<str<strong>on</strong>g>Order</str<strong>on</strong>g> <strong>on</strong> <strong>technical</strong> regulati<strong>on</strong> <strong>on</strong> <strong>safety</strong> <strong>of</strong> navigati<strong>on</strong><br />

<strong>in</strong> <strong>Greenland</strong> territorial waters<br />

In pursuance <strong>of</strong> secti<strong>on</strong> 1(3), secti<strong>on</strong> 3, secti<strong>on</strong> 6 and secti<strong>on</strong> 32 <strong>of</strong> the Act <strong>on</strong> Safety at<br />

Sea, cf. C<strong>on</strong>solidated Act no. 903 <strong>of</strong> 12 July 2007, as put <strong>in</strong>to force by Decree no. 882 <strong>of</strong> 25<br />

August 2008 <strong>on</strong> the entry <strong>in</strong>to force <strong>of</strong> the Act <strong>on</strong> Safety <strong>of</strong> Sea <strong>in</strong> <strong>Greenland</strong>, after<br />

c<strong>on</strong>sultati<strong>on</strong> with the <strong>Greenland</strong> Home Rule and by authority, the follow<strong>in</strong>g provisi<strong>on</strong>s are<br />

laid down:<br />

Applicati<strong>on</strong><br />

Secti<strong>on</strong> 1. This regulati<strong>on</strong> shall apply to all cargo ships with a gross t<strong>on</strong>nage <strong>of</strong> or above<br />

150 and ships carry<strong>in</strong>g more than 12 passengers and engaged <strong>in</strong> voyages <strong>in</strong> <strong>Greenland</strong><br />

territorial waters with the excepti<strong>on</strong>s stipulated <strong>in</strong> subsecti<strong>on</strong> 2.<br />

Subsecti<strong>on</strong> 2. Secti<strong>on</strong>s 5-7 shall not apply to foreign ships that <strong>on</strong>ly pass <strong>Greenland</strong><br />

territorial waters. 1<br />

Def<strong>in</strong>iti<strong>on</strong>s<br />

Secti<strong>on</strong> 2. An “iceberg” shall mean ice broken away from a glacier and ris<strong>in</strong>g more than 5<br />

metres above the sea, as def<strong>in</strong>ed by the Internati<strong>on</strong>al Hydrograpic Organizati<strong>on</strong>.<br />

Subsecti<strong>on</strong> 2. “Pass” shall mean that foreign ships traverse outer <strong>Greenland</strong> territorial<br />

waters without enter<strong>in</strong>g <strong>in</strong>ner waters or that ships, without <strong>in</strong>terrupti<strong>on</strong> and appropriately fast,<br />

call at a roadsted or port facility.<br />

Subsecti<strong>on</strong> 3. “Territorial waters” shall mean waters with<strong>in</strong> the base l<strong>in</strong>e as stipulated <strong>in</strong><br />

Decree no. 191 <strong>of</strong> 27 May 1963 <strong>on</strong> the delimitati<strong>on</strong> <strong>of</strong> the territorial waters around <strong>Greenland</strong>,<br />

as amended by Decree no. 636 <strong>of</strong> 6 September 1991 and by Decree no. 1004 <strong>of</strong> 15 October<br />

2004, as well as the outer territorial waters extend<strong>in</strong>g 3 nautical miles from the base l<strong>in</strong>e. The<br />

base l<strong>in</strong>e is shown <strong>in</strong> <strong>of</strong>ficial charts published by the Nati<strong>on</strong>al Survey and Cadastre.<br />

Subsecti<strong>on</strong> 4. A “track” shall mean a navigati<strong>on</strong> route previously navigated by own or<br />

other ships without underwater obstacles hav<strong>in</strong>g been observed.<br />

