Abstract<br />

The present study is to one of the<br />

proposals for amending current criminal<br />

procedural provisions contained in the<br />

draft new Co<strong>de</strong> of Criminal Procedure<br />

established in February 25, 2009 - namely<br />

the introduction of express among the<br />

basic principles of criminal procedure and<br />

the alternative of "waiver of prosecution<br />

criminal "by the prosecutor.<br />

The author presents in this study their<br />

views on the proposal <strong>de</strong>scribed, and<br />

motivating them by analyzing the<br />

consequences that these changes might<br />

have on institutions that implement the<br />

criminal procedural provisions, to that of<br />

the parties involved in relationships as<br />

criminal and criminal procedural law and,<br />

finally, the judicial process itself.<br />

The study also refers to some aspects of<br />

comparative law frequently used by the<br />

author in motivating their views on issues<br />

consi<strong>de</strong>red.<br />
