• <strong>the</strong> representation was made by <strong>the</strong> person in fur<strong>the</strong>rance of a<br />
common purpose (whe<strong>the</strong>r lawful or not) that <strong>the</strong> person had with<br />
<strong>the</strong> party or one or more persons including <strong>the</strong> party (s87(1)).<br />
For <strong>the</strong> purposes of s87, <strong>the</strong> hearsay rule does not apply <strong>to</strong> a previous<br />
representation made by a person that tends <strong>to</strong> prove:<br />
• that <strong>the</strong> person had authority <strong>to</strong> make statements on behalf of<br />
ano<strong>the</strong>r person in relation <strong>to</strong> a matter or<br />
• that <strong>the</strong> person was an employee of ano<strong>the</strong>r person or had authority<br />
o<strong>the</strong>rwise <strong>to</strong> act for ano<strong>the</strong>r person or<br />
• <strong>the</strong> scope of <strong>the</strong> person’s employment or authority (s87(2)).<br />
