9 374 pcs. of mobile phone parts bearing different trademarks. In September, 740 pairs of shoes bearing the mark PIERE<br />
CARDIN, whose value was over 119 000 LTL, were detained.<br />
The previous year, the number of detained perfumery products and their packages increased. The officers from<br />
Klaipėda TCO detained 86 472 pcs. of metal packages for perfume BURBERRY and 19 512 pcs. of glass perfume<br />
bottles bearing the trademark BRITNEY.<br />
In 2006, the number of detained goods belonging to the group endangering health and security, such as counterfeit<br />
automobile parts, toys, razors, increased. In June, the officers of Šiauliai TCO detained 99 720 pcs. of razors bearing the<br />
mark BLUE II, whose value was almost 4 300 LTL; in October, they detained 1 440 pcs. of toys bearing the trademarks<br />
WEST, BRIDGESTONE, BEIJING 2008; in August, the officers of Kaunas TCO detained 19 999 pcs. of counterfeit<br />
automobile parts bearing the protected mark GATES; in May 2006, the officers of Klaipėda TCO detained a large cargo<br />
with remote control panels bearing different counterfeit trademarks. Applications for action had already been lodged in<br />
respect of the protection of some trademarks, and, in respect of a great part of goods detained on the Customs` initiative,<br />
the applications for action were lodged to the Customs Department within the prescribed period. Over 50 000 pcs. of<br />
panels were destroyed.<br />
The rapidly increasing number of applications<br />
for action to protect intellectual property rights<br />
and constant improvement of Customs officers`<br />
qualification makes a significant impact on detecting<br />
violations. Last year, 165 applications for action<br />
by the Customs were received, 108 applications<br />
were prolonged. The greatest part comprises the<br />
applications for trademark protection, the number<br />
of applications for protecting patents and design has<br />
been increasing.<br />

In 2006, Customs officers detained over 620 000 pcs. of<br />
different counterfeit goods.<br />
Risk Management<br />
To identify risk indicators, the messages received<br />
from the Customs authorities of the EU member<br />
states, international Anti–fraud Information System,<br />
information received from the structural units of the<br />
Customs Department, territorial Customs offices<br />
are used. This information is evaluated, and central,<br />
territorial and local risk profiles are created taking into<br />
consideration the degree of risk. In 2006, 37 central<br />
risk profiles were created. The following risk indicators<br />
of import goods are prevailing: undeclared goods are carried in hiding–places, intellectual property rights are violated,<br />
incorrect commodity codes are indicated with a view to evading taxes, origin and other documents are falsified with a<br />
view to reducing taxes or avoiding the Customs valuation control procedures, companies are known adversely.<br />
The investigation of lighters, on releasing which for free circulation (in the case of Chinese origin) the antidumping<br />
duty was applied, should be mentioned as one of the most successful risk management operations carried out at the<br />
Lithuanian Customs. 6 cases have been established when the lighters were allegedly brought into Lithuania from Malaysia<br />
by indicating the Malaysian origin (0 rate import duty). The European Anti–Fraud Office (OLAF) submitted materials<br />
proving that the Malaysian enterprises do not have sufficient productive capacities to produce the quantities of lighters<br />
in question, and that the lighters had actually been produced in China, and later – transported to Malaysia where they<br />
were illegally granted the Malaysian origin. Upon performing the controls of economic and commercial activities of a<br />
Lithuanian company in respect of the said case and upon disclosing the violations, the antidumping duty due at the<br />
amount of 1 074 000 LTL was assessed additionally.<br />