Report<strong>in</strong>g<br />

Secti<strong>on</strong> 3. All ships engaged <strong>on</strong> voyages to <strong>Greenland</strong> waters shall submit GREENPOS<br />

reports 2 and shall, up<strong>on</strong> request, submit copies to the Danish Maritime Authority <strong>of</strong> the valid<br />

certificates carried <strong>on</strong> board.<br />

Regulati<strong>on</strong>s <strong>on</strong> passage as well as exempti<strong>on</strong>s from requirements for design, c<strong>on</strong>structi<strong>on</strong>, mann<strong>in</strong>g or<br />

equipment are found <strong>in</strong> promulgati<strong>on</strong> no. 17 <strong>of</strong> 21 July 2005 <strong>of</strong> the United Nati<strong>on</strong>s C<strong>on</strong>venti<strong>on</strong> <strong>on</strong> the Law <strong>of</strong><br />

the Seas <strong>of</strong> 10 December 1982.<br />

Navigati<strong>on</strong>al measures<br />

Secti<strong>on</strong> 4. Navigati<strong>on</strong> is prohibited <strong>in</strong> areas delimited <strong>in</strong> the charts by a dotted l<strong>in</strong>e<br />

<strong>in</strong>form<strong>in</strong>g about “numerous rocks” or similar <strong>in</strong>dicati<strong>on</strong> <strong>in</strong> other countries’ charts.<br />

Subsecti<strong>on</strong> 2. Navigati<strong>on</strong> is prohibited <strong>in</strong> areas <strong>in</strong>dicated <strong>in</strong> the charts as “foul” or<br />

“unsurveyed” or similar <strong>in</strong>dicati<strong>on</strong> <strong>in</strong> other countries’ charts or where sound<strong>in</strong>g is not<br />

<strong>in</strong>dicated <strong>in</strong> a greater area.<br />

Subsecti<strong>on</strong> 3. The waters menti<strong>on</strong>ed <strong>in</strong> subsecti<strong>on</strong> 2 may be navigated if the ship follows<br />

previously used tracks that the master has assessed as hav<strong>in</strong>g a sufficient <strong>safety</strong> marg<strong>in</strong> <strong>in</strong><br />

relati<strong>on</strong> to the ship’s draught and breadth.<br />

Subsecti<strong>on</strong> 4. The waters menti<strong>on</strong>ed <strong>in</strong> subsecti<strong>on</strong> 2 may be navigated if all the measures<br />

are taken <strong>on</strong> board necessary for the voyage to be safe, <strong>in</strong>clud<strong>in</strong>g:<br />

1) The positi<strong>on</strong> <strong>of</strong> the ship is determ<strong>in</strong>ed by means <strong>of</strong> terrestrial and/or radar navigati<strong>on</strong>;<br />

2) Only the speed necessary to ma<strong>in</strong>ta<strong>in</strong> the ship’s manoeuvrability is used;<br />

3) The sea <strong>in</strong> fr<strong>on</strong>t <strong>of</strong> the ship is explored by means <strong>of</strong> sound<strong>in</strong>gs or the like to the extent such<br />

a possibility is available;<br />

4) Watertight doors, hatches and similar below the waterl<strong>in</strong>e are closed to ensure the<br />

watertight <strong>in</strong>tegrity <strong>of</strong> the ship;<br />

5) Prohibiti<strong>on</strong> aga<strong>in</strong>st unnecessary stay <strong>on</strong> deck below the waterl<strong>in</strong>e is established.<br />

6) Stern anchors are lowered to warn <strong>of</strong> underwater obstacles if deemed appropriate, am<strong>on</strong>g<br />

other th<strong>in</strong>gs <strong>in</strong> c<strong>on</strong>siderati<strong>on</strong> <strong>of</strong> the expected character <strong>of</strong> the seabed; and<br />

Subsecti<strong>on</strong> 5. Ships shall navigate with <strong>in</strong>tensified vigilance <strong>in</strong> c<strong>on</strong>siderati<strong>on</strong> <strong>of</strong> the danger<br />

<strong>of</strong> unknown underwater obstacles <strong>in</strong> areas where depths are <strong>in</strong>dicated by means <strong>of</strong> a s<strong>in</strong>gle<br />

sound<strong>in</strong>g l<strong>in</strong>e. Such sound<strong>in</strong>g l<strong>in</strong>es may <strong>on</strong>ly be c<strong>on</strong>sidered as rec<strong>on</strong>naissance.<br />

