As <strong>in</strong>dicated <strong>in</strong> <strong>the</strong> above discussion of <strong>the</strong> Ch<strong>in</strong>a — Media case, a<br />

comprehensive set of Ch<strong>in</strong>ese laws prohibit <strong>the</strong> publication and dissem<strong>in</strong>ation<br />

of specified types of “content” and a number of U.S. foreign<br />

media products and services have been denied entry <strong>in</strong>to Ch<strong>in</strong>a’s<br />

market as a result. In fact, <strong>the</strong>re are so many examples of banned or<br />

restricted U.S. media products <strong>in</strong> Ch<strong>in</strong>a that it is difficult to believe<br />

that <strong>the</strong> U.S. <strong>in</strong> <strong>the</strong> next few years will not challenge at least one of<br />

Ch<strong>in</strong>a’s prohibited content laws as constitut<strong>in</strong>g a prohibited trade<br />

barrier, 49 and <strong>in</strong> response to <strong>the</strong> U.S.’ allegations, Ch<strong>in</strong>a almost certa<strong>in</strong>ly<br />

would claim <strong>in</strong> such a <strong>WTO</strong> dispute proceed<strong>in</strong>g that <strong>the</strong> law<br />

is justified under <strong>the</strong> public morals exception to <strong>the</strong> <strong>WTO</strong> rules. The<br />

Ch<strong>in</strong>ese Government’s removal of <strong>in</strong>formation that it considers <strong>in</strong>appropriate<br />

that is posted on websites ma<strong>in</strong>ta<strong>in</strong>ed by Google and o<strong>the</strong>r<br />

providers has been well-publicized. 50 In June of 2009, Google’s<br />

“[s]earch functions and Gmail were <strong>in</strong>accessible for more than an hour<br />

<strong>in</strong> a move seen by web watchers as a warn<strong>in</strong>g shot across <strong>the</strong> bows by<br />

Ch<strong>in</strong>a’s censors . . . as [e]arlier <strong>in</strong> <strong>the</strong> day, <strong>the</strong> ma<strong>in</strong> state and communist<br />

party media—X<strong>in</strong>hua and People Daily—condemned Google for provid<strong>in</strong>g<br />

l<strong>in</strong>ks to pornographic websites through its search eng<strong>in</strong>e.” 51 The<br />
