NOTE: Under Minnesota Rules Chapter 4695 <strong>the</strong> Commissioner <strong>of</strong> Health issues recommendations regarding proposed occupational<br />

regulation after reviewing <strong>the</strong> recommendations and reports issued by <strong>the</strong> Human Services Occupations Advisory Council (HSOAC).<br />

The Commissioner has <strong>the</strong> authority to establish registration through rulemaking. Also note that under Minn. Stat. §214.001 licensing<br />

is defined as a system <strong>of</strong> regulation whereby “a practitioner must receive recognition by <strong>the</strong> state <strong>of</strong> having met predetermined qualifications,<br />

and persons not so licensed are prohibited from practicing,” and registration is defined as a system <strong>of</strong> regulation whereby “<strong>the</strong><br />

only persons permitted to use a designated title are listed on an <strong>of</strong>ficial roster after having met predetermined qulifications.” This definition<br />

<strong>of</strong> registration departs from <strong>the</strong> standard definition used in o<strong>the</strong>r places throughout this report.<br />

produced a study <strong>of</strong> Health Care Reform and <strong>Occupational</strong> <strong>Regulation</strong> in<br />

Minnesota in 1995. Since 1996, <strong>the</strong> HSOAC process has not been funded and<br />

studies by <strong>the</strong> Department <strong>of</strong> Health are limited to those specifically mandated by<br />

<strong>the</strong> Legislature.
