when the defendant presents a prima<br />

facie showing that prior convictions<br />

were unconstitutional because they were<br />

uncounseled and resulted in confinement,<br />

the burden shifts to the state to prove the<br />

right to counsel was properly waived. (2).<br />

Waiver <strong>of</strong> counsel must be made on the<br />

record in open court, and in cases involving<br />

serious <strong>of</strong>fenses where the penalty includes<br />

confinement for more than six months, the<br />

waiver also must be in writing and filed with<br />

(1). When multiple charges arise from a<br />

criminal incident and share a common<br />

litigation history, pretrial incarceration<br />

on the multiple charges constitutes<br />

incarceration on the “pending charge” for<br />

the purposes <strong>of</strong> the triple-count provision<br />

<strong>of</strong> the speedy-trial statute, R.C. 2945.71(E).<br />

(2). Criminal charges arising out <strong>of</strong> the<br />

same criminal incident and brought<br />

simultaneously will always be deemed to<br />

have a “common litigation history” for<br />

the purposes <strong>of</strong> establishing incarceration<br />

solely on the “pending charge” within the<br />

meaning <strong>of</strong> R.C. 2945.71(E), even if they are<br />

prosecuted in separate jurisdictions.<br />
