<strong>the</strong> <strong>UEA</strong> are uniform.<br />
The Explana<strong>to</strong>ry Memorandum <strong>to</strong> <strong>the</strong> Evidence Act 2008 states that <strong>the</strong><br />
Act is <strong>the</strong> first of two Acts introducing uniform evidence law in<strong>to</strong> Vic<strong>to</strong>ria.<br />
A second Act is required <strong>to</strong> amend <strong>the</strong> Vic<strong>to</strong>rian statute book<br />
consequential on <strong>the</strong> enactment of <strong>the</strong> Evidence Act 2008, for example, <strong>to</strong><br />
deal with sections currently in operation across <strong>the</strong> Vic<strong>to</strong>rian statute book<br />
that provide for subject matter now addressed in <strong>the</strong> Evidence Act 2008.<br />
The second Act is expected <strong>to</strong> also contain transitional provisions.<br />
1.3 Terminology<br />
In this publication, <strong>the</strong> Evidence Act 1995 (Cth), Evidence Act 1995 (NSW)<br />
and Evidence Act 2008 (Vic) are collectively referred as <strong>the</strong> <strong>UEA</strong>. If<br />
reference is made <strong>to</strong> a specific Act, it is referred <strong>to</strong> as <strong>the</strong> Commonwealth<br />
<strong>UEA</strong>, NSW <strong>UEA</strong> or Vic<strong>to</strong>rian <strong>UEA</strong>.<br />
