administrative Support Staff
Paralegal staff supplied prosecutors with the legal,
administrative and clerical services essential to the professional
discharge of their duties. In 2011, the paralegal team of the
Division comprised six law translation officers (LTOs), 25 law
clerks and 54 support staff.
Law Translation Officers
In the Bilingual Court Documents Unit, Ms Janet Yau,
Senior Law Translation Officer and her five LTOs assisted
counsel in preparing bilingual court documents for criminal
proceedings. Grappling with the language complexities of
court documents and racing against time to beat deadlines
are matters of routine for this team. In 2011, the LTOs
produced 4,825 translated pages from English to Chinese
and 1,136 translated pages from Chinese to English. The
court documents they handled included indictments, charge
sheets, consents to prosecution, immunities from prosecution,
summaries of facts, legal submissions and judgments. Some of

協 助 刑 事 檢 控 專 員 辦 公 室 的 律 師 執 行 與 律 政 書 記 和 支 援
人 員 有 關 的 管 理 和 行 政 職 務 。 刑 事 檢 控 總 務 室 分 設 下 列
七 個 組 別 :
上 訴 事 務 小 組 — 該 小 組 協 助 處 理 由 檢 控 產 生 或 引 致 的

Law Clerks
these were couched in difficult legal jargon requiring delicate
translation skills. To enhance bilingualism in the courtroom,
the LTOs translated headnotes and some important case
digests for the Criminal Appeals Bulletin. The LTOs also
electronically maintained and periodically updated some
bilingual references such as specimen charges and judgment
extracts for use by prosecutors. In addition, one LTO regularly
conducted workshops and seminars on the use of Chinese for
counsel and paralegals to enhance their effectiveness in court.
Law Clerks
Law clerks provided legal support across the board. They
drafted legal documents, assessed costs claims, compiled
case bundles, briefed fiat counsel, vetted legal documents,
arranged hearing dates and conducted fixed penalty
proceedings. They operated within the Prosecution Registry
and the Briefing Out and Court Duties Section.
Prosecution Registry
The Prosecution Registry was headed by Ms Teresa Tang,
Senior Law Clerk I, who assisted counsel in the ODPP in
their management and discharge of administrative duties
in relation to law clerks and support staff. The Prosecution
Registry comprised the following seven units:
Appeals Unit — This unit assisted counsel on appeals
generated by or arising from prosecutions. In 2011, the unit
provided support services to counsel in respect of over 1,600
appeals and over 700 High Court bail applications.
Bilingual Court Documents Unit — This unit provided
bilingual translations of court documents for the Division.
Law Clerks and general supporting staff helped LTOs in
providing translation and vetting services to prosecutors in
the conduct of proceedings.
Court of First Instance Unit — This unit supported counsel
in the Court of First Instance Advisory Section in preparing
cases for committal to the Court of First Instance and
handling Court of First Instance cases for trial by jury. The
unit handled over 400 committals and Court of First Instance
cases in 2011.
Commercial Crime and Corruption Unit — This unit
helped counsel in Sub-division IV prepare and conduct cases
submitted mainly by the Commercial Crime Bureau, the ICAC,

準 外 判 案 件 機 制 的 日 常 運 作 。 小 組 編 製 和 更 新 外 判 律 師
名 單 、 處 理 列 入 外 判 律 師 名 單 的 申 請 、 擬 備
外 判 律 師 的 委 聘 書 和 核 對 收 費 單 。 此 外 , 小
組 亦 負 責 擬 備 外 判 工 作 的 統 計 數 字 , 並 協
助 刑 事 檢 控 科 遴 選 委 員 會 履 行 職 責 。 小 組

the Customs and Excise Department and the
Securities and Futures Commission. It also
processed domestic asset recovery cases.
District Court Unit — This unit provided
assistance to counsel of the District Court
Advisory Section in the preparation of legal
documents for transferring cases from the Magistrates’ Courts
to the District Court and in the preparation of District Court
cases for trial. In 2011, the unit processed over 1,200 transfer
applications to the District Court and provided support
services to prosecutors in over 500 District Court trials.
Management Section and Magistracy Unit — This unit
assisted the ODPP in managing the Division and allocating
cases. It provided support to counsel in conducting magistracy
trials and death inquests. It also provided support for the FAST
advisory system. In 2011, the unit handled over 2,300 FAST
legal advices.
Receipt and Despatch Unit — This unit ensured that files and
correspondences were efficiently and securely delivered and
processed. It vetted and classified incoming cases and ensured
timely return of completed advices to law enforcement agencies.
Briefing Out and Court Duties Section
This Section was headed by Ms Jenny Kwan, Senior Law Clerk
I and comprised the following three units:
Briefing Out and Work Management Unit — This unit
handled the daily operation of the briefing out system for
both standard briefs and non-standard briefs. It maintained
lists of fiat counsel, processed applications for inclusion
on the Briefing-out Lists, prepared briefs for counsel and
checked fee notes. It also compiled statistics for briefing out
work and assisted in the work of the Prosecutions Division
Selection Board. The unit faced a great challenge last year by
providing support to enhance the initiatives on performance
management and training to fiat counsel.
Costs Unit — This unit assisted prosecutors to process costs
claims in criminal cases at all levels of court. Its members
assisted in the assessment of bills of costs in all types of
criminal cases, attended call-over hearings, assisted in taxation
hearings, prepared notices of objections and liaised with
solicitors, litigants and law costs draftsmen for settlement. It
was also responsible for drafting bills of costs for cases where
costs were awarded to the prosecution. In 2011, the unit
handled over 500 costs claims.
Fixed Penalty Unit — This unit dealt with fixed penalty cases
concerning parking contraventions under the Fixed Penalty
(Traffic Contraventions) Ordinance, Cap 237 referred by the
Judiciary and the Central Traffic Prosecutions Division of the
Police. The Law Clerks conducted fixed penalty proceedings in
magistracies. They signed and made applications for distress
warrants and court orders, gave instructions to the Police
and Court Prosecutors for appropriate actions, and handled
queries or complaints arising from fixed penalty cases. In 2011,
the unit handled over 7,000 cases.
