cooperative covered under secti<strong>on</strong> 64 <strong>of</strong> the Landst<strong>in</strong>g Act <strong>on</strong> municipal councils and local<br />

authorities, etc. or a local authority, liability to pay a f<strong>in</strong>e may be <strong>in</strong>curred by the relevant<br />

public authority as such.<br />

Subsecti<strong>on</strong> 5. If the relevant party is not resident <strong>in</strong> <strong>Greenland</strong> or his c<strong>on</strong>necti<strong>on</strong> to<br />

<strong>Greenland</strong> society is otherwise so remote that the prerequisites for measures to be taken do<br />

not exist, legal proceed<strong>in</strong>gs may be <strong>in</strong>stigated or the case may be referred for trial <strong>in</strong><br />

Denmark.<br />

Secti<strong>on</strong> 10. In the cases stipulated <strong>in</strong> secti<strong>on</strong> 9(5), c<strong>on</strong>traventi<strong>on</strong>s <strong>of</strong> secti<strong>on</strong>s 4-8 shall be<br />

punishable by f<strong>in</strong>e or impris<strong>on</strong>ment for a period not exceed<strong>in</strong>g 1 year.<br />

Subsecti<strong>on</strong> 2. The penalty may be <strong>in</strong>creased to impris<strong>on</strong>ment for a period not exceed<strong>in</strong>g 2<br />

years if<br />

1) the c<strong>on</strong>traventi<strong>on</strong> has caused damage to life or health or risk <strong>of</strong> such damage;<br />

2) an <strong>in</strong>juncti<strong>on</strong> or order has previously been issued <strong>in</strong> c<strong>on</strong>necti<strong>on</strong> with the same or<br />

equivalent situati<strong>on</strong>s; or<br />

3) the c<strong>on</strong>traventi<strong>on</strong> has produced or has been <strong>in</strong>tended to produce f<strong>in</strong>ancial benefits to the<br />

c<strong>on</strong>travener or others.<br />

Subsecti<strong>on</strong> 3. Companies etc. (legal pers<strong>on</strong>alities) may be liable to punishment accord<strong>in</strong>g<br />

to the provisi<strong>on</strong>s <strong>of</strong> chapter 5 <strong>of</strong> the Penal Code.<br />

Entry <strong>in</strong>to force<br />

Secti<strong>on</strong> 11. This regulati<strong>on</strong> shall enter <strong>in</strong>to force <strong>on</strong> 1 July 2009. However, secti<strong>on</strong> 6 shall<br />

not enter <strong>in</strong>to force until 31 December 2010.<br />
