Explanatory memorandum<br />
C<strong>on</strong>sidering that:<br />
1) the ICT Authority has as functi<strong>on</strong> under secti<strong>on</strong> 18(1)(b)<strong>of</strong> the ICT Act 2001 “to provide<br />
ec<strong>on</strong>omic and technical m<strong>on</strong>itoring <strong>of</strong> the informati<strong>on</strong> and communicati<strong>on</strong> industry in<br />
accordance with recognised internati<strong>on</strong>al standard practices, protocols and having regard<br />
to the c<strong>on</strong>vergence <strong>of</strong> technology”;<br />
2) the ICT Authority has as functi<strong>on</strong> under secti<strong>on</strong> 18(1) (f) <strong>of</strong> the ICT Act 2001 “to establish,<br />
for public operators, performance standards and linkage standards in relati<strong>on</strong> to the<br />
provisi<strong>on</strong> <strong>of</strong> internati<strong>on</strong>al and local teleph<strong>on</strong>e services, and m<strong>on</strong>itor compliance with both<br />
<strong>of</strong> those standards” and “to report, in such manner as may be required, to the Minister or to<br />
any other pers<strong>on</strong> <strong>on</strong> any matter that lies within its purview, such as the performance <strong>of</strong><br />
public operators, the quality <strong>of</strong> c<strong>on</strong>sumer service and c<strong>on</strong>sumer satisfacti<strong>on</strong>, measured<br />
against the best available internati<strong>on</strong>al standards <strong>of</strong> practice”.<br />
3) the ICT Authority has as functi<strong>on</strong> under secti<strong>on</strong> 18(1) (n) <strong>of</strong> the ICT Act 2001 “to ensure<br />
the safety and quality <strong>of</strong> every informati<strong>on</strong> and communicati<strong>on</strong> services including<br />
telecornmunicati<strong>on</strong> services, and for that purpose, determine technical standards for<br />
telecommunicati<strong>on</strong> network, the c<strong>on</strong>necti<strong>on</strong> <strong>of</strong> customer equipment to telecommunicati<strong>on</strong><br />
networks”;<br />
4) standards bodies such as the Internati<strong>on</strong>al Telecommunicati<strong>on</strong> Uni<strong>on</strong> (ITU) and the<br />
European Telecommunicati<strong>on</strong>s Standards Institute (ETSI) have issued pertinent<br />
recommendati<strong>on</strong>s, directives and guides <strong>on</strong> <strong>Quality</strong> <strong>of</strong> <strong>Service</strong> (<strong>QoS</strong>);<br />
5) regulators around the world have set out regulati<strong>on</strong>s/directives <strong>on</strong> <strong>QoS</strong> with a view to<br />
m<strong>on</strong>itoring and improving quality and assisting c<strong>on</strong>sumers in making informed choices <strong>on</strong><br />
service providers;<br />
6) there is need for the ICT Authority, in pursuance <strong>of</strong> its statutory objectives and in line with<br />
internati<strong>on</strong>al best-practices, to define an appropriate framework for m<strong>on</strong>itoring the quality<br />
<strong>of</strong> the services <strong>of</strong>fered <strong>on</strong> the market;<br />
The Informati<strong>on</strong> and Communicati<strong>on</strong> Technologies Authority resolves to:<br />
1) make available for public c<strong>on</strong>sultati<strong>on</strong> the <str<strong>on</strong>g>C<strong>on</strong>sultati<strong>on</strong></str<strong>on</strong>g> Document Ref <strong>ICTA</strong>/2010/01;<br />
2) invite views, c<strong>on</strong>tributi<strong>on</strong>s, and comments <strong>on</strong> the <str<strong>on</strong>g>C<strong>on</strong>sultati<strong>on</strong></str<strong>on</strong>g> Document.<br />
