4.2.3 Exceptions dependant on competency<br />

The exceptions <strong>to</strong> <strong>the</strong> hearsay rule depend on competency (s61).<br />

The exceptions <strong>to</strong> <strong>the</strong> hearsay rule do not allow <strong>the</strong> use of a previous<br />

representation (o<strong>the</strong>r than a contemporaneous representation) <strong>to</strong> prove<br />

<strong>the</strong> existence of an asserted fact if, when <strong>the</strong> representation was made,<br />

<strong>the</strong> person who made it was not competent <strong>to</strong> give evidence about that<br />

fact because of s13(1) (Competence – lack of capacity).<br />

Section 66A provides for contemporaneous representations and does not<br />

require <strong>the</strong> person who made <strong>the</strong> contemporaneous representation <strong>to</strong><br />

have been competent <strong>to</strong> give evidence at <strong>the</strong> time of making it.<br />
