Lawyers Guild, charged the District of Columbia <strong>and</strong> federal<br />

agencies with falsely arresting hundreds of dem<strong>on</strong>strators, observers,<br />

<strong>and</strong> passers-by <strong>on</strong> September 27. “D.C. <strong>and</strong> federal law-enforcement<br />

authorities executed an illegal <strong>and</strong> unc<strong>on</strong>stituti<strong>on</strong>al coordinated plan<br />

to sweep the streets of political activists <strong>and</strong> place them in preventive<br />

detenti<strong>on</strong>,” said attorney Carl Messineo. 134 <str<strong>on</strong>g>The</str<strong>on</strong>g> lawsuit also<br />

described severe <strong>and</strong> excessively l<strong>on</strong>g c<strong>on</strong>diti<strong>on</strong>s of c<strong>on</strong>finement,<br />

including people being shackled wrist to opposite ankle.<br />

D.C. Councilmember Patters<strong>on</strong> issued a press release summarizing<br />

the findings of an internal review of the MPD related to these mass<br />

arrests that stated, “Not <strong>on</strong>ly were arrests preemptive <strong>and</strong> wr<strong>on</strong>gful,<br />

not <strong>on</strong>ly was the detenti<strong>on</strong> inhumane, but officers in the field were<br />

directed to sign arrest forms that were inaccurate <strong>on</strong> their face.” 135<br />

<str<strong>on</strong>g>The</str<strong>on</strong>g> statement also provided a summary listing of the findings made<br />

in the report:<br />

• Police arrested byst<strong>and</strong>ers who had not participated in the<br />

dem<strong>on</strong>strati<strong>on</strong>s.<br />

• Before the arrests, police refused to allow those who wanted to<br />

leave Pershing Park to do so.<br />

• Those arrested were charged with “failure to obey a police<br />

order,” but witnesses, including law-enforcement officials, did<br />

not hear any orders being given to those who were subsequently<br />

arrested.<br />

• Arresting officers signed field-arrest forms affirming that in each<br />

case they saw the pers<strong>on</strong> arrested engage in unlawful activity <strong>and</strong><br />

subsequently gave an order warning the pers<strong>on</strong> to cease to<br />

engage in that activity. In fact, not a single arresting officer gave<br />

or observed a police warning.<br />

• Following arrest <strong>and</strong> transport to the police academy, those<br />

arrested were held for up to an additi<strong>on</strong>al 18 hours due to<br />

computer-caused processing delays. <str<strong>on</strong>g>The</str<strong>on</strong>g> department failed to<br />

implement a manual backup system.<br />

• Detainees were restrained with plastic “flexicuffs” with <strong>on</strong>e wrist<br />

tethered to the opposite ankle so that detainees could not st<strong>and</strong><br />

up or lie pr<strong>on</strong>e. <str<strong>on</strong>g>The</str<strong>on</strong>g> report claims that this does not c<strong>on</strong>stitute<br />

“hog tying,” although the department’s own definiti<strong>on</strong>, which<br />

prohibits the practice, states that hog tying is a restraint that<br />

forces the legs <strong>and</strong> h<strong>and</strong>s to be close to <strong>on</strong>e another.<br />

• <str<strong>on</strong>g>The</str<strong>on</strong>g>re were procedural errors in the arrests, the choice of<br />

charges, <strong>and</strong> the manner of arrest documentati<strong>on</strong>.
