displaying press credentials, passers-by who had been attracted by<br />

the protesters’ message, <strong>and</strong> unknowing tourists <strong>and</strong> others who were<br />

in the area <strong>on</strong>ly by coincidence. <str<strong>on</strong>g>The</str<strong>on</strong>g> police then arrested nearly<br />

every<strong>on</strong>e caught in their trap, including lawful dem<strong>on</strong>strators,<br />

byst<strong>and</strong>ers, journalists, <strong>and</strong> tourists. Altogether more than 600 people<br />

were arrested. 113<br />

Because these arrests took place before the meetings <strong>and</strong> the main<br />

protests began, they rendered it difficult <strong>and</strong> frightening for arrested<br />

individuals to participate in dem<strong>on</strong>strati<strong>on</strong>s over the following two<br />

days. Such arrests discouraged others from participating in or<br />

observing those dem<strong>on</strong>strati<strong>on</strong>s by signaling to them that they might<br />

be arrested without cause. During these arrests, law enforcement<br />

took video footage of dem<strong>on</strong>strators from ground level <strong>and</strong> from<br />

nearby rooftops. Law enforcement also used the arrests as an<br />

opportunity to collect informati<strong>on</strong> <strong>on</strong> dem<strong>on</strong>strators, including their<br />

identificati<strong>on</strong>, photographs, fingerprints, <strong>and</strong> other informati<strong>on</strong>, <strong>and</strong><br />

to compile records <strong>on</strong> lawful dem<strong>on</strong>strators. 114<br />

<str<strong>on</strong>g>The</str<strong>on</strong>g> arrestees were held in harsh c<strong>on</strong>diti<strong>on</strong>s. <str<strong>on</strong>g>The</str<strong>on</strong>g>y were restrained in<br />

plastic h<strong>and</strong>cuffs that inflicted pain, discomfort, <strong>and</strong> distress.<br />

Arrestees were c<strong>on</strong>fined <strong>on</strong> buses <strong>and</strong> denied food <strong>and</strong> water, in<br />

some cases for as l<strong>on</strong>g as 18 hours. <str<strong>on</strong>g>The</str<strong>on</strong>g>y were denied use of a<br />

bathroom for hours, causing discomfort <strong>and</strong> humiliati<strong>on</strong>. Police<br />

denied them use of lawfully dispensed prescripti<strong>on</strong> medicati<strong>on</strong>s for<br />

preexisting c<strong>on</strong>diti<strong>on</strong>s. Arrestees were also denied use of a teleph<strong>on</strong>e<br />

to c<strong>on</strong>tact family members or attorneys. Metropolitan Police<br />

Department officers deliberately misinformed arrestees about their<br />

rights, falsely stating that detenti<strong>on</strong> would c<strong>on</strong>tinue, in some<br />

instances for days, unless detainees posted <strong>and</strong> forfeited fifty dollars.<br />

<str<strong>on</strong>g>The</str<strong>on</strong>g> police did not advise the detainees of the opti<strong>on</strong> to post fifty<br />

dollars <strong>and</strong> appear at a hearing to c<strong>on</strong>test the arrest. 115 This mass<br />

arrest is the subject of class acti<strong>on</strong> by the Partnership for Civil<br />

Justice. 116<br />

Intimidati<strong>on</strong> by FBI Questi<strong>on</strong>ing<br />

Three men in Denver who had planned to travel to a protest at the<br />

2004 Democratic Nati<strong>on</strong>al C<strong>on</strong>venti<strong>on</strong> instead were in court in St.<br />

Louis appearing before a gr<strong>and</strong> jury after being interviewed by the<br />

FBI. 117 <str<strong>on</strong>g>The</str<strong>on</strong>g> FBI’s Joint Terrorism Task Force c<strong>on</strong>ducted interviews
