Unit Three: CEDAW and the Courts
CEDAW goes beyond these guarantees and mandates in Article 11 that States Parties prohibit
dismissals in work on grounds of being married or pregnant; and “to introduce maternity leave
with pay or with comparable social benefits without loss of former employment, seniority or
social allowances.”
2. What is the benefit of CEDAW
Under CEDAW, rights for women are based on three fundamental principles that provide a
foundation for the Articles of the Convention:
• Substantive Equality
• Non-discrimination
• State Obligations
The existence of a positive legal framework for women’s rights cannot automatically confer
rights on women. However, it does serve to legitimize women’s claims for rights; transforming
women from passive beneficiaries to active claimants. In other words, it creates a space for
women’s agency to assert their rights. 3
Topic 3: The Role of the Judiciary
1. What is the role of the judiciary in the promotion of women’s rights
The judiciary has a critical role in contributing to the achievement of substantive equality for
women in the country. Through the development of case law on women’s rights, and through
ensuring that the legal system is accessible to women, the judiciary helps to guarantee
women’s rights to effective remedies for violations of their rights.
