‘WAITING FOR THE HANGMAN’<br />

<br />

Remove all provisions in state legislation which provide for mandatory death sentences.<br />

<br />

Restrict <strong>the</strong> imposition of <strong>the</strong> death penalty to only <strong>the</strong> most serious crimes.<br />

Recommendations to <strong>the</strong> judiciary<br />

Enquire whe<strong>the</strong>r a confession has been made under pressure and ensure that<br />

any statement made as a result of torture or o<strong>the</strong>r ill-treatment is ruled inadmissible<br />

as evidence.<br />

Ensure that <strong>the</strong> prohibition on <strong>the</strong> imposition of <strong>the</strong> death penalty on anyone suffering<br />

from a mental disability and on juvenile offenders under <strong>the</strong> age of 18 181 is respected and<br />

no death sentences are passed.<br />

Ensure that all defendants are allowed to appeal, including those who were sentenced<br />

to death by tribunals under <strong>the</strong> military government.<br />

Recommendations to <strong>the</strong> Inspector General of <strong>the</strong> Police<br />

<br />

Publicly inform all police officers that torture is illegal.<br />

Ensure that all complaints of torture are promptly investigated and prosecuted, and<br />

that disciplinary measures are taken against all police officers who are alleged to have<br />

carried out torture. Every law enforcement officer under investigation should be suspended<br />

from active duty pending <strong>the</strong> outcome of <strong>the</strong> investigations.<br />

Recommendations to <strong>the</strong> international community, including governments and<br />

intergovernmental agencies<br />

Provide technical support to Nigerian state authorities to assist <strong>the</strong>m to review<br />

legislation which provides for <strong>the</strong> death penalty, with a view to abolishing <strong>the</strong><br />

death penalty.<br />

Provide technical support to improve <strong>the</strong> investigation procedures of <strong>the</strong> Nigeria<br />

Police Force.<br />
