Section 108C provides an exception <strong>to</strong> <strong>the</strong> credibility rule <strong>to</strong> allow (with<br />
<strong>the</strong> court’s leave) opinion evidence <strong>to</strong> be led in chief on matters of<br />
credibility without <strong>the</strong> need <strong>to</strong> put matters <strong>to</strong> <strong>the</strong> witness.<br />
The section may be utilised in cases where it is not possible or appropriate<br />
<strong>to</strong> ask <strong>the</strong> witness <strong>to</strong> self-diagnose.<br />
Example<br />
Evidence of this kind may be led <strong>to</strong> explain <strong>the</strong> behaviour exhibited by<br />
complainants that might o<strong>the</strong>rwise be taken <strong>to</strong> adversely affect <strong>the</strong>ir<br />
credibility. Alternatively, opinion evidence may be led as <strong>to</strong> fac<strong>to</strong>rs<br />
affecting identification evidence.<br />
Specialist knowledge in relation <strong>to</strong> child development and child behaviour<br />
as well as children who have been <strong>the</strong> victims of sexual offences is<br />
specifically captured by s108C(2).<br />
In determining whe<strong>the</strong>r <strong>to</strong> grant leave under s108C, <strong>the</strong> court is <strong>to</strong> take<br />
in<strong>to</strong> account <strong>the</strong> matters set out in s192 which provides that leave,<br />
permission or direction given under <strong>the</strong> <strong>UEA</strong> may be conditional.<br />
