RESOLUTION NO. 2290<br />
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF<br />
BONNEY LAKE, PIERCE COUNTY, WASHINGTON,<br />
AWARDING THE FENNEL CREEK TRAIL AND 192No AVENUE<br />
SIDEWALKS PROJECT PHASE 2 TO PIVETTA BROTHERS<br />
CONSTRUCTION INC.<br />
WHEREAS, the <strong>City</strong> <strong>of</strong> <strong>Bonney</strong> <strong>Lake</strong> desires to create opportunities for local<br />
children to walk to their local schools; and<br />
WHEREAS, the <strong>City</strong> <strong>of</strong> <strong>Bonney</strong> <strong>Lake</strong> received a grant from WSDOT in June <strong>of</strong><br />
2007 to partially fund these improvements; and<br />
WHEREAS, the <strong>City</strong> <strong>of</strong> <strong>Bonney</strong> <strong>Lake</strong> completed Phase 1 <strong>of</strong> this effort in the<br />
summer <strong>of</strong> 2010 which constructed sidewalks along l 92nd A venue East and several side<br />
streets; and<br />
WHEREAS, the <strong>City</strong> advertised the Fennel Creek Trail and 192nd Avenue<br />
Sidewalks Project Phase 2 and opened bids on April 3, 2013 and has determined the<br />
lowest responsive bidder for this contract was received from Pivetta Brothers<br />
Construction, Inc.;<br />
NOW, THEREFORE, BE IT RESOLVED that the <strong>City</strong> <strong>of</strong> <strong>Bonney</strong> <strong>Lake</strong><br />
Council does hereby authorize the Mayor to sign the attached contract with Pivetta<br />
Brothers Construction, Inc. in the amount <strong>of</strong> $771,220.00 which includes tax.<br />
BE IT FURTHER RESOLVED that the <strong>City</strong> <strong>of</strong> <strong>Bonney</strong> <strong>Lake</strong> Council does<br />
hereby authorize a 10% Construction Contingency ($77,122.00) amount based on the<br />
contract bid amount as well as a 5% Construction Engineering ($40,410.00) amount<br />
based on the contract bid.<br />

THIS CONTRACT, made and entered into thi~day <strong>of</strong> April , in the year <strong>of</strong><br />
2013 , by and between <strong>City</strong> <strong>of</strong> Bo1111ey Luke, Washington, a municipn.J corponllion, hereinafter<br />
designated as the "Owner," and Pivetta Brothers Construction, Inc. hereinafter<br />
designated as the "Contractor,"<br />
WITNESS ETH:<br />
That WHEREAS th Owner has heret9fore caused to be prepared, certain plans and specifications<br />
described as the Fennel Creek Trail & 192nd Ave. Sidewalks-Phase 2 and<br />
theContractordidonthe 3rd day <strong>of</strong> April 2013 ,filewiththeOwnera<br />
proposal to construct said work and agreed to accept as payment therefore the sum fully stated and set<br />
forth in the proposal, and<br />
WHEREAS, the said Contract Documents fully and accurately described the terms and conditions<br />
upon which the Contractor proposes to fnrnish said equipment, labor, materials, and appurtenances and<br />
perfom1 said work, together with the manner and time <strong>of</strong> furnishing same;<br />
IT IS THEREFORE AGREED, first, that a copy <strong>of</strong> said General Conditions and other Contract<br />
Documents filed with the Owner, as aforesaid, do, in all particulars, become a part <strong>of</strong> the Agreement and<br />
Contract by and between the parties hereto in all matters and things therein set forth and descdbed; and further,<br />
that the Owner and the Contractor hereby accept and agree to the terms and conditions <strong>of</strong> said Contract<br />
Documents as filed as completely as if said tenns and conditions and plans were herein set out in full.<br />

Administrative Recommendation:<br />
Background Summary: The <strong>City</strong> was awarded a Safe Routes to School Federal Grant for $1,098,000<br />
on June 1, 2007. Phase 1 comprised <strong>of</strong> sidewalk improvements along the l 92nd A venue E corridor and<br />
several side streets. Phase 1 was designed in 2008 and constructed in the summer <strong>of</strong>2010. Phase 2 is the<br />
trail portion <strong>of</strong> the program that will connect the Willowbrook subdivision community to the sidewalks<br />
completed in 2010 and ultimately to the schools (Victor Falls Elementary, Mountain View Junior High,<br />
and <strong>Bonney</strong> <strong>Lake</strong> High schools) on the east side <strong>of</strong> Fennel Creek.<br />
