INDEX OF ACRONYMS<br />

For ease of reference, acronyms have been added to visually indicate the applicability of an article to the following employee<br />

groups:<br />

FXT – Fixed Term Employee<br />

SE – Seasonal Employee<br />

ST – Student Employee<br />

FPT – Flexible Part Time Employee<br />

RPT – Regular Part Time Employee<br />

GO – Go Temp<br />

These acronyms are not intended to substitute for the language of the Collective Agreement. Reliance should only be placed on<br />

the actual text of the Collective Agreement.<br />

DEFINITIONS<br />

1.1 A "regular employee" is a public servant appointed under section 32 of the Public Service of Ontario Act, 2006 other<br />

than for a fixed term.<br />

1.2 “Regular Service" is that part of the Public Service composed of regular employees.<br />

1.3 A "fixed term employee” is a public servant appointed under Part III of the Public Service of Ontario Act, 2006 for a<br />

fixed term.<br />

1.4 "Fixed Term Service" is that part of the Public Service composed of fixed term employees.<br />

1.5 A "Regular part-time employee" is a regular part-time employee who has been appointed to the Regular Service.<br />

1.6 A “Seasonal employee” is a public servant appointed under Part III of the Public Service of Ontario Act, 2006 for a<br />

period of at least eight (8) consecutive weeks to an annually recurring full-time position in the Fixed Term Service in a<br />

ministry. For purposes of this definition full-time means a minimum of thirty-six and one-quarter (36 ¼) or forty (40)<br />

hours per week, as applicable.<br />

ARTICLE 1 - RECOGNITION<br />

(FXT, SE, ST, FPT, RPT, GO)<br />

1.1 The Ontario Public Service Employees Union (<strong>OPSEU</strong>) is recognized as the exclusive bargaining agent for a bargaining<br />

unit consisting of all employees employed within the two bargaining units (Unified and Correctional) which are the<br />

successor units to the six bargaining units as described by the Lieutenant Governor in Council in OIC 243/94 dated<br />

February 3, 1994, in the Tripartite Agreement between the Crown, <strong>OPSEU</strong> and AMAPCEO dated April 21, 1995, plus<br />

those employees included in the six bargaining units by the agreement of the Crown and <strong>OPSEU</strong> from February 3, 1994<br />

to December 31, 2008.<br />

1.2 For greater certainty, such employees include regular, fixed-term employees, students, GO Temps and such other<br />

employees as may be mutually agreed.<br />

1.3 For greater certainty, the Central Collective agreement shall apply to the employees employed in positions in the<br />

Bargaining Unit described in Article 1.1 and the Bargaining Unit shall be deemed to be amended in accordance with any<br />

agreement of the parties to amend any of the bargaining units listed therein.<br />

1.4 Where the Employer establishes a new classification or creates a new position, within an existing class, the Employer<br />

shall provide the Union with a copy of the class standard and/or position description, including bargaining unit status (if<br />

applicable), at the relevant MERC.<br />

1.5 Upon written request to the employee’s immediate supervisor, a regular employee in the bargaining unit shall be provided<br />

with a copy of his or her current position description and other documents, if they exist, related to the duties and<br />

responsibilities of the position, e.g. physical demands analysis. This information shall be provided within 20 working days<br />
