How the Police, with Justice Department<br />

Approval, Violate the First Amendment<br />

Police infracti<strong>on</strong>s of civil liberties are evident before, during, <strong>and</strong><br />

after dem<strong>on</strong>strati<strong>on</strong>s throughout the country. <str<strong>on</strong>g>The</str<strong>on</strong>g> next three secti<strong>on</strong>s,<br />

in that order, lay out strategies used by law enforcement that<br />

systematically violate the c<strong>on</strong>stituti<strong>on</strong>al rights of individuals<br />

nati<strong>on</strong>wide.<br />

Chilling Political Expressi<strong>on</strong> Before<br />

Dem<strong>on</strong>strati<strong>on</strong>s<br />

I<br />

n the late 1990s there was a noticeable shift from reactive<br />

law enforcement to preemptive law enforcement.<br />

Preemptive policing includes engaging in mass false<br />

arrests <strong>and</strong> a range of other activities designed to stop<br />

individuals before they engage in associative activities. False<br />

<strong>and</strong> pretextual arrests occurred before the 2000 World<br />

Bank/Internati<strong>on</strong>al M<strong>on</strong>etary Fund (IMF) dem<strong>on</strong>strati<strong>on</strong>s in<br />

Washingt<strong>on</strong>, D.C. Police also shut down a central meeting place<br />

<strong>and</strong> organizers’ offices while c<strong>on</strong>fiscating literature, signs, <strong>and</strong><br />

banners—materials clearly protected by the First Amendment—<br />

as well as medical supplies. <str<strong>on</strong>g>The</str<strong>on</strong>g>se tactics have been repeated at<br />

most large dem<strong>on</strong>strati<strong>on</strong>s following the World Bank/IMF<br />

protests, but in nearly all instances they are illegal. Probable<br />

cause must exist for each <strong>and</strong> every pers<strong>on</strong> arrested in order to<br />

c<strong>on</strong>stitute lawful arrest. 32<br />

Other pre-dem<strong>on</strong>strati<strong>on</strong> tactics include intimidati<strong>on</strong> by the media,<br />

police infiltrati<strong>on</strong>, passing unc<strong>on</strong>stituti<strong>on</strong>al ordinances in advance of<br />

specific dem<strong>on</strong>strati<strong>on</strong>s, <strong>and</strong> denying permits based <strong>on</strong> c<strong>on</strong>tent.<br />

Intimidati<strong>on</strong> by the Media<br />

One of the first measures is to deter people from attending<br />

dem<strong>on</strong>strati<strong>on</strong>s altogether. <str<strong>on</strong>g>The</str<strong>on</strong>g> media plays a large role in this by<br />

depicting protesters as violent <strong>and</strong> by showing striking images of<br />

weap<strong>on</strong>-bearing police officers in riot gear well in advance of a<br />

given event. Such early media coverage of anticipated c<strong>on</strong>fr<strong>on</strong>tati<strong>on</strong>s
