Abstract<br />
The paper that we submit to your<br />
attention try to analyse the <strong>de</strong>legation of<br />
legislative powers, an institution of the<br />
constitutional law who has, lately,<br />
received ad<strong>de</strong>d importance in the relation<br />
between the Parliament and the<br />
Government, mainly in the process of<br />
drafting and enacting law-<strong>de</strong>crees.<br />
The present study attempts to present<br />
some issues that we <strong>de</strong>veloped on this<br />
institution, in recently practice on our<br />
country. We also try to present some<br />
possible and dangers posed to the proper<br />
functioning of the institutions of the state,<br />
the possibility of <strong>de</strong>formation of the<br />
relations between the legislative and the<br />
executive following the excessive, and<br />
sometimes unjustified use of this<br />
constitutional instrument.<br />
Finally, we try to suggest some<br />
solutions, talk about the need for further<br />
reflections on the phenomenon of<br />
<strong>de</strong>legation of legislative powers through<br />
the prism of the current practice, process<br />
that will lead to concrete legislative<br />
changes wich we consi<strong>de</strong>r absolutly<br />
necessary for the proper functioning of<br />
<strong>de</strong>mocracy state and rule of law.<br />
