That the Second Party, will conduct its inspection as a local representative of the First Party, in Bangladesh. 54 [2. Code Classification of imported goods and on any and all work to be undertaken by it for shipments to or from Bangladesh. 4. That the First Party shall ensure that all of its worldwide wholly-owned Offices, Subsidiaries, Joint Ventures, Affiliates and Agents will abide by the terms and conditions provided in law, rules and regulations for conducting Pre-shipment Inspection Services relating to Value, Quality, Quantity, Description and H.S. Code Classification of imported goods to be undertaken for customs purposes in accordance with the provisions of Pre-shipment Inspection Rules, 2002 of the Government of the People’s Republic of Bangladesh and all or any work done or undertaken for any other purposes. 5. That both parties agree that any violation or negligence on the above clauses shall be regarded as gross misconduct and shall be treated as breach of conduct. 6. That on such violation of terms and conditions as laid down above, and any genuine claim on such matters is received by either party for violation or negligence, shall be duly compensated by the party responsible for such misconduct or violation, or negligence of duty.