Subsecti<strong>on</strong> 6. Intensified lookout for ice shall be made through the use <strong>of</strong> all available<br />

means when navigat<strong>in</strong>g <strong>in</strong> waters where there may be a risk <strong>of</strong> collid<strong>in</strong>g with ice <strong>of</strong> a size that<br />

may pose a danger to the ship. The speed shall be adjusted so that it is possible for the ship to<br />

stop or sail around ice that may harm the ship. In the dark, the ship shall use ice searchlights<br />

to light up the sea <strong>in</strong> fr<strong>on</strong>t <strong>of</strong> the ship. 3<br />

Subsecti<strong>on</strong> 7. Ships shall keep a safe distance to icebergs and the master shall determ<strong>in</strong>e<br />

<strong>safety</strong> distances to icebergs <strong>in</strong> c<strong>on</strong>siderati<strong>on</strong> <strong>of</strong> the <strong>safety</strong> <strong>of</strong> the ship, the crew and the<br />

passengers. If it is necessary <strong>in</strong> order to call at a port, roads or place or <strong>in</strong> order to navigate<br />

narrow waters or the like to sail close to icebergs, the greatest possible distance shall be<br />

observed permitted by the actual c<strong>on</strong>diti<strong>on</strong>s <strong>of</strong> the waters.<br />

Navigator’s qualificati<strong>on</strong>s<br />

Secti<strong>on</strong> 5. Ships shall have at least <strong>on</strong>e navigator available <strong>on</strong> board with the necessary<br />

local knowledge <strong>of</strong> the waters to be navigated<br />

Subsecti<strong>on</strong> 2. The shipp<strong>in</strong>g company shall be able to document the navigator’s experience<br />

with and knowledge <strong>of</strong> navigati<strong>on</strong> <strong>in</strong> Arctic desolate and icy waters.<br />

Subsecti<strong>on</strong> 3. The navigator shall have the qualificati<strong>on</strong>s that would give him the right to<br />

navigate the ship <strong>in</strong> questi<strong>on</strong>. However, a valid certificate <strong>of</strong> competency shall not be<br />

required.<br />

Equipment<br />

Secti<strong>on</strong> 6. Open survival craft may not form part <strong>of</strong> the ship’s rescue emergency<br />

preparedness.<br />

Design<br />

Secti<strong>on</strong> 7. Navigati<strong>on</strong> <strong>in</strong> ice may form part <strong>of</strong> the plann<strong>in</strong>g <strong>of</strong> the ship’s voyage <strong>on</strong>ly if the<br />

structural design <strong>of</strong> the ship is <strong>in</strong>tended for navigati<strong>on</strong> <strong>in</strong> the relevant type <strong>of</strong> ice.<br />

Safety management<br />

Secti<strong>on</strong> 8. Ships required to have a <strong>safety</strong> management system accord<strong>in</strong>g to the<br />

Internati<strong>on</strong>al Safety Management (ISM) Code shall have procedures and c<strong>on</strong>t<strong>in</strong>gency plans<br />

that take <strong>in</strong>to c<strong>on</strong>siderati<strong>on</strong> the special c<strong>on</strong>diti<strong>on</strong>s related to navigati<strong>on</strong> <strong>in</strong> Arctic waters,<br />

<strong>in</strong>clud<strong>in</strong>g the exist<strong>in</strong>g search and rescue emergency preparedness.<br />

Subsecti<strong>on</strong> 2. The procedures and c<strong>on</strong>t<strong>in</strong>gency plans menti<strong>on</strong>ed <strong>in</strong> subsecti<strong>on</strong> 1 shall be<br />

drawn up <strong>in</strong> c<strong>on</strong>siderati<strong>on</strong> <strong>of</strong> the guidel<strong>in</strong>es for navigati<strong>on</strong> <strong>in</strong> Arctic, ice-covered and desolate<br />

areas adopted by the IMO. 4<br />

Penalty clauses<br />

Secti<strong>on</strong> 9. In case <strong>of</strong> c<strong>on</strong>traventi<strong>on</strong>s <strong>of</strong> secti<strong>on</strong>s 4-8, measures may be laid down <strong>in</strong><br />

accordance with the Crim<strong>in</strong>al Code for <strong>Greenland</strong>.<br />

Subsecti<strong>on</strong> 2. It shall be regarded as aggrevat<strong>in</strong>g circumstances if:<br />

