support to this Conclave follows recent steps by <strong>the</strong> Government of<br />

<strong>India</strong> to advance susta<strong>in</strong> ability <strong>in</strong> <strong>the</strong> country with <strong>the</strong> release of<br />

Voluntary Guidel<strong>in</strong>es on Corporate Governance and Responsibility <strong>in</strong><br />

<strong>India</strong> (see attachment 1).<br />

Human Rights<br />

Human rights <strong>in</strong> <strong>India</strong> are covered under “The protection of Human<br />

Rights Act, 1993 (As amended by <strong>the</strong> Protection of Human Rights<br />

(Amendment) Act, 2006-No. 43 of 2006)”. This is handled by <strong>the</strong><br />

“National Human Rights Commission” (see http://nhrc.nic.<strong>in</strong>/).<br />

At this webpage you will also f<strong>in</strong>d a copy of <strong>the</strong> above mentioned<br />

Human Rights Act. Cont<strong>in</strong>uous attempts are be<strong>in</strong>g made by <strong>the</strong><br />

Commission to address various Human Rights issues. Some of <strong>the</strong>se<br />

are be<strong>in</strong>g monitored as Programmes under <strong>the</strong> directions of <strong>the</strong><br />

Supreme Court.<br />

Child Labour and Right of Organization<br />

<strong>India</strong> is member of <strong>the</strong> International Labour Organization, and has<br />

ratified 40 of <strong>the</strong> ILO conventions. However, <strong>India</strong> has not ratified four<br />

of <strong>the</strong> ILO core conventions:<br />

o 087 Freedom of Association and Protection of <strong>the</strong> Right to<br />

Organize (1948)<br />

o 098 Right to Organize and Collective Barga<strong>in</strong><strong>in</strong>g (1949)<br />

o 138 M<strong>in</strong>imum Age Convention (1973)<br />

o 182 Elim<strong>in</strong>ation of <strong>the</strong> Worst Forms of Child Labour (1999)<br />

<strong>India</strong>’s domestic law on child labour, Child Labour (Prohibition and<br />

Regulation) Act (1986), ban employment of children <strong>in</strong> some dangerous<br />

occupations, such as factories and m<strong>in</strong>es, and regulate <strong>the</strong> work<strong>in</strong>g<br />

conditions <strong>in</strong> o<strong>the</strong>rs. Accord<strong>in</strong>g to this law, anyone above <strong>the</strong> age of 14<br />

will be regarded as an adult and will not be protected by <strong>the</strong> child<br />

labour regulations.<br />

Accord<strong>in</strong>g to UNICEF, <strong>in</strong>sufficient attention has been given <strong>in</strong> <strong>India</strong> to<br />

elim<strong>in</strong>ate <strong>the</strong> worst forms of child labour. The 1986 child labour law<br />

does not cover children <strong>in</strong> all sectors. <strong>India</strong> has <strong>the</strong> world’s highest<br />

number of child labourers’ under14 years.<br />