1) the c<strong>on</strong>traventi<strong>on</strong> has caused damage to life or health or risk <strong>of</strong> such damage;<br />

2) an <strong>in</strong>juncti<strong>on</strong> or order has previously been issued <strong>in</strong> c<strong>on</strong>necti<strong>on</strong> with the same or<br />

equivalent situati<strong>on</strong>s; or<br />

3) the c<strong>on</strong>traventi<strong>on</strong> has produced or has been <strong>in</strong>tended to produce f<strong>in</strong>ancial benefits to the<br />

c<strong>on</strong>travener or others.<br />

Subsecti<strong>on</strong> 3. If the pr<strong>of</strong>its ga<strong>in</strong>ed through the c<strong>on</strong>traventi<strong>on</strong> are not c<strong>on</strong>fiscated <strong>in</strong><br />

pursuance <strong>of</strong> the provisi<strong>on</strong>s <strong>of</strong> the Crim<strong>in</strong>al Code, particular account shall, when met<strong>in</strong>g out<br />

penalties, <strong>in</strong>clud<strong>in</strong>g additi<strong>on</strong>al penalties, be taken <strong>of</strong> the scale <strong>of</strong> any ec<strong>on</strong>omic benefit<br />

achieved or sought.<br />

Subsecti<strong>on</strong> 4. If the c<strong>on</strong>traventi<strong>on</strong> has been committed by companies, etc. (legal entities),<br />

liability to pay a f<strong>in</strong>e may be <strong>in</strong>curred by the legal entity as such. If the c<strong>on</strong>traventi<strong>on</strong> has<br />

been committed by the State, the <strong>Greenland</strong> Home Rule, a municipality, a municipal<br />

cooperative covered under secti<strong>on</strong> 64 <strong>of</strong> the Landst<strong>in</strong>g Act <strong>on</strong> municipal councils and local<br />

authorities, etc. or a local authority, liability to pay a f<strong>in</strong>e may be <strong>in</strong>curred by the relevant<br />

public authority as such.<br />

Subsecti<strong>on</strong> 5. If the relevant party is not resident <strong>in</strong> <strong>Greenland</strong> or his c<strong>on</strong>necti<strong>on</strong> to<br />

<strong>Greenland</strong> society is otherwise so remote that the prerequisites for measures to be taken do<br />

not exist, legal proceed<strong>in</strong>gs may be <strong>in</strong>stigated or the case may be referred for trial <strong>in</strong><br />

Denmark.<br />

Secti<strong>on</strong> 10. In the cases stipulated <strong>in</strong> secti<strong>on</strong> 9(5), c<strong>on</strong>traventi<strong>on</strong>s <strong>of</strong> secti<strong>on</strong>s 4-8 shall be<br />

punishable by f<strong>in</strong>e or impris<strong>on</strong>ment for a period not exceed<strong>in</strong>g 1 year.<br />

Subsecti<strong>on</strong> 2. The penalty may be <strong>in</strong>creased to impris<strong>on</strong>ment for a period not exceed<strong>in</strong>g 2<br />

years if<br />

1) the c<strong>on</strong>traventi<strong>on</strong> has caused damage to life or health or risk <strong>of</strong> such damage;<br />

2) an <strong>in</strong>juncti<strong>on</strong> or order has previously been issued <strong>in</strong> c<strong>on</strong>necti<strong>on</strong> with the same or<br />

equivalent situati<strong>on</strong>s; or<br />

3) the c<strong>on</strong>traventi<strong>on</strong> has produced or has been <strong>in</strong>tended to produce f<strong>in</strong>ancial benefits to the<br />

c<strong>on</strong>travener or others.<br />

Subsecti<strong>on</strong> 3. Companies etc. (legal pers<strong>on</strong>alities) may be liable to punishment accord<strong>in</strong>g<br />

to the provisi<strong>on</strong>s <strong>of</strong> chapter 5 <strong>of</strong> the Penal Code.<br />

Entry <strong>in</strong>to force<br />

Secti<strong>on</strong> 11. This regulati<strong>on</strong> shall enter <strong>in</strong>to force <strong>on</strong> 1 July 2009. However, secti<strong>on</strong> 6 shall<br />

not enter <strong>in</strong>to force until 31 December 2010.<br />
